CNN —Founder of the disastrous 2017 Fyre Festival Billy McFarland appears ready for round two. “Since 2016 FYRE has been the most talked about festival in the world. Many of the musicians who were expected to perform ended up backing out of the festival because of the chaotic planning. Prosecutors said in a statement at the time that McFarland defrauded Fyre Festival investors and ticket vendors of about $26 million, and that he’d participated in a separate “sham ticket scheme” in which he sold bogus tickets to fashion, music and sporting events while out on bail. McFarland was released from prison in 2022 after serving nearly four years of his six-year sentence.

Opinion | Compassionate Release for Those Aging Behind Bars
  + stars: | 2023-08-21 | by ( ) www.nytimes.com   time to read: +1 min
To the Editor:Re “Inside a Dementia Unit in a Federal Prison” (Opinion guest essay, Aug. 13):Katie Engelhart vividly describes the absurdity and cruelty of incarcerating frail elders with debilitating dementia. It would be a mistake, though, to conclude simply that expanding compassionate release is the answer. As a former parole commissioner, I know that dementia is just the tip of the iceberg of the problem of mass aging behind bars. Countless people (not just men) effectively face a slow death penalty behind bars because of extreme sentences or repeated denials of parole release despite these individuals’ complete transformations. Far from being helpless, many are violence interrupters, mentors, scholars and artists, including people previously convicted of causing serious harm.

They were the latest members of the former president’s inner circle to find out that associating with Trump could put them on cracking legal ice. There is increasing speculation over why Meadows was charged in Georgia but not in special counsel Jack Smith’s federal investigation into Trump’s election stealing efforts. Legal experts wonder whether he could be cooperating with that probe in a sign of peril for the former president. Trump’s inner circles have long faced legal problemsTrump’s co-defendants in the Georgia case are not the first to find out that the ex-president’s intolerance for the rules and conventions that normally constrain presidencies can lead them into treacherous waters. Trump once vowed to bring only “the best people” to Washington, but his acolytes often find themselves dragged into his legal storms.

It may not make sense for Trump to ever go to trial in Georgia, an ex-prosecutor says. The Georgia case is currently at "the back of the line," Neama Rahmani said. That's because he might already be serving time for any of the multiple federal cases against him. Fulton County District Attorney Fani Willis investigated the Georgia case but "really waited a long time, unnecessarily, in my opinion," Rahmani said. Rahmani then wondered if Trump gets years in federal prison, "does it make sense" to have him "stand trial in Georgia when there's a possibility he dies in prison?"

Martha Stewart was famously accused of insider trading in the early 2000s, but she didn't face criminal insider trading charges. "It is incredibly difficult to prove an insider trading case," said Daniel Taylor, a forensic accounting professor at the University of Pennsylvania. "Insider trading is judge-made law," said John Reed Stark, former head of the Office of Internet Enforcement at the Securities Exchange Commission. The SEC adopted an amendment to a rule that will "enhance investor protections against insider trading." The Department of Justice prosecuted the first insider trading case exclusively based on the rule in March 2023.

CNN —A federal appeals court upheld the child pornography conviction of former reality TV star Josh Duggar, rejecting his arguments for a new trial, court documents show. Duggar was sentenced last year to 12 years in federal prison after being found guilty of receipt of child pornography and possession of child pornography. Duggar reportedly asked federal agents serving a warrant, “Has somebody been downloading child pornography,” before they were able to give him further explanation of the warrant, according to court documents. Duggar ultimately decided not to call him to the stand, however, because the district court ruled that any mention of the employee’s prior conviction was off-limits,” the panel said in its decision. The appellate judges noted that the district court tried to strike a balance by allowing the former employee to testify but blocking mention of the prior sex crime.

Jurors will need to be unanimous to impose the death penalty or else the gunman will receive life without the possibility of parole. The panel will now deliver its verdict to U.S. District Court Judge Robert Colville, who is bound to impose their decision against the gunman. Last month, this same jury found the shooter guilty on 63 criminal counts stemming from the attack in the Squirrel Hill neighborhood of Pittsburgh on October 27, 2018. New York CNN —A woman is suing the billionaire investor Leon Black, accusing him of raping her at Jeffrey Epstein’s Manhattan townhouse when she was 16 years old. The lawsuit describes in gruesome detail the woman’s account of a sexual assault that left her bleeding and sobbing. A spokesman for Black, Whit Clay, echoed Estrich’s denial, saying the law firm “has an agenda” and that its credibility has been impugned by the dismissal of the previous suit. An internal Apollo investigation that documented his $158 million payment to Epstein found no wrongdoing. The latest suit is the third to publicly accuse Black of rape.

A truck driver who assaulted a police officer with a flagpole at the Capitol on Jan. 6, 2021, was sentenced on Monday to 52 months in federal prison. The attack by the driver, Peter Stager, produced one of the most disturbing images to emerge from the Capitol attack. Mr. Stager, 44, of Conway, Ark., was captured on video beating the officer, Blake Miller, with the flagpole in a fit of rage as Officer Miller lay facedown in a mob of other rioters with “no means of defending himself,” prosecutors wrote in court papers. Officers who fell victim to attacks in a tunnel on the terrace and on the steps there have repeatedly likened the violence to the hand-to-hand combat of a medieval battle. After assaulting Officer Miller, prosecutors say, Mr. Stager was caught on video pointing at the Capitol, and declaring: “Everybody in there is a disgrace.

CNN —Disgraced former Theranos CEO Elizabeth Holmes could be out of prison nearly two years earlier than expected, according to the projected release date posted by the Bureau of Prisons. The Bureau of Prisons online database now reports, however, that Holmes’ expected release date is December 29, 2032 – which would take roughly two years off of her full sentence. The discrepancy appears to be due to how the Bureau of Prisons calculates its estimated release date. These factors that go into calculating an estimated release date are not unique to Holmes’ case, but standard for inmates. Holmes is currently serving out her sentence at Federal Prison Camp Bryan, a minimum security federal prison camp that is approximately 100 miles from Houston.

CNN —Former USA Gymnastics doctor Larry Nassar, who was convicted of sexually abusing young athletes under the guise of medical treatment, was assaulted inside a federal prison in Florida, according to two sources familiar with the incident. Joe Rojas, president of the local correction officers’ union, told CNN Nassar was stabbed a total of 10 times – twice in the neck, twice in the back, and six times in the chest. Rojas says Nassar is in stable condition. In 2021, victims of Nassar reached a $380 million settlement with USA Gymnastics, the US Olympic Committee and their insurers. The settlement was part of the USA Gymnastics plan to exit bankruptcy as the organization has struggled to recover from the Nassar scandal.

In a scathing 2021 report, the inspector general for the Justice Department found that the F.B.I. initially botched the investigation, allowing Mr. Nassar to assault more young women. Mr. Nassar was convicted on federal charges in 2017. A federal judge ordered that sentence to run concurrently and remanded him to federal custody. Last year, 13 female athletes who were sexually assaulted by Mr. Nassar each sought $10 million from the F.B.I., claiming agents mishandled the investigation, allowing him to continue abusing more victims.

CNN —A California man has been convicted for illegally importing an ancient floor mosaic, believed to have been made in modern-day Syria nearly two thousand years ago and valued at almost half a million dollars. Alcharihi only paid about $12,000 for the antiquity, which an appraisal expert valued at $450,000, according to the US Attorney’s Office. The mosaic weighs a whopping 2,000 pounds and is about 15-feet long and 8-feet tall, according to the release.
