“I have had two spectacular Notre Dame law clerks. The traditional elite law schools dominate Supreme Court clerkships, with many justices hiring clerks from the same law schools they themselves attended and maintaining close links with faculty members. Barrett, who graduated from Notre Dame Law School, is the only member of the current court not to have a law degree from Harvard or Yale. Within that context, Notre Dame is scrapping with other law schools for the remaining clerkships and has performed well. Another conservative-aligned law school that is making inroads is George Mason University’s Antonin Scalia Law School in Virginia, which has also placed some graduates in Supreme Court clerkships.

Vance is also expected to begin holding news conferences with reporters as early as this week, the source said. At a closed-door fundraiser in Oklahoma City last week, Trump’s finance team was hoping the former president’s new running mate would raise $1 million. Everything we know about Mr. Trump today suggests that he will take his judicial cues not from the conservative legal establishment, as he did previously, but instead from the conservative legal movement’s extreme fringes. Mr. Trump’s decision to publicly align himself with Mr. Leo helped settle the nerves of establishment Republicans who were skeptical of the candidate’s ideological bona fides, and played a significant role in the 2016 election. As president, Mr. Trump selected all his nominees — Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett — from versions of the shortlist, which he periodically updated. In the past four years, however, Mr. Trump has soured on the conservative legal establishment. The Federalist Society credentials that were once essential for conservative lawyers aspiring to federal judgeships during Republican presidencies are, in Mr. Trump’s world, now apparently a liability.

CNN —As the conservative Supreme Court majority has won case after case in recent days, liberal dissenters are having their moment in the courtroom. Other justices stared out at spectators or down at notes, perhaps anticipating the next opinions, and dissents, to be revealed. The court majority reversed a 1984 milestone that required judges to defer to reasonable agency interpretations of their congressional mandates. Her oral dissent lasted nearly 15 minutes, about five minutes longer than Roberts’ rendition of the majority opinion. Though Justice Clarence Thomas’ decision in a major trademark case last week was unanimous, it prompted a sharp debate led by Justice Amy Coney Barrett over the use of history to decide the case. “There definitely is the potential formation here of an alternative or several alternative approaches to history that ultimately draw a majority,” Wolf said. “What we could be seeing is a more nuanced approach to using that history,” said Elizabeth Wydra, president of the progressive Constitutional Accountability Center. But in a striking concurrence that captured support from both liberal and conservative justices, Justice Elena Kagan asserted that the court’s historic analysis need not end with the late-18th century. Barrett’s concurrence said the dispute could have been dealt with based on the court’s past precedent with trademark law and stressed that just leaning on the nation’s trademark history wasn’t good enough.

The Supreme Court’s unanimous decision ensuring access to an abortion pill took no position on its safety or morality. Instead, Justice Brett M. Kavanaugh, writing for the court, focused entirely on standing. That is the legal doctrine that requires plaintiffs to show that they have suffered direct and concrete injuries in order to sue. Justice Antonin Scalia, who died in 2016, once succinctly summarized the standing doctrine, saying it requires plaintiffs to answer this question: “What’s it to you?”The plaintiffs in the case, doctors and medical associations who oppose abortion, had no good answer to that question, Justice Kavanaugh wrote. Their main theory was that there was a statistical possibility that some doctors may at some point work in an emergency room and have to treat patients suffering from complications after taking the pill, subjecting the doctors to “enormous stress and pressure” and putting making them choose between their consciences and their professional obligations.

Thomas received 103 gifts with a total value of more than $2.4 million between 2004 and 2023, the judicial reform group Fix the Court said in a report Thursday. Fix the Court's analysis found that Alito accepted 16 gifts worth a combined $170,095. Counting those gifts, Thomas' total two-decade haul is valued at nearly $4.2 million. The value and number of gifts Thomas received also eclipsed those accepted by eight retired or dead Supreme Court justices whose tenures overlapped his service on the court, which began in 1991. Antonin Scalia, a conservative justice who died in 2016 while on the court, accepted 67 gifts worth about $210,000 during his tenure, which began in 1986.

The email went out to members of Justice Clarence Thomas’s law clerk network late last month celebrating his newest addition to an exclusive club. “Crystal Clanton’s clerkship for OT ’24 was announced by Scalia Law today!” wrote an assistant to Virginia Thomas, the justice’s wife, who is known as Ginni. The email referred to the 2024 October term of the court, and the tone was jubilant: “Please take a look at these posts of congratulations and support. In 2019, at the Thomases’ urging, Ms. Clanton enrolled at Antonin Scalia Law School at George Mason University in Virginia, where Justice Thomas has taught. She received a full merit scholarship, according to another judge who later hired her.

The real question, then, is if Congress fails to act, should the administrative agencies be the second choice or the courts. I am confident that the administrative agencies are the better choice. Courts are not experts and are not responsive to the electorate. By contrast, administrative agency heads are appointed by the current president, who, the Electoral College notwithstanding, is responsive to the will of the people. Moreover, unlike judges, administrative agencies have true subject matter expertise, and that was the entire premise of the Chevron decision, as noted by no less a jurist than Justice Antonin Scalia.
