☆ Court ruling stops Louisiana from requiring Ten Commandments in classrooms for now

NEW ORLEANS — Louisiana’s plan to make all of the state’s public school classrooms post the Ten Commandments next year remains on hold under an order Wednesday by a federal appeals court in New Orleans. The state contends that deGravelles’ order affects only the five school districts that are defendants in a legal challenge. Jeff Landry signed the bill into law in June, prompting a group of Louisiana public school parents of different faiths to sue. Murrill, the Republican attorney general, has said she disagreed with deGravelles’ ruling and that the law is constitutional under Supreme Court precedents. In recent years, similar bills requiring the Ten Commandments to be displayed in classrooms have been proposed in states including Texas, Oklahoma and Utah.

WASHINGTON — Republicans are gearing up to lock in their remake of the judiciary under President-elect Donald Trump and a new Senate majority, including potentially installing several more conservative Supreme Court justices. Conservatives are prepared for Supreme Court retirements, with the most attention on Justice Samuel Alito, 74. NEW ORLEANS — Distinct minority groups cannot join together in coalitions to claim their votes are diluted in redistricting cases under the Voting Rights Act, a divided federal appeals court ruled Thursday, acknowledging that it was reversing years of its own precedent. At issue was a redistricting case in Galveston County, Texas, where Black and Latino groups had joined to challenge district maps drawn by the county commission. Circuit Court of Appeals initially upheld the decision before the full court decided to reconsider the issue, resulting in Thursday’s 12-6 decision. “Nowhere does Section 2 indicate that two minority groups may combine forces to pursue a vote dilution claim,” Jones, nominated to the court by former President Ronald Reagan, wrote. “To reach its conclusion, the majority must reject well-established methods of statutory interpretation, jumping through hoops to find exceptions,” Douglas wrote.

Behind the scenes, the conservative justice sought to put a thumb on the scale for states trying to restrict how social media companies filter content. The states enacted their laws in 2021 and, with variations, restricted the ability of social media platforms to filter third-party messages, videos and other content. Greg Abbott signed that state’s measure, he said, “there is a dangerous movement by social media companies to silence conservative viewpoints and ideas.” In Florida, Gov. Kagan added a footnote to her majority opinion buttressing that point and reinforcing Barrett’s view. But, despite Alito’s protest, Kagan had a majority signing her decision, which, at minimum, offers lower court judges a strong indication of the framework the high court majority would use in future online challenges.

The court ruled 6-3 that adjudication of cases by in-house judges violates the right to trial by jury. The challenge zeroed in on how the SEC enforces securities laws, including those prohibiting insider trading. A three-judge panel of the New Orleans-based 5th Circuit U.S. Court of Appeals ruled against the agency, prompting the SEC to ask the Supreme Court to intervene.

That sent lower courts scurrying into historical analyses to figure out if modern gun laws had some connection to the 18th Century. Roberts’ opinion said that lower courts were misunderstanding what the majority had said in that ruling. But Justice Ketanji Brown Jackson, a member of the court’s liberal wing, suggested it was the high court’s fault for not providing clarity for lower courts to follow. One deals with a Pennsylvania man’s challenge to a federal law prohibiting felons, including those who are non-violent, from possessing firearms. Solicitor General Elizabeth Prelogar presented that argument with an eye toward several other challenges pending to similar federal gun prohibitions that involve non-violent criminal activity.

Bump stocks allow a shooter to convert a semi-automatic rifle into a weapon that can fire at a rate of hundreds of rounds a minute. The federal rule made possession of a bump stock a crime punishable by up to 10 years in prison. Both the Trump and Biden administrations, as well as gun control groups, said the way bump stocks work mean they qualify as machine guns. Circuit Court of Appeals decided that the SEC exceeded its authority by adopting the rule in August 2023. The latest decision addressed rules covering private equity funds, hedge funds, venture capital funds and managers of funds for institutional investors such as pension funds and endowments, among others. Industry critics said this lack of transparency has hurt ordinary investors with indirect exposure to private funds, such as through pension and retirement plans. Private funds often attract well-heeled, sophisticated investors, and as a result have received less federal regulatory oversight than investments geared toward ordinary investors. Congress created the bureau in 2010 to protect consumers from financial scams. The payday lending groups sued over a 2017 bureau rule that prohibited attempts to withdraw payments from accounts after two consecutive tries failed due to insufficient funds. Because of that, the conservative appeals court tossed the payday lending rule. The Biden administration appealed to the Supreme Court in 2022. CNN Supreme Court analyst Steve Vladeck said the ruling is another instance of the high court not endorsing controversial opinions from the 5th Circuit.

Spectrum WT and two student leaders of the LGBTQ group filed an emergency petition with the high court asking that it be allowed to put on the show at West Texas A&M University. The brief order by the Supreme Court on Friday doesn’t resolve the issue but means the group will not be able to put on the performance while the litigation continues.
