Two years after an Alabama prisoner was spared when staff members struggled to execute him by lethal injection, officials plan to try again Thursday — using the rare method of nitrogen gas. He filed a federal lawsuit in March seeking to halt his execution, citing the state's past execution failures and concerns that the method of nitrogen hypoxia would add pain and prolong death. "The resolution of this case confirms that Alabama's nitrogen hypoxia system is reliable and humane," Marshall said in a previous statement. Alabama officials have insisted in court filings that nitrogen hypoxia is "painless because it causes unconsciousness in seconds" and death within minutes. "Whether by lethal injection or nitrogen suffocation, the myth of the 'humane execution' is a lie fewer and fewer people believe," Foa said in a statement.

CNN —An Alabama death row inmate who is set to be executed by lethal injection next week has asked the state to forgo an autopsy of his body after he is put to death, saying it would violate his religious beliefs as a practicing Muslim, a lawsuit says. Keith Gavin, who is set to be executed next Thursday or Friday, says his body will be subjected to an “invasive autopsy” that would violate his “sincerely held religious beliefs,” as well as Alabama state law, according to the complaint filed by his attorneys last month. After Mr. Gavin’s execution, there will be no question as to who or what caused Mr. Gavin’s death. CNN has reached out to the Alabama Department of Corrections and Alabama Attorney General Steve Marshall’s office for comment on the lawsuit. Ivey asked the state Department of Corrections to conduct a “top-to-bottom review of the state’s execution process” after the problems came into the national spotlight, CNN previously reported.

CNN —Alabama inmate Kenneth Smith was put to death Thursday night by nitrogen hypoxia, marking the nation’s first known execution to be carried out using that method. The execution process began at 7:53 p.m. CT Thursday, and Smith was pronounced dead at 8:25 p.m., according to Alabama Department of Corrections officials. Smith made a lengthy statement in front of the witnesses before the execution started, according to the pool reporters. By Jonathan Allen(Reuters) - If federal courts give the green light, Alabama plans on Thursday to pioneer the first new method of judicial execution since lethal injections were introduced in 1982. "If this execution is successful then we're going to see nitrogen hypoxia take off across the country," said Rev. Smith is scheduled to be the first prisoner subjected to the method, which Alabama refers to as 'nitrogen hypoxia,' on Thursday evening at Alabama's Holman Correctional Facility. Alabama Solicitor General Edmund LaCour told federal judges last week that the state has since developed "the most painless and humane method of execution known to man." This is the first time he has had to sign a form acknowledging the risk that an execution method poses to others in the execution chamber.

An Alabama inmate died after being “baked” to death in a sweltering prison cell described as “hotter than three hells,” his family alleged in a federal wrongful death lawsuit. T Unit, the mental health ward where Rutledge was held, was not included in the project, according to the lawsuit. Alleged negligence by corrections officersThe suit said that inmates in the T Unit had complained of “excessive heat” all weekend prior to Rutledge’s death. The evening of Rutledge’s death, the heat in T Unit was over 100 degrees, the lawsuit said, and the blistering temperature was “obvious” to officers who conducted periodic checks. Kay Ivey sought a pause in executions and ordered a “top-to-bottom” review of the state’s capital punishment system Monday after an unprecedented third failed lethal injection. Ivey also requested that Marshall not seek additional execution dates for any other death row inmates until the review is complete. In September, the state called off the scheduled execution of Alan Eugene Miller because of difficulty accessing his veins. Alabama in 2018 called off the execution of Doyle Hamm because of problems getting the intravenous line connected. Alabama should have imposed an execution moratorium after Hamm’s failed execution for the benefit of everyone, said Bernard Harcourt, an attorney who represented Hamm for years.
It is the second execution since September that the state has canceled because of difficulties with establishing an IV. Because the death warrant expired at midnight, the state must go back to court to seek a new execution date. Some three decades ago, a promise was made to Elizabeth’s family that justice would be served through a lawfully imposed death sentence. Smith was initially convicted in 1989, and a jury voted 10-2 to recommend a death sentence, which a judge imposed. The U.S. Supreme Court on Wednesday denied Smith’s request to review the constitutionality of his death sentence on those grounds.
