Judge Arthur Engoron said the website’s retention of the post was a “blatant violation" of his Oct. 3 order requiring Trump to immediately delete the offending message. “I’ll take this under advisement," Engoron said after Kise explained the mechanics of how Trump’s post was able to remain online. The judge ordered Trump to delete the post, which he did, and warned of “serious sanctions” for violations. Before Trump deleted the post from his Truth Social platform, as ordered, his campaign copied the message into an email blast to supporters. That email, with the subject line “ICYMI," was automatically archived on Trump’s website, Kise said.

New York Attorney General Letitia James' office suggested Thursday that the Trump Organization failed to produce evidence in the $250 million fraud trial of Donald Trump and his company, citing a recent report accusing a key witness of lying under oath. The attorney general's suit accuses Trump, his sons Donald Trump Jr. and Eric Trump, the Trump Organization and top executives of misstating the true values of properties to obtain tax advantages and better terms on loans and insurance. Wallace, in his letter, proposed that an independent monitor conduct a forensic review of electronic data held by the Trump Organization from August to September 2016. The alleged failure to produce those emails follows "multiple affidavits on behalf of the Trump Organization attesting to the completion of their production obligations," Wallace wrote. Weisselberg, who has been loyal to Trump, served jail time for tax fraud in a criminal case related to his work at the Trump Organization.

McArdle said Thursday that Eric Trump may have had a “more lofty value" in mind, but a higher number wouldn't have been credible. Trump's financial statements went on to list the golf course at values sometimes topping $100 million, according to James' lawsuit. Both Eric and Donald Trump have attended some parts of the trial but weren't there Thursday. Earlier in the trial, retired Deutsche Bank official Nicholas Haigh testified that Trump’s financial statements were key to approvals for hundreds of millions of dollars in loans in 2011 and 2012.

Former President Donald Trump returned to court in Manhattan on Tuesday to attend the ongoing civil fraud trial against him and his company. Outside of the courtroom at Manhattan Supreme Court, Trump slammed the judge who will decide the case. Trump also repeated attacks against New York Attorney General Letitia James, who brought the case accusing Trump, two of his adult sons, the Trump Organization and others of a yearslong pattern of business fraud. Judge Arthur Engoron has already ruled that Trump and others in the case are liable for fraud. The judge's decision revoked the defendants' New York business certificates and ordered an independent receiver to oversee their dissolution.

CNN —Former President Donald Trump on Tuesday decried the gag order issued on him by the federal judge overseeing his federal 2020 election subversion case, claiming she “took away my right to speak.”“We’re being railroaded. I’m a candidate that’s running for office and I’m not allowed to speak,” Trump said, referring to the partial gag order issued Monday by US District Judge Tanya Chutkan. The gag order restricts Trump’s ability to publicly target court personnel, potential witnesses or special counsel Jack Smith and his staff. “This is not about whether I like the language Mr. Trump uses,” Chutkan said in court Monday as she announced the order. Tuesday’s proceedings in the New York civil fraud case will include more testimony from Donna Kidder, the Trump Organization’s assistant controller.

NEW YORK (AP) — Former President Donald Trump returns to a New York City courthouse Tuesday to be a spectator at the civil fraud trial threatening to disrupt his real estate empire. His appearance was initially supposed to coincide with testimony by Michael Cohen, his former attorney turned foe. But Cohen's planned appearance on the witness stand was delayed until at least next week, due to a health problem. Instead of Cohen, Trump's courtroom visit is likely to overlap with the resumption of testimony from his company's assistant controller, Donna Kidder. The trial concerns six remaining claims in the lawsuit, including allegations of conspiracy, insurance fraud and falsifying business records.

In a pretrial court filing, James’ office estimated that Trump exaggerated his wealth by as much as $3.6 billion. They've also called accountants Donald Bender and Camron Harris, whose firms Trump hired to prepare his financial statements. A retired Deutsche Bank official testified the financial statements were key to Trump securing hundreds of millions of dollars in loans. Weisselberg acknowledged that information in Trump’s financial statements wasn’t always accurate, such as valuing his penthouse based on the wrong size. In a decision last month, Engoron resolved the lawsuit's top claim, ruling that Trump committed years of fraud by inflating the value of assets in his financial statements.

“This is not about whether I like the language Mr. Trump uses,” Judge Tanya Chutkan said. Trump will appeal Chutkan’s order, he said in a post on his social media website Truth Social. Following the two federal indictments against the former president, Trump has lashed out against prosecutors, potential witnesses and the judge overseeing the election subversion case in Washington. “When you start to use a word like ‘thug’ to describe a prosecutor doing their job, that wouldn’t be allowed by any other criminal defendant,” Chutkan said. NEW YORK (AP) — Donald Trump will back in court next week for his New York civil fraud trial, a person familiar with the former president’s plans told The Associated Press on Thursday, setting up a potential face-to-face showdown with fixer-turned-foe Michael Cohen, who is expected to testify. Trump is expected to attend the non-jury trial Tuesday through Thursday next week, according to the person who confirmed the plans, which were first reported by news website The Messenger. Outside, Trump decried the civil trial a “sham,” a “scam,” and “a continuation of the single greatest witch hunt of all time.” His campaign, meanwhile, attempted to capitalize with fundraising appeals tied to the proceedings. Trump isn’t required to be in court for the civil trial until he is called to testify in the few weeks. The civil trial, which doesn't have a jury because one is not required under the law, concerns allegations of conspiracy, insurance fraud and falsifying business records.

Trump's longtime finance chief, Allen Weisselberg, acknowledged in testimony Tuesday that information in the financial statements wasn't always accurate. The disclaimers say, among other things, that the financial statements aren't audited and that others “might reach different conclusions” about Trump's financial position if they had more information. It’s the first time a bank official has testified in court about the impact Trump’s financial statements had on his ability to obtain loans. Haigh said he reviewed Trump’s financial statements before approving the loans and, at the time, had no reason to doubt their validity. “I assumed that the representations of the assets and liabilities were broadly accurate," Haigh said of Trump’s financial statements.

Now, after a recent jail stint for tax fraud, Weisselberg is front and center again — set to testify Tuesday in the civil trial in New York Attorney General Letitia James’ fraud lawsuit against Trump and his company, the Trump Organization. James' lawsuit alleges that Weisselberg engineered Trump’s financial statements to meet his demands that they show increases in his net worth and signed off on lofty valuations for assets despite appraisals to the contrary. “Over the last number of months, it’s been I’m sure well-documented and well-known that I’ve been through quite a bit,” Weisselberg testified in a May deposition in the civil case. Weisselberg testified that he was having trouble sleeping, started seeing a therapist and was taking a generic form of Valium as he tried to “re-acclimate myself back to society." He might say magnificent,” Weisselberg testified.

Homes a tenth the size of Mar-a-Lago on tiny inland lots sell for that in the Town of Palm Beach, a wealthy island enclave. It is also a club, private beach resort, historical artifact and banquet hall with a ballroom that features gold leaf. The much smaller Palm Beach compound once owned by the Kennedy political dynasty sold for $70 million three years ago. SO HOW DID PALM BEACH COUNTY COME UP WITH SUCH A LOW TAX ASSESSMENT? If Mar-a-Lago had a $1 billion assessed value, it’s property tax bill would be approximately $18 million.

The appellate court last week rejected the defense’s last-minute effort to delay the trial just days before it began. On Thursday, Trump’s lawyers dropped a lawsuit they filed against Engoron as part of that challenge. Political Cartoons View All 1202 ImagesThe appellate court has yet to rule on the latest appeal. Trump's lawyers argued that Engoron had “no rationale or legal authority” to impose what they described as “the corporate death penalty." “Perhaps most alarming is (the court's) incomprehension of the sweeping and significant consequences of its own ruling,” Trump's lawyers said in their appeal Friday, describing Engoron’s ruling as an “overbroad directive that sows confusion and chaos in its implementation.”

CNN —The former controller of the Trump Organization says that Eric Trump directed him to make certain decisions that led to the inflated valuations of several Trump properties. Jeff McConney, also a co-defendant of former President Donald Trump, Eric Trump and Donald Trump Jr., testified Friday as the first week of the civil fraud trial came to an end. (Attorneys for Eric Trump have argued he was not aware that any phone conversations with McConney were used to formulate value assets in the financial statements for Trump properties.) McConney testified that he did not know at the time that Trump had deeded away his right to develop the property beyond its use as a social club in 2005. He said he did this at the direction of Eric Trump, who oversaw the project.

CNN —A New York appeals court judge on Friday rejected Donald Trump’s attempt to stop the ongoing $250 million civil fraud trial, but temporarily halted the process of breaking up his businesses. We’re not seeking anything but a fair trial and these errors permeate the ongoing trial,” Trump attorney Christopher Kise said in court Friday, referring to “an avalanche of errors” in the summary judgment ruling. “And tellingly, they waited until after Mr. Trump decided to stop attending the trial,” the letter says. Trump attorneys and his co-defendants notified the appellate court that they’ve agreed with the New York Attorney General Letitia James’ office to discontinue the suit. Engoron handed down the summary judgment ruling last week, causing the appellate court to deny Trump’s request for a stay as moot because Engoron ruled as they requested.

A New York appeals court on Friday refused to stay the ongoing civil business fraud trial of Donald Trump and his company, but did halt a judge's order to cancel the business certificates of Trump's companies in the state. The ruling came after Trump's business fraud trial ended its first week of proceedings in Manhattan Supreme Court. New York Attorney General Letitia James had opposed halting Trump's trial pending his appeal of a judge's pretrial ruling that he was liable for business fraud in the case. The ongoing trial is dealing with James's $250 million lawsuit against Trump, the Trump Organization, his two adult sons and top company executives. Engoron had canceled the business certificates of Trump's companies as part of that finding.

But the front-running GOP presidential primary candidate was there – and he was pissed. Yet Trump was seething for another reason altogether – or so he claimed: His mounting legal challenges were preventing him from campaigning. “Trump campaigning from a courtroom is so Trumpian,” says Tobe Berkovitz, associate professor of advertising emeritus at Boston University. Separately from the civil trial in New York focusing on fraud, Trump faces 91 criminal charges stemming from four state and federal cases. And like the mug shot, Trump’s presence in the courtroom this week gave his supporters something he can’t give them on the campaign trail – a physical representation of the system he claims is out to get him.

Former President Donald Trump sits in the courtroom for the third day of his civil fraud trial in New York, Oct. 4, 2023. But Kise said he did not want to reveal the scope of the appeal planned for Friday morning, upsetting a lawyer from the New York Attorney General's Office. Lawyers for Donald Trump may ask a New York appeals court to pause his ongoing $250 million business fraud trial and stay a judge's order that could gut the former president's company, lawyers said Thursday afternoon. Engoron last month issued a summary judgment finding that James had proven her top claim, that the defendants engaged in business fraud. Trump was present in court for the first 2½ days of the trial, which began Monday.

NEW YORK (AP) — An accountant who prepared Donald Trump's financial statements was back on the witness stand for a fourth day Thursday in the New York civil fraud trial examining whether the former president exaggerated his wealth. The business fraud trial stems from New York Attorney General Letitia James' lawsuit alleging that Trump and his business ginned up financial statements that vastly overvalued Trump Tower, Mar-a-Lago and other assets. James is seeking $250 million in penalties and a ban on Trump doing business in New York. The witnesses so far have been two accountants who worked on the financial statements, which went to banks, insurers and others. The defense has been trying to show that if there were problems with the financial statements, the flubs were accountant Donald Bender's fault.

Former President Donald Trump wants a New York judge to dismiss the criminal case against him charging that he falsified business records relating to hush money payments, arguing prosecutors waited too long to bring their case. "The delay has prejudiced President Trump, interfered with his ongoing presidential campaign, and violated his due process rights," the filing by Trump attorneys Todd Blanche and Susan Necheles contends, and the charges should therefore be dismissed. That information was hush money paid to two women who claimed to have had affairs with Trump. In their filing, Trump's lawyers contended it was accurate. Trump has pleaded not guilty in both federal cases and denied wrongdoing in the AG's civil case.

NEW YORK (AP) — On notice to mind his out-of-court commentary, former President Donald Trump returned to his New York civil fraud trial Wednesday as his lawyers questioned an accountant who prepared financial statements at the heart of the case. With accountant Donald Bender on the witness stand, state lawyers has sought to show that Trump and others at his company had full control over the preparation of the financial statements. Bender testified Tuesday that the Trump Organization didn’t always supply all the information needed to produce the documents. Trump denies any wrongdoing, and his defense continued Wednesday to fault Bender for any shortcomings in the statements. Suarez then showed video of pretrial testimony in which Bender said he didn't recall whether he consulted with any specialists when preparing Trump's financial statements.

Shannon Stapleton/Pool/Getty ImagesJudge Arthur Engoron, who is overseeing the New York attorney general’s civil case against Donald Trump, said Tuesday that the trial itself is not the venue for Trump’s attorneys to contest what he’s already ruled on. Leaving court Monday, Trump incorrectly claimed that the judge had agreed that 80% of the attorney general’s case was thrown out because of the statute of limitations. It’s one of several allegations contained in the attorney general’s civil case against Trump, but it could lead to stiff penalties for his business. The attorney general’s office is seeking to bar Trump from doing business in New York.
