A settlement has been reached in a defamation lawsuit pitting an electronic voting machine manufacturer targeted by allies of former President Donald Trump against a conservative news outlet that aired accusations of vote manipulation in the 2020 election. The Delaware lawsuit, which takes issue with Newsmax reports over a five-week period in late 2020, is one of several stemming from reports by conservative news outlets following the election. Smartmatic also is suing Fox News for defamation in New York and recently settled a lawsuit in the District of Columbia against the One America News Network, another conservative outlet. Dominion Voting Systems similarly filed several defamation lawsuits against those who spread conspiracy theories blaming its election equipment for Trump's loss. A Delaware judge agreed to send another 2020 election defamation case to trial Thursday, ruling that the Newsmax Media published false claims saying Smartmatic voting machines rigged the 2020 election. Florida-based voting machine company Smartmatic, alleging defamation, sued Newsmax Media, also based in Florida, in 2021, arguing that the network claimed its devices rigged the 2020 election. Former President Donald Trump and his allies have repeatedly claimed that the 2020 election was rigged. But in wins for Smartmatic, he ruled firmly that the rigged election claims were definitely false, published by Newsmax and specific to Smartmatic. Smartmatic's case is quite different, in large part because the voting machine company was used only in Los Angeles during the 2020 election.

The voting technology company Smartmatic reached a settlement on Tuesday in its defamation lawsuit against One America News Network, a far-right broadcaster, over the amplification of election falsehoods about the 2020 presidential election. The terms of the settlement were confidential and could not immediately be learned. Smartmatic filed the lawsuit in 2021, accusing OAN of amplifying baseless claims that Smartmatic had been involved in rigging the presidential election through its voting machines. In an unexpected twist in the courtroom on Tuesday — after jurors had been selected and opening statements delayed — Fox News agreed to a $787.5 million settlement. But even at less than half that amount, the settlement is still one of the largest ever in a defamation case. Caveats released in August said vehicles and plug-in hybrids assembled outside North America were not eligible for the $7,500 credit. The list of eligible vehicles is expected to grow as carmakers fine-tune their supply chains and catch up with demand. When the bank reports its quarterly earnings this week, analysts expect to see an enormous flight of deposits — that is, customers pulling their money from the bank — and losses.
Private equity firm Staple Street Capital valued Dominion at $80 million when it purchased a controlling stake in it in 2018. The Fox settlement was nearly 10 times that amount and far outstripped the $226 million average of four pre-election valuations cited in Fox's court papers. Dominion's damages claim in the Fox case was based upon a report it commissioned from an accounting expert, half of which remains under seal. It is difficult to place a dollar value on the U.S. voting-machine industry because Dominion and its competitors all are privately held. While Dominion's report cites dozens of lost clients due to Fox's coverage, the company still has landed recent contract renewals including in California's Republican-majority Kern County.

REUTERS/Mike BlakeDec 13 (Reuters) - Fox Corp (FOXA.O) Chairman Rupert Murdoch is set to be questioned under oath on Tuesday in a defamation lawsuit over his network’s coverage of unfounded vote-rigging claims during the 2020 U.S. presidential election. The deposition comes as special committees of the boards of directors for News Corp (NWSA.O) and Murdoch-controlled Fox Corp consider a proposal from Murdoch to re-combine, nearly a decade after the companies split. Murdoch will be questioned via videoconference on Tuesday and Wednesday by lawyers for Dominion, according to a filing in Delaware Superior Court. On Dec. 5, Murdoch’s eldest son and executive chair and CEO of Fox Corp (FOXA.O), Lachlan, sat for a deposition in Los Angeles. Murdoch’s other son, James Murdoch, was questioned in October.
