Mangione was denied bail on Tuesday and is fighting his extradition to New York, where he faces five charges, including second-degree murder, in Thompson’s killing. A second-degree murder charge – but not first-degree murder – allows the defendant an “affirmative defense,” which is essentially a “Yes, but” argument to lessen the seriousness of the charge to first-degree manslaughter, according to Shapiro. CNN —Embattled musician and producer Sean “Diddy” Combs has been arrested, the mogul’s attorney tells CNN. According to a source, Combs was arrested in a Manhattan hotel on Monday night and is currently being processed. “We are disappointed with the decision to pursue what we believe is an unjust prosecution of Mr. Combs by the U.S. Attorney’s Office,” Marc Agnifilo, an attorney for Combs, told CNN.
