CNN —A Montana judge handed a significant victory on Monday to more than a dozen young plaintiffs in the nation’s first constitutional climate trial, as extreme weather becomes more deadly and scientists warn the climate crisis is eroding our environment and natural resources. While Seeley’s ruling won’t prevent mining or burning fossil fuels in the state, it will reverse a recently passed state law that prohibits state agencies from considering planet-warming pollution when permitting fossil fuel projects. “Their same legal theory has been thrown out of federal court and courts in more than a dozen states. All three women received treatment for their injuries, some of which were more serious than others. The three women were in the middle of a wide stretch of the river on Wednesday evening when the otter appeared behind one of them and attacked, Royce explained. “I didn’t even get a chance to get the words, ‘There is an otter behind you,’ out of me before it attacked her,” Royce said. Royce’s face, arms, ears, hands, legs and ankle were all bit by the otter as it attacked for about five minutes. The Montana Fish, Wildlife and Parks has posted signs at various recreational fishing sites advising people of otter activity in the area.

CNN —An evening of inner tubing turned perilous for three Montana women when they were attacked by an otter. At least one otter attacked the women, who called 911 when they were able to get out of the water. Montana FWP has posted signs at various recreational fishing sites advising people of otter activity in the area. “While attacks from otters are rare, otters can be protective of themselves and their young, especially at close distances,” Montana FWP said. “If you are attacked by an otter, fight back, get away and out of the water, and seek medical attention,” Montana FWP added.

CNN —A train derailment in Montana caused a bridge across the Yellowstone River to collapse and sent multiple cars into the water below, officials in Stillwater County said Saturday. Multiple tanker cars were damaged and are leaking “petroleum products,” according to Yellowstone County Disaster and Emergency Services. The derailed Montana Rail Link train cars included “several hazmat cars,” the regional rail company said in a statement. “The state is standing by to support as Montana Rail Link and county officials assess their needs,” he said. Montana Rail Link is a Class II regional railroad that operates over 900 route miles of tracks across Montana and Idaho, according to the company’s website.

CNN —A landmark youth climate trial is playing out in Montana, as more than a dozen young plaintiffs aged 5 to 22 said they are already being hurt by climate change-fueled wildfires, drought, reduced snowpack and impacts to wildlife. It is the first youth climate case to make it to trial in the United States, even as several others are working their way through the court system. Still, the ruling could set an important legal precedent for upcoming youth climate cases in various stages. The Montana plaintiffs first filed their case three years ago, while the Juliana case was first filed in 2015. “I know that climate change is a global issue, but Montana needs to take responsibility for our part of that,” plaintiff Rikki Held, 22, testified.

On Tuesday, I wrote about the Republican effort to limit the reach and scope of initiatives and referendums as another instance of the party’s war on majority rule. One thing I wanted to include, but couldn’t quite integrate into the structure of the column, was a point about the recent use of legislative expulsion to punish Democratic lawmakers who dissent from or challenge Republican majorities. We saw another example this week, in Montana, after State Representative Zooey Zephyr, a transgender woman, spoke out against a bill that would ban gender-affirming care for minors. In Nebraska, a Democratic lawmaker is being investigated by an ethics panel for a conflict of interest regarding her filibuster of another bill to ban gender-affirming health care for minors. She has a transgender child.
