CNN —Supreme Court Justice Amy Coney Barrett stands apart. And that is why Barrett has become the best hope for what remains of the liberal wing, particularly after Trump’s election victory. As Trump returns to the White House, the Supreme Court may be even more positioned to check the balance of powers. Nonetheless, progressives have few options, and an uncertain horizon, and cannot help but imbue Barrett with hope. “As Justice Barrett said…,” is a common Kagan refrain, too.

Figuring out how to heal from intergenerational trauma is at the center of “Exhibiting Forgiveness,” a new semi-autobiographical film by acclaimed artist Titus Kaphar, starring actor André Holland. And Trump is all but guaranteed to resurface at the Supreme Court in coming weeks to clarify the sweeping criminal immunity the court bestowed on him in July. “As matters stand now, this feels like the court is keeping its powder dry in case the election explodes,” Carter Phillips, a veteran Supreme Court litigator, told CNN early last week. A poll released by the Annenberg Public Policy Center on Wednesday found 56% of Americans disapprove of the Supreme Court. Take, for instance, Trump’s ban on travel from predominately Muslim nations, which made repeat trips to the Supreme Court. The Supreme Court has already dipped into next month’s election in a few emergency cases, two of which involved third-party candidates trying to remain on state presidential ballots.

Handwritten notes from Justice Sandra Day O'Connor's papers on a major abortion case in 1989. The correspondence and notes foreshadow where O’Connor landed in the 1992 Planned Parenthood v. Casey case, when Justice Anthony Kennedy, hostile to Roe v. Wade in 1989, was ready to join O’Connor in upholding Roe. Accelerating the tensions all around was the time pressure of the Missouri case. O’Connor wrote that Kennedy said, “Roe is just flawed analytically” and that he wanted to “return this debate to democratic process” in the states. CNN —Lee Daniels may have a hit on Netflix with his latest project “The Deliverance,” but it has not come without controversy. The director has responded to backlash over the character Alberta, played by Glenn Close. The film is inspired by the true story of a Black family who said they were plagued by demons in their home back in 2011. It stars Andra Day, Mo’nique and Close as the mother of Day’s character. Supreme Court Justice Sonia Sotomayor speaks during a service for retired Supreme Court Justice Sandra Day O'Connor in the Great Hall at the Supreme Court in Washington, D.C., on Dec. 18, 2023. Marshal tasked with protecting Supreme Court justices' homes shot an alleged armed carjacker near the Washington residence of Associate Justice Sonia Sotomayor last week, authorities said Tuesday. The suspect, 18-year-old Kentrell Flowers of Southeast D.C., allegedly pulled a handgun on the marshal, who was in a parked car in the Northwest section of the city around 1:15 a.m. The marshal drew his own gun and "fired several shots at the suspect," the MPD said. Another marshal in a separate vehicle also fired at Flowers, who suffered non-life-threatening injuries, police said.

Thomas received 103 gifts with a total value of more than $2.4 million between 2004 and 2023, the judicial reform group Fix the Court said in a report Thursday. Fix the Court's analysis found that Alito accepted 16 gifts worth a combined $170,095. Counting those gifts, Thomas' total two-decade haul is valued at nearly $4.2 million. The value and number of gifts Thomas received also eclipsed those accepted by eight retired or dead Supreme Court justices whose tenures overlapped his service on the court, which began in 1991. Antonin Scalia, a conservative justice who died in 2016 while on the court, accepted 67 gifts worth about $210,000 during his tenure, which began in 1986.

CNN —The Supreme Court’s hearing Thursday on former President Donald Trump’s immunity claim will underline a historic power shift. Trump’s relationship has been complex with the court’s conservative majority – despite his instrumental role in establishing it. In sharp contrast, the court’s conservative majority has exerted its influence year after year, without interruption. “There is just much more intense vetting of Supreme Court justices,” said Pierson. “You can tell by the results of the court decisions over the past several years that it is fundamentally different.

Chief Justice Extols Legacy of Sandra Day O’Connor

Chief Justice John G. Roberts Jr. delivered a fond tribute to former Justice Sandra Day O’Connor on Thursday, celebrating her legacy as the first woman on the Supreme Court and her commitment to advancing civics and civility after her retirement. During an award ceremony at Duke University to recognize her contribution to civics education, Chief Justice Roberts reiterated his admiration of his former colleague, a crucial swing justice who was often referred to as the most powerful woman in America. He eulogized her in December shortly after her death at 93. “Sandra Day O’Connor expanded the public image of what it meant to look like a judge,” he said. The award was accepted by her son Scott O’Connor.

Recently, the Supreme Court justices Sonia Sotomayor and Amy Coney Barrett spoke together publicly about how members of the court speak civilly to one another while disagreeing, sometimes vigorously, about the law. Considerable disagreements on professional matters among the Supreme Court justices, important as they are, remain professional, not personal. They found some, and Justice Ginsburg wore them ever after. At about the same time, Justice O’Connor reminded me that our chief justice, William Rehnquist, had decided that he, too, needed something distinctive on his black robe. Justice O’Connor found at a European bookstall a picture of Lorenzo de’ Medici wearing similar stripes.

Retired Supreme Court Associate Justice Stephen Breyer is worried about a divided America. It concerns many, including retired Supreme Court Associate Justice Stephen Breyer. Attentive listening to the opposing view often "increased the chances of agreement or compromise," Breyer wrote. Though he was one of the broadly liberal justices, Breyer described playing games of bridge with right-leaning Chief Justice William Rehnquist, Justice Anthony Kennedy, Justice Sandra Day O'Connor, and their spouses. "What works for nine people with lifetime appointments won't work for the entire nation, but listening to one another in search of a consensus might help," Breyer wrote.

Opinion: The one thing Biden and Trump agree on

We’re looking back at the strongest, smartest opinion takes of the week from CNN and other outlets. That reference to Election Day is perhaps the only line in Trump’s speech that President Joe Biden would agree with. In another America, they would be collegial members of the Presidents Club, bonding over memories of how they overcame their thorniest challenges. “Biden sounded like he’s ready to go toe to toe with former President Donald Trump and win in November. Lower courts used the decision to uphold a 2020 National Marine Fisheries Service rule that herring fishermen pay for monitors who track their fish intake. Exit George SantosVideo Ad Feedback SE Cupp: Trump didn't pave the way for George Santos. In the week that Americans said goodbye to Rosalynn Carter, Henry Kissinger and Sandra Day O’Connor, it was jarring that Santos occupied our minds. But as SE Cupp argued, in a more rational world, Santos would have resigned from Congress long ago. • Join us on Twitter and Facebook“Many Republicans just don’t care,” wrote Zelizer. Ron Edmonds/APAs a 12-year-old girl in 1981, Traci Lovitt was riveted by the appointment of Sandra Day O’Connor as the first woman on the Supreme Court.

For nearly a quarter-century, Sandra Day O’Connor , who died Friday at age 93, was perhaps the most powerful woman in America, often casting the deciding vote when her Supreme Court colleagues divided 4-4 along ideological lines. Her decisions on issues including abortion, affirmative action, voting rights and the line between church and state often reflected a pragmatic middle ground that frequently aligned with mainstream public opinion. O’Connor’s retirement in 2006 sent the court in a new direction. Republican presidents selected justices devoted to formal theories that seek constitutional fealty regardless of contemporary social values. Where O’Connor took each case as it came, today’s majority views the litigation before it as part of a larger struggle over the Constitution’s meaning.
