The ETF industry is gearing up for some potentially seismic changes in 2025 and beyond. Policy changes from the SEC are hard to predict, but the ETF industry appears to sense an opening to push new types of products. Private credit funds One big area of focus for the ETF industry is how to tap into the private credit boom that has become a key part of the U.S. financial system. Fund issuers will need the SEC to bless new types of constructions in order to get a private credit fund approved. "For the most part, private credit is an investment that is limited to sophisticated investors and not retail investors," said Brian Murphy, a partner at law firm Stradley Ronon.

As megacap tech stocks continue to fuel the rally on Wall Street, investors appear to be betting even more heavily that the big run for those market leaders will continue. Between the start of December and Feb. 2, tech sector funds brought in about $5.2 billion — more than double the next closest sector — according to Strategas. In fact, cumulative flows into all other sector funds combined have been net negative over the past three months. Not all tech sector funds will include every member of the Magnificent 7. Semiconductor stocks have been on a tear for more than a year, led by Nvidia , which has emerged as a leading stock in the excitement around artificial intelligence. That has helped the S & P 500 enter a new bull market and made the chipmakers an increasingly influential part of the major market indexes. "The % weight of the Semiconductors within the S & P 500 is now at nearly 9%. For example, the best-performing fund in the category so far this year is the VanEck Semiconductor ETF (SMH) . The Senate voted Thursday to confirm Democrat Anna Gomez to the Federal Communications Commission, breaking the deadlock at the agency that has lasted the entirety of the Biden presidency. Gomez's confirmation comes after a protracted battle to confirm Biden's initial pick for the commissioner seat, Gigi Sohn. As senators remained split on her confirmation, the FCC was left in a 2-2 deadlock of Republican and Democratic commissioners, limiting its agenda to items that both sides could agree on. That could include a push to return to net neutrality rules, which seek to prevent internet service providers from slowing or blocking service for select websites, for which President Joe Biden has voiced his support for. Disclosure: Comcast, an internet service provider, is also the owner of CNBC parent company NBCUniversal.

The Invesco QQQ Trust (QQQ) , which has even heavier exposure to Big Tech names, has brought in $5.8 billion of its own. "It's not really the overconcentration in the big names that worries me. It's actually the concentration in the big names compared to their earnings contribution," said Oktay Kavrak, director of communications and strategy at Leverage Shares. WASHINGTON, July 6 (Reuters) - The U.S. Senate Commerce Committee plans to vote next week on President Joe Biden's nominee for a key fifth seat on the U.S. Federal Communications Commission (FCC). In July 2021, Biden signed an executive order encouraging the FCC to reinstate net neutrality rules adopted under Democratic then-President Barack Obama in 2015. Biden's first nominee for the open seat, former FCC official Gigi Sohn, withdrew in March after three hearings. The FCC has raised mounting concerns about Chinese telecom companies which had won permission to operate in the United States decades ago. In 2019, the FCC voted to deny state-owned Chinese telecom firm China Mobile Ltd (0941.HK) the right to provide U.S. services and later withdrew U.S. authorizations for several other Chinese telecom carriers, including China Telecom Corp (0728.HK).

Peter Sohn never wanted to be a director, but after a 23-year career at Pixar, he's at the helm of his second feature — and it's his most personal work yet. Sohn went on to graduate from CalArts and worked at Disney and Warner Bros. before landing a job at Pixar. The two types of people in a workplaceThe biggest key to his success in building a long-lasting career at Pixar is learning "how to present yourself in a collaborative setting," Sohn says. "So much of the job in animation is about working with a lot of people, because this stuff is painstaking." Throughout his career, he's come to realize there are two types of people in a workplace: Ladder-climbers, who view projects as ways to get ahead in their own careers, and knife-sharpeners, or people who are critical and honest to help sharpen each other's talent to get better.

The iShares Russell 2000 ETF (IWM) and Invesco S & P 500 Equal Weight ETF (RSP) have attracted inflows of over $4 billion and about $1.8 billion, respectively, so far this month, according to FactSet. Both funds provide investors a way to get broad exposure to the stock market while reducing the impact of names such as Nvidia and Alphabet on their portfolios. "Interest in funds outside of core S & P exposure has increased with notable inflows and volumes into the equal-weight S & P 500 (RSP) and Russell 2000 (IWM) recently. These funds — along with a host of other non-Tech exposed ETFs — are seemingly a preferred way to play a catch-up trade," Strategas ETF strategist Todd Sohn said in a note to clients Tuesday. Another option for investors looking to diversify away from large technology companies could be international funds, Sohn said.

The movie is projected to debut with a modest $31 million to $41 million this weekend in the U.S., according to the Box Office Pro website. That is well shy of the recent $120.5 million haul for Sony’s critically acclaimed animated hit "Spider-Man: Across the Spider-Verse." Pixar is looking to rebound from the box office disappointment of 2022 release "Lightyear," the origin story of "Toy Story" hero Buzz Lightyear. "Judging Pixar on the recent past, history would not be kind," said SVB MoffettNathanson media analyst Michael Nathanson. But the move dealt a blow to creatives who had hoped their films would be seen on the big screen, according to one Pixar director who spoke on condition of anonymity.

Gigi Sohn withdrew her stalled nomination for the Federal Communications Commission on Tuesday after Joe Manchin (D., W.Va.) announced his opposition. Chair Jessica Rosenworcel will now have to advance her progressive agenda without a wingman, but her effort to kill a major media acquisition on the sly shows what she’s up to. Ms. Sohn blamed “unrelenting, dishonest and cruel attacks” for her failure to be confirmed in two Congresses. But she has a long record as an unrelenting partisan and her attacks on conservative media suggested she couldn’t be trusted to be fair-minded in regulating the airwaves.
Senator Joe Manchin (D-WV) speaks to reporters following the weekly Democratic caucus luncheon at the U.S. Capitol in Washington, D.C., U.S., November 29, 2022. Senator Joe Manchin said on Tuesday he will vote against confirming Gigi Sohn as a commissioner of the Federal Communications Commission (FCC), potentially imperiling her nomination by President Joe Biden. The open internet laws seek to bar internet service providers from blocking or slowing traffic or offering paid fast lanes. In July 2021, Biden signed an executive order encouraging the FCC to reinstate the open internet net neutrality rules. Gigi Sohn informed the White House that she is withdrawing her nomination for FCC commissioner. Gigi Sohn has withdrawn her nomination to serve as a commissioner on the Federal Communications Commission after a stalled confirmation process. Ms. Sohn informed the White House she would be withdrawing. The Washington Post reported about her decision earlier.
Gigi Sohn testifies during a Senate Commerce, Science and Transportation Committee confirmation hearing, examining her nomination to be appointed Commissioner of the Federal Communications Commission in Washington, D.C., February 9, 2022. Gigi Sohn, who was chosen by President Joe Biden to serve as telecommunications regulator to the Federal Communications Commission, said on Tuesday that she's withdrawing her nomination. After multiple hearings in the Senate Commerce Committee, it was still unclear if Sohn would have the votes for her nomination to pass the full Senate. During a 16-month battle with cable and media industry lobbyists, Sohn said she's been subject to "unrelenting, dishonest and cruel attacks" that have taken "an enormous toll" on her family. "And with the help of their friends in the Senate, the powerful cable and media companies have done just that."
Watch Out, Gigi Sohn Is Back

His Federal Communications Commission nominee Gigi Sohn proved too partisan for the last Senate to confirm. Yet he has renominated her even as the commission considers a dangerous rule-making that has flown under media radar. We’ve written before about Ms. Sohn’s left-wing views and desire for political control of the airwaves. As a counselor to Obama FCC Chair Tom Wheeler , Ms. Sohn championed the net-neutrality regulation that classified broadband providers as common carriers under Title II of the 1934 Communications Act. Those rules were repealed by the Trump FCC to the great benefit of new investment and competition.
Gigi Sohn, who was nominated in October 2021, will have her third hearing for the job before the Senate Commerce Committee on Tuesday. Her written remarks said she will seek to answer the question, "Why am I still President Biden’s nominee for the 5th seat on the FCC?" In July 2021, Biden signed an executive order encouraging the FCC to reinstate the open internet net neutrality rules. Republicans have questioned Sohn's role as a board member of a nonprofit that operated a transmission service called Locast. "The work of the Commission - from net neutrality to closing the digital divide - is too important for this nomination to be delayed any further," said Senator Ed Markey.
But, it also forecast a higher terminal rate — or end point for its rate hikes — of 5.1%. I think the market was going retest the lows anyway, mainly because market bottoms mostly have retests," he said. Stovall said the market could see a slight Santa rally at the end of the month, going into the beginning of January. Many Wall Street strategists expect a choppy start of 2023, with a test of the lows, then improvement in the second half. Sohn said there's still a chance for a Santa rally, but he expects it may have already happened.
An ETF that mirrors the S & P technology sector has fallen 33% this year, while the ETF representing the energy sector is up 45%. On top of that, Strategas found that the energy sector is punching above its weight when it comes to earnings power. For instance, its 12-month trailing earnings weight among S & P 500 companies is more than double its S & P 500 market cap weight of about 5%. In the past 50 years, the sector has traditionally been about 11% of the S & P 500, he said. S & P energy earnings are expected to soar 121% in the third quarter, while total S & P 500 earnings are expected to grow just 4.1%, according to Refinitiv.
The charts of bitcoin, Tesla and Ark Innovation ETF are all showing the same thing: That the market for the some of the riskiest holdings is at an inflection point. "I do think the S & P 500 is vulnerable to 3,400," he said. "I'm not bearish on the S & P simply because of these charts, but they do add to the conviction." "The weakness from one area will leak to the S & P." Sohn described Ark, bitcoin and Tesla as emblems for the "speculative corner of the market." Like the Nasdaq, trading in Ark, Tesla and bitcoin is tied to the direction of interest rates.
