CVS Health , UnitedHealth Group and Cigna sued the Federal Trade Commission on Tuesday, claiming that the agency's case against drug supply chain middlemen over high insulin prices in the U.S. is unconstitutional. The FTC's in-house administrative process initiates a proceeding before an administrative judge who would hear the case. FTC commissioners then vote on that opinion. The Tuesday complaint argues that the FTC's process violates the companies' due process rights under the Fifth Amendment. The complaint comes a month after CVS, UnitedHealth Group and Cigna demanded FTC Chair Lina Khan and two other commissioners recuse themselves from the agency's in-house suit.

During hurricanes, the National Weather Service has said, 72% of deaths occur in homes, and of those, 54% occur in mobile homes. She also urged mobile home park residents to organize their communities and if there are complaints, to do it as a group, which is more effective.

The Major Supreme Court Cases of 2024No Supreme Court term in recent memory has featured so many cases with the potential to transform American society. In 2015, the Supreme Court limited the sweep of the statute at issue in the case, the Sarbanes-Oxley Act of 2002. In 2023, the Supreme Court temporarily blocked efforts to severely curb access to the pill, mifepristone, as an appeal moved forward. A series of Supreme Court decisions say that making race the predominant factor in drawing voting districts violates the Constitution. The difference matters because the Supreme Court has said that only racial gerrymandering may be challenged in federal court under the Constitution.

Tesla is being accused of taking steps to keep employees in Buffalo, New York, from unionizing, according to a complaint from the National Labor Relations Board. The policy restricted Tesla workers from "recording, unauthorized solicitating [sic] or promoting," and "creating channels and distribution lists," among other things, the complaint said. The Tesla Buffalo plant was supposed to manufacture solar panels, but has been used more recently to assemble electric vehicle charging equipment, and to house a team of AI software data labelers. Last month, the Buffalo plant was home to a number of job cuts put in place as part of a broader restructuring at the electric vehicle company. "Many people have taken sides,” says Sandrine, who didn't feel comfortable providing her last name given the sensitivity of the topic. Immediately following the Oct. 7 attacks, Macron condemned Hamas and supported Israel’s right to defend itself. “The explicit prohibition of Palestinian demonstrations is something very recent and, in my opinion, a massive political mistake,” Lazar says. The RN, which denounces mass immigration to France from largely Muslim countries, also views Israel as a beacon of democracy in the Arab world. "He needs to defend what [Hamas does] without saying he supports them directly" as part of the Palestinian cause, says Lazar.

Gaza Activist on Speaking Tour in France Faces Deportation

PARIS (Reuters) - A French court has approved the deportation of Palestinian activist Mariam Abudaqa, who came to France for a speaking tour in September and was put under house arrest after the Oct. 7 attack on Israel by Hamas militants. More than 10,000 people have been killed in Gaza by Israel's retaliatory assault on the enclave. "We are supposed to die without even saying ouch, without expressing pain," said Abudaqa of her arrest and speaking ban on Tuesday before the court decision came. The Conseil d'Etat, France's highest administrative court, based its ruling on Abudaqa's membership of the PFLP, stating that she occupies a "leadership" position. The court ruling does not specify by what date Abudaqa must leave and where she must go.

BERLIN (AP) — A German federal court on Tuesday denied two seriously ill men direct access to a lethal dose of a drug, arguing that the country's narcotics law stands in the way and that they could turn to assisted suicide to end their lives. The two men, one of whom has advanced multiple sclerosis and the other of whom has been through cancer, sought permission to acquire lethal doses of natrium-pentobarbital. In July, lawmakers failed to agree on new rules regulating assisted suicide after the country’s highest court struck down legislation which banned the practice when conducted on a “business” basis. Political Cartoons View All 1234 ImagesThe Federal Constitutional Court ruled in 2020 that the ban, which was introduced five years earlier, violated the rights of citizens to determine the circumstances of their own deaths by restricting their ability to seek assistance from a third party. The lawyer for the plaintiffs in Tuesday's case, Robert Rossbruch, said the verdict marked a “black day” and that he was likely to take the case to the constitutional court, German news agency dpa reported.

PARIS (Reuters) - Thousands of people waving Palestinian flags and chanting "Gaza, Paris is with you" gathered on Sunday for the first pro-Palestinian demonstration allowed by police in the French capital since the Oct. 7 Hamas attacks on Israel. Police said that the protest was authorised, unlike others, because the declaration by organisers condemned the Oct. 7 attacks on Israel, which killed 1,400 people. On Thursday, a protest was authorised at the last minute only after a Paris court overturned the police decision to ban it, and in the last few days, other protests have been authorised in cities across France. This came following a ruling by France's highest administrative court stating that pro-Palestinian protests were to be banned on a case-by-case basis, not systematically as an earlier instruction by the French interior minister had suggested. On the heels of that decision, a federal appeals court invalidated a federal law that bars an individual who is subject to a domestic violence restraining order from possessing a firearm. A three-judge district court panel struck down the plan in January, saying that race had been the predominant motivating factor. Three years ago, the Supreme Court limited the independence of the CFPB by invalidating its leadership structure. The court’s decision could impact whether the SEC and other agencies can conduct enforcement proceedings in-house, using administrative courts staffed with agency employees, or whether such actions must be brought in federal court. “It’s difficult to think of any other recent First Amendment cases in which the stakes were so high,” Jaffer added.

PARIS, Sept 29 (Reuters) - An adviser to France's top administrative court urged it on Friday to reject a class action lawsuit against the state alleging police inaction on racial profiling, saying the government could not be held at fault over a lack of reform. Six human rights groups petitioning the Conseil d'Etat (State Council) argued the police discriminate against young Arab and Black men during routine patrols. The State Council, of which the public rapporteur is a member, is not bound by such opinions but follows the adviser's lead in most cases. A lawyer for the rights groups, which include Amnesty International and Human Rights Watch, urged the council not to follow the recommendation. The rights groups' case is supported by statements from 40 victims as well as police.

A top court in France on Thursday upheld a new government decree barring children in public schools from wearing the abaya, a loosefitting, full-length robe worn by some Muslim women, in a blow to critics who had called the ban discriminatory and had filed an emergency petition to strike it down. The Council of State, France’s top administrative court, which has jurisdiction over disputes concerning civil liberties, ruled that the ban was not a “serious and obviously illegal infringement of a fundamental freedom.”Wearing an abaya is part of a “logic of religious affirmation,” the court said in a statement, adding that the ban was therefore in line with a French law that “prohibits the wearing by pupils of signs or clothing ostensibly expressing religious affiliation, either in and of themselves, or because of the pupil’s behavior.”Since 2004, students have not been able to wear “ostentatious” symbols that have a clear religious meaning, like Catholic crosses, Jewish skullcaps or Muslim head scarves, in middle and high schools.

Rubiales sacked Spain manager Julen Lopetegui two days before their 2018 World Cup campaign in Russia because the coach had a pre-agreement to join Real Madrid after the tournament. There was further controversy last year when members of the Spanish women's team mutinied against their coach Jorge Vilda. The RFEF backed Vilda who then cut 12 of the 15 players involved from the squad that went on to win the World Cup. Rubiales' actions on World Cup final day, and later defiance, have brought a torrent of public criticism in Spain and elsewhere, but also a backlash in some circles against feminism.

The prosecutor at the Spanish High Court, which has jurisdiction as the soccer final was abroad, has received several complaints alleging possible sexual aggression. The High Court prosecutor said on Monday the office would contact Hermoso to ask her if she wants to formalise a criminal complaint. World soccer governing body FIFA suspended Rubiales from all football-related activities for three months with immediate effect on Saturday. The Spanish government has strongly condemned Rubiales' actions but can not directly suspend or remove Rubiales from his post as president of the Spanish Royal Football Federation (RFEF), which is a private institution. Although Rubiales is already suspended, Spain's CSD said it would move ahead with its own case regardless.

BARCELONA, Spain (AP) — Facing his possible removal from office, the president of the Spanish soccer federation refused to resign Friday despite an uproar for kissing a player on the lips without her consent after the Women's World Cup final. The president of Spain's women's league, Beatriz Álvarez, told Spanish state broadcaster RTVE that she was not surprised because Rubiales' "ego is above his dignity." The only relevant institution to remain silent has been European soccer body UEFA, for which Rubiales is a vice president. Rubiales, who led the Spanish players' union for eight years before taking over as federation president in 2018, is currently heading the UEFA-backed bid to host the men's World Cup in 2030. "The speech by Mr. Rubiales before the general assembly of the Spanish soccer federation is absolutely incompatible with representing Spanish sports and with the values of an advanced society like Spain's," Spain's Higher Council for Sports said.

France has used an anti-terrorism unit to question some climate activists, the police confirmed to Reuters. Britain’s National Police Chiefs’ Council did not immediately respond to a request for comment and its interior ministry did not comment. Germany does not have a national policy targeting climate activists, who the government considers mainly non-extremist, a spokesperson for the country’s interior ministry said. "Climate protesters can perhaps be locked away, but the climate catastrophe will come anyway," Lachner said after being convicted in Berlin in July for glueing incidents last year and fined 2,700 euros. Courts push backThe Biden administration released guidelines this week that seek to toughen antitrust law, which restricts anticompetitive practices. Under Khan, the F.T.C. has also pushed courts to effectively lower the burden of proof required to show that a merger is anticompetitive. “But it often seems that courts will not let plaintiffs win an antitrust case based on circumstantial evidence.”The F.T.C. The last major shift in antitrust law, in the 1970s, came after decades of work by conservatives to push the law and courts in their direction.

CNN —The Federal Trade Commission said Wednesday it would appeal a decision from earlier this week by a district court judge allowing Microsoft to close its $69 billion Activision Blizzard merger. The FTC had asked for a preliminary injunction while a separate legal challenge to the merger unfolds in the agency’s in-house administrative court. Tuesday’s decision paved the way for Microsoft to potentially finalize the deal with Activision in a matter of days, ahead of a July 18 contractual deadline. Alternatively, the companies could mutually seek to extend that timeframe. Consummating the deal would turn Microsoft into the third largest video game publisher in the world, after Tencent and Sony.

CNN —A federal judge will not block Microsoft (MSFT) from closing its $69 billion deal to acquire video game giant Activision Blizzard, a defeat for US regulators who had asked for a temporary injunction while legal challenges to the merger unfold. Microsoft could potentially finalize the deal with Activision in a matter of days, ahead of a July 18 contractual deadline, or the parties could mutually seek to extend that timeframe. During a five-day hearing last month in federal court, Microsoft executives including CEO Satya Nadella testified that properties such as “Call of Duty” would not be restricted from competitors following the deal’s close. UK officials also previously moved to block the Activision merger in April, citing some of the same concerns the FTC raised in its case and triggering an appeal from Microsoft. “Microsoft and Activision have agreed with the CMA that a stay of the litigation in the UK would be in the public interest and the parties have made a joint submission … to this effect.”
