(AP) — The trial and conviction of a movie armorer in connection with a fatal shooting on the set of the Western movie “Rust” has given Alec Baldwin and his legal team a unusual window into how his own trial in the death could unfold. Baldwin’s trial is scheduled for July and will involve the same judge and prosecutors as well as many of the same witnesses. But Gutierrez-Reed's trial included previously undisclosed testimony from eyewitnesses to the shooting. “Alec Baldwin’s conduct and his lack of gun safety inside that church on that day is something that he’s going to have to answer for," prosecutor Kari Morrissey said in her closing arguments against Gutierrez-Reed. The filming of “Rust” moved to Montana after the shooting in New Mexico, under an agreement with Hutchins' widower, Matthew Hutchins, that made him an executive producer.

March 27 (Reuters) - Cinematographer Halyna Hutchins was killed on the New Mexico set of Western movie "Rust" in 2021 after live ammunition was mixed with dummy rounds. Five other live rounds were later found on the set by investigators. Investigators have not been able to establish where the live rounds found on the "Rust" set came from. Kenney has denied that the live rounds on set came from his company. Charging documents held Gutierrez-Reed responsible for "allowing live ammunition on the set," but not for bringing them to the production.
Andrea Reeb, the special prosecutor in the "Rust" criminal case has recused herself after Alec Baldwin's attorneys filed a motion to disqualify her, according to a Tuesday statement. "After much reflection, I have made the difficult decision to step down as special prosecutor in the 'Rust' case," said Reeb. "My priority in this case—and in every case I've prosecuted in my 25-year career—has been justice for the victim. She added, "I will not allow questions about my serving as a legislator and prosecutor to cloud the real issue at hand." Baldwin's lawyers filed the disqualification motion in early February on the basis that the involvement of special prosecutor Andrea Reeb was unconstitutional since she simultaneously serves as a New Mexico state legislator.

Two days after Baldwin's defense filed the Feb. 10 motion, special prosecutor Andrea Reeb wrote in an email: "We are a tad confused on your motion on the firearm enhancement." A couple hours later, Reeb sent a third email, admitting that the prosecutors were wrong and that she "100 percent" agreed with Baldwin's lawyers' evaluation of the firearm enhancement. "I will have our documents drafted to amend the criminal information to take off the firearm enhancement," she wrote. Days later, the prosecutors officially downgraded the charges, removing the firearm enhancement that could have landed Baldwin more than five years in prison if convicted.
Feb 20 (Reuters) - Prosecutors have downgraded the involuntary manslaughter charges against Alec Baldwin, reducing the possible prison time the Hollywood star may face for the 2021 fatal shooting on the set of the movie "Rust," charging documents showed. Carmack-Altwies filed altered charges for Baldwin and Gutierrez-Reed on Friday, removing the firearm enhancement and reducing their possible prison sentence from a minimum of five years to a maximum of 18 months. “We applaud the decision of the district attorney to dismiss the firearm enhancement and it was the right call, ethically, and on the merits," said Jason Bowles, an attorney for Gutierrez-Reed. In 2022, the criteria for applying the firearm enhancement -with the 5-year minimum prison sentence - was expanded to include when a weapon was simply "discharged" in the commission of a noncapital felony. Baldwin and Gutierrez-Reed are both expected to make an initial court appearance in Santa Fe, New Mexico, on Feb. 24.

Matthew Hutchins, the widower of Halyna Hutchins, will join as an executive producer on the movie, along with the original producers. Bianca Cline, the cinematographer for the Oscar-nominated "Marcel the Shell with Shoes On," will take over as the "Rust" cinematographer. Matthew Hutchins will also serve as an executive producer of a new documentary on his late wife's life and work. Halyna Hutchins' mother, father, and sister filed a separate civil suit against Baldwin last week, which Matthew is not directly involved in.
