California health officials on Tuesday reported a possible case of bird flu in a child with mild symptoms. A bird flu test on the child four days after the positive result came back negative. Bird flu has been spreading rampantly in poultry since 2022 in the worst such outbreak the U.S. has ever experienced. California represents the largest share of human bird flu cases in the U.S. so far, with 27 confirmed, not counting the child in Alameda County. In Canada, health officials reported the country's first human case of bird flu last week, in a teenager hospitalized and in critical condition.

CNN —All signs suggest that the partisan divide over changing gender roles in society could widen even further in the 2024 election, adding a new source of uncertainty to a contest already on a knife’s edge. That was only the latest example of his campaign signaling its support for traditional gender roles. “The messaging on gender coming out of the campaign broadly is very much about reaffirming traditional roles for women and for men,” Cassese said. South Carolina state Rep. Seth Rose, a Democrat in Columbia and one of Marsh’s attorneys, called it a “really tragic” case. But at the hospital, Marsh learned that her infant, a girl, had not survived. Historically, birth outcomes for Black women in Orangeburg County, where Marsh lost her pregnancy, have ranked among the worst in South Carolina. Arizona Attorney General Kris Mayes’ office announced Monday that Jenna Ellis, a former Donald Trump attorney and one of the 18 defendants in the Arizona “fake electors” case stemming from the 2020 election, is cooperating with the prosecution. NEW YORK CNN —A Manhattan prosecutor said Wednesday a new indictment against Harvey Weinstein is possible as additional accusers have come forward with claims against the powerful Hollywood producer whose downfall became a symbol of the #MeToo movement. That trial similarly used “prior bad acts” witnesses and has also been appealed. In addition, three other women testified at trial as “prior bad acts” witnesses. They argued the “prior bad acts” witnesses should not have been allowed to testify and the court should not have given prosecutors the ability to question Weinstein about instances of verbal abuse and bullying on cross-examination. In sexual assault cases, their testimony can turn a difficult “he said, she said” case into a more convincing “he said, they said” case.

CNN —The New York Court of Appeals on Thursday overturned the sex crimes conviction against Harvey Weinstein, the powerful Hollywood producer whose downfall stood as a symbol of the #MeToo movement. Douglas H. Wigdor, an attorney who has represented eight of Weinstein’s accusers, including two of the “prior bad acts” witnesses at his New York criminal trial, criticized the ruling. In addition, three other women testified during the trial as “prior bad acts” witnesses as prosecutors sought to show Weinstein had a pattern of abuse. The use of “prior bad acts” witnesses has increased in recent years with the rise of the #MeToo movement. “Prior bad acts” evidence is one exception to this rule.

We should call it an “election interference” trial going forward. Assistant District Attorney Joshua Steinglass skillfully advanced the election interference theory by structuring his evidentiary points in chronological order within that frame. Trump’s alleged 2020 attempt to overthrow our government distorts perceptions of how serious the charges related to the 2016 election are. How can we call this an election interference trial, they ask, if the election was already over when the 34 alleged document falsification crimes occurred? It is an election interference one and we should say so.

CNN —Fifty-six years after a Florida milkman failed to return home after his rounds, his homicide has been solved, closing the oldest cold case in Indian River County Sheriff’s Office history. The next day, Grayam’s body and truck were located in a wooded area in what was described as a “chilling scene,” the sheriff’s office said in a statement. Over the subsequent years, 16 separate investigations occurred through April 1974 in an effort to solve the case, Flowers said. After receiving that information, detectives tracked down the suspect’s ex-wife, who also said Williams confessed to her, Flowers said. The witnesses said the suspect had been arrested and convicted several times on other charges, the sheriff’s office added.

The surprise court ruling this week throws into question whether votes cast for Trump will be counted. Porter issued her decision Wednesday night and paused the decision for two days, so Trump could appeal. Sidney Powell and Lin Wood filed separate appeals asking the justices to review sanctions imposed by a US district court in 2021. Though their cases involved several technical arguments, both claimed sanctions would make it less likely for lawyers to take “unpopular” cases to court.
