A National Labor Relations Board regional official has decided that Dartmouth basketball players are employees of the school, clearing the way for an election that would create the first-ever labor union for NCAA athletes. “Because Dartmouth has the right to control the work performed by the Dartmouth men’s basketball team, and the players perform that work in exchange for compensation, I find that the petitioned-for basketball players are employees within the meaning of the (National Labor Relations) Act,” NLRB Regional Director Laura Sacks ruled. “At Dartmouth, students’ primary objective is learning,” school attorney Joe McConnell said then. I matriculated at Yale, bought room decor, and learned the hard way that Yale dorms didn't have air conditioning. The FDA’s Anesthesiology and Respiratory Therapy Devices Panel of the Medical Devices Advisory Committee is meeting Friday to review ways to better evaluate the accuracy and performance of pulse oximeters in patients with darker skin. Pulse oximeters are fingertip clamps that send light beams through your finger to estimate the oxygen saturation of your blood and your pulse rate. “That standard is then applied to all people as a one-size-fits-all, but time and again, we have seen in medicine that this approach leads to poor outcomes for certain groups, especially Black patients,” Ibekie said. “We need to address the root and work harder to conduct research with patients that represent our populations as a whole,” she said.

Our $7,657 cruise package included airfare from Atlanta to Barcelona, Spain, via Newark, and Norwegian’s own BookSafe Travel Protection Plan, which included travel insurance and also allowed me to “cancel for any reason” for a 75 percent credit. So we spent the night in the Newark airport, paid for a return flight to Atlanta the next morning and canceled the cruise and remaining air legs. I would have moved on to help another Tripped Up reader, but Norwegian’s use of the responsibility-shirking phrase “as a gesture of good will” bugged me. CNN —Transgender swimmer Lia Thomas has begun legal proceedings against World Aquatics, swimming’s governing body, after it voted to restrict transgender athletes from competing in elite women’s aquatics competitions, according to the Court of Arbitration for Sport. The swimmer is challenging certain parts of the World Aquatics’ gender inclusion policy, which went into effect on June 20, 2022, according to the international court body. CNN —The Dana-Farber Cancer Institute, a prestigious Harvard teaching school, is moving to retract six studies and correct 31 others following allegations of data manipulation. The steps by the Harvard Medical School affiliate come after a molecular biologist published a blog post earlier this month alleging researchers falsified data by manipulating images. More than 50 papers are part of the ongoing review by Dana-Farber into four researchers, all of whom have faculty appointments at Harvard Medical School. Earlier this month, Sholto David published a blog post titled “Dana-Farberications at Harvard University,” alleging researchers at the cancer institute manipulated images and data.
