New York prosecutors told the judge who presided over Donald Trump's hush money trial on Tuesday that his sentencing should be postponed while the president-elect's lawyers file further legal arguments asking the case be dismissed. The proposal Tuesday from Manhattan District Attorney Alvin Bragg's office would need to be signed off on by Judge Juan Merchan to become official. A ruling against Trump on the issue would have paved the way for the judge to proceed with his sentencing, which was tentatively scheduled for Nov. 26. That case has been paused while Trump and some of his co-defendants seek to have an appeals court remove Willis from the case for an alleged conflict of interest. Trump's lawyers have contended that even if she’s allowed to remain on the case, any Trump trial would have to wait until he’s out of office in 2029 because of constitutional issues.

CNN —Donald Trump’s lawyers and the Manhattan district attorney’s office have agreed to delay activity in the hush money case until November 19 to give the president-elect’s lawyers time to make new arguments on how his election victory impacts the case. Judge Juan Merchan was expected to rule Tuesday on whether to overturn the business fraud conviction based on this summer’s Supreme Court ruling on presidential immunity. “The stay, and dismissal, are necessary to avoid unconstitutional impediments to President Trump’s ability to govern,” Bove wrote. The Supreme Court’s immunity decision also indefinitely tied up Trump’s federal election subversion case in Washington, DC. The jury should not have heard any testimony from Hope Hicks about events in 2018 when she was the White House Communications Director, Trump’s lawyers argued.

A North Carolina man's used a $20 bill he discovered on the ground to purchase a lottery scratch-off ticket that won him a $1 million top prize, officials said. CNN —When a North Carolina man headed to a convenience store on Tuesday, he had no idea luck was on his side. Jerry Hicks, a master carpenter from Banner Elk, found a $20 bill in the parking lot of the store, he said in a news release. He spent it on a scratch-off lottery ticket – and won $1 million. Hicks used the money to buy an Extreme Cash scratch-off, according to the release. Hicks claimed his prize on Friday at the North Carolina Education Lottery Headquarters.

To lower costs, 1 in 3 homeowners are willing to hire a contractor with holes in their resume. About 33% of surveyed homeowners say they'd consider hiring a contractor with a questionable reputation to save money, according to a new report by Clever Real Estate, a housing data site. Generally, homeowners say reputation is the most important factor when hiring a contractor (25%), followed by experience (23%), cost (19%), personal recommendations (13%), availability (11%) and estimated project timeline (10%). As homeowners juggle insurance claims and recovery efforts from back-to-back storm aftermaths, one thing to keep in mind is who to hire as a contractor. CNN —The highest peak at Great Smoky Mountains National Park is officially reverting to its Cherokee name more than 150 years after a surveyor named it for a Confederate general. “The Cherokee People have had strong connections to Kuwohi and the surrounding area, long before the land became a national park. Great Smoky Mountains National Park closes Kuwohi every year for three half-days so that predominantly Cherokee schools can visit the mountain and learn its history. Great Smoky Mountains National Park, on the Tennessee-North Carolina border, is America’s most visited national park, and Kuwohi is one its most popular sites, with more than 650,000 visitors per year. The name-restoration proposal was submitted in January by Eastern Band of Cherokee Indians Principal Chief Michell Hicks.

As the Ukrainian soldiers raced through the ruins of the destroyed city under the spying eye of Russian drones, the skeletal remains of blasted-out buildings cast eerie shadows in the light of a full moon. CNN —Manhattan prosecutors said there is no basis to overturn Donald Trump’s conviction in the hush money case after the Supreme Court’s ruling on presidential immunity. Any error, they argued in a filing Thursday, is “harmless” when viewed against “overwhelming evidence” of the former president’s guilt. Prosecutors with the Manhattan district attorney’s office said the conviction should stand. They also noted that Trump’s attorneys didn’t raise objections during the trial to most of the evidence they now question, arguing they can’t now challenge it after the trial.
