As President Joe Biden makes a final push to confirm judicial nominees before his term in office ends, he is on track to have appointed more federal judges of color than any president before him. If Cheeks is approved, Biden will have appointed 63 Black federal judges, the most of a presidency of any length, according to the Leadership Conference on Civil and Human Rights. Both Obama and Bill Clinton each appointed 62 Black judges over the course of their two terms. Senate Democrats vowed to confirm as many Biden nominees as possible before Trump takes office in January and Republicans take control of the Senate. They’ve confirmed dozens since Election Day, but these circuit nominees are in limbo amid some opposition from Democrats as well as GOP senators.

But holding the White House and Senate majority for another few weeks doesn’t guarantee Democrats will have an easy time processing the final batch of Biden appointees. “There is a push across the board from the White House and the Senate for Democrats to show up and do the job they were elected to do,” a senior White House official, asking for anonymity to speak candidly, told CNN. The White House official pointed to how Republican Texas Sen. John Cornyn on Saturday promised “no weekends, no breaks” to confirm Trump’s Cabinet once he took power, and the White House official encouraged Democrats to show that dedication to judges in Biden’s final stretch. “Regardless of party, the American people expect their leaders to prioritize the rule of law and ensuring the criminal justice system can function effectively in every stated,” said White House spokesperson Andrew Bates. On paper, President Biden’s nominee to fill a vacancy on the Third Circuit Court of Appeals is an archetypical candidate for a federal judgeship. Adeel Abdullah Mangi has a sterling legal education, which he followed with a distinguished career at a high-profile private firm mixing corporate litigation with important pro bono work. The candidate has another quality that was especially appealing to Biden, who has made diversifying the federal bench a key priority: Mangi would be the first Muslim American federal appellate judge in the United States. When Mangi appeared before the Senate Judiciary Committee in December for a hearing about this lifetime appointment, Republican senators did not ask him about his legal background or judicial philosophy. Such bad faith ambushes are Cruz’s stock in trade, especially since the Oct. 7 attack on Israel by Hamas.
