CNN —The Supreme Court on Friday rejected a request from Robert F. Kennedy Jr. to appear on New York’s presidential ballot even though he suspended his campaign last month and backed former President Donald Trump. The high court turned away Kennedy’s longshot appeal without comment and there were no noted dissents. I want you to vote for Donald J. Trump,” Kennedy said. It’s the second presidential ballot access appeal to reach the Supreme Court in recent weeks, underscoring the spoiler role third party and independent candidates can play in tight elections. On Friday, the Supreme Court denied an emergency request from the Green Party to ensure presidential candidate Jill Stein could appear on the ballot in the battleground state of Nevada.

A US appeals court threw out the dismissal of an antitrust lawsuit accusing 10 large banks of overcharging investors on corporate bonds, saying the trial judge should have been recused because his wife owned stock in one of the banks. Liman, an appointee of former President Donald Trump, was assigned the lawsuit in April 2020 and dismissed it with prejudice in October 2021, three months after his wife sold $15,000 of Bank of America stock. The banks said Liman’s failure to uncover his conflict didn’t require recusal or reviving the case. But the appeals court found a “legitimate risk” that similar violations could undermine public confidence in the judicial process. US Supreme Court Chief Justice John Roberts highlighted in his 2021 annual report on the judiciary a need for judges to be vigilant about financial conflicts.

CNN —The Supreme Court on Tuesday declined an appeal from disgraced attorney Michael Avenatti, who argued that his extortion conviction was based on a vague anti-corruption law that shouldn’t apply to lawyers making settlement demands. On his broad point, at least, Avenatti’s argument has picked up some support from members of the Supreme Court’s conservative wing. Avenatti cited the Gorsuch opinion in his appeal and argued that the Supreme Court should invalidate the law. The Biden administration countered that Avenatti’s conduct was well within the plain meaning of the prohibition – in other words, not a fringe case – and that his appeal was foreclosed by earlier Supreme Court precedent. The New York-based 2nd US Circuit Court of Appeals declined to overturn Avenatti’s conviction last year.

CNN —Lawyers for E. Jean Carroll have asked a federal appeals court to expedite Donald Trump’s appeal of the verdict in their first trial in which a jury awarded Carroll $5 million in damages after finding Trump liable for defamation and battery in May 2023. The motion with the 2nd US Circuit Court of Appeals filed Tuesday cites Trump’s numerous attempts to delay both trials with Carroll as a signal that he’s likely to drag out the appeal. The jury in the second trial held in January determined Trump should pay Carroll $83.3 million in damages for defaming her. Her lawyers also asked the appeals court to consider the author’s progressing age. Carroll is an 80-year-old woman who has struggled mightily to obtain justice for almost five years,” the filing says.

CNN —The Supreme Court on Monday turned away Tesla CEO Elon Musk’s request to back out of a settlement agreement he struck with the Securities and Exchange Commission in 2018 over a series of tweets about the car maker that regulators alleged were fraudulent. To avoid enforcement, Musk agreed to a settlement that required him to have a company lawyer approve his social media posts about Tesla. Though he agreed to the “Twitter sitter” provision, Musk has subsequently challenged it as a violation of his First Amendment rights. The Supreme Court rejected Musk’s appeal without comment and there were no noted dissents. A US District Court and the 2nd US Circuit Court of Appeals rejected Musk’s request to declare the Twitter sitter provision unenforceable.

CNN —The Supreme Court will hear arguments Monday in an unusual First Amendment appeal from the National Rifle Association against a New York financial regulator who persuaded banks and insurance companies to sever ties with the gun rights group. The danger, she said, is that regulators in both red and blue states could start leaning on insurance companies and banks to drop coverage for disfavored advocacy groups or companies. Critics dubbed the policies “murder insurance.”If other insurance companies distanced themselves from the NRA, Vullo argues, it was because they no longer wanted to do business with the group. The Supreme Court held that such “informal censorship” was unconstitutional. The Supreme Court will hear a related case Monday, one that implicates the White House, federal agencies and social media.

CNN —A federal judge formally ordered Donald Trump to pay $83.3 million to E. Jean Carroll, endorsing the jury’s verdict from the defamation trial last month. This will be the second judgment Carroll has won against Trump. Last May, Trump appealed the verdict to the 2nd US Circuit Court of Appeals, which has not yet heard arguments. In the current case, a jury found Carroll should receive $83.3 million in damages to repair her reputation, to compensate her, and to punish Trump. The judge found that the prior verdict should carry over to statements at issue in the last trial since they were similar.

A NY court has blocked the first subpoena issued by a House GOP inquiry into Trump's hush-money prosecution. Ex-Manhattan prosecutor Mark Pomerantz had been ordered to submit to Judiciary Committee questioning Thursday. That's now on hold while committee chair Jim Jordan and DA Alvin Bragg continue fighting over the inquiry. Bragg's office must file court papers by Friday explaining why Pomerantz should not testify, and why Wednesday's decision should be overturned. Bragg has sued to fight the committee's inquiry into the hush-money prosecution, under which Trump is facing 34 felony counts of falsifying business records.

The Supreme Court unanimously decided that the Mall of America can challenge a lease it has with Sears. In 1991, the mall gave Sears a 100-year lease on a three-story location for just $10 per year. Mall of America objected, saying that landlords have a right to "adequate assurance of future performance" by whoever took over Sears' lease. The bankruptcy court overruled the mall's objection. That appeal too was dismissed, which led the mall to petition the Supreme Court.
