Former President Donald Trump is seeking to sever his criminal election interference case in Georgia from any of his 18 co-defendants who are demanding that the case proceed quickly to trial, a Thursday court filing showed. There are "substantial adverse procedural and substantive 'effects' President Trump would endure" if he is held to the same schedule, Sadow wrote. He is set to participate in another trial starting in late September in federal court in Florida. Trump has been charged with 91 total counts in four separate criminal cases as he campaigns for the 2024 Republican presidential nomination. His lawyers in his two federal cases tried to push off his trial until after the November 2024 election.

Trump Georgia prosecutor wants 'speedy trials' done together

The Atlanta district attorney prosecuting the Georgia election interference case against former President Donald Trump and 18 others asked a judge Tuesday to order that defendants granted so-called speedy trials be tried together. Fulton County DA Fani Willis also asked Judge Scott McAfee to set a deadline for defendants in the case to file requests to sever their cases. McAfee has discretion on whether to sever the cases for separate trials. But defendants soon could make similar speedy trial requests, which would require their trials to begin by Nov. 3. In her court filing Tuesday, Willis said she opposed, "at this juncture," severing the cases of defendants so that they would be tried either in 19 separate trials or in smaller groups.

Mark Meadows wants his criminal case moved to federal court, under an Obama-appointed judge. A federal judge may be more sympathetic to arguments that he's immune from the case, experts say. Meadows, Clark, and several other defendants have asked to have their cases removed to federal court. "A federal court judge might be more sympathetic to some of their federal constitutional defenses that they might want to raise," Ratakonda told Insider. A state court proceeding would also take in jurors from Fulton County, which voted overwhelmingly for Biden in 2020.

One of those cases, a civil trial in New York, threatens to cripple the former president's company, the Trump Organization . James is seeking $250 million in damages in the civil case. In July, the U.S. Department of Justice dropped a nearly three-year effort to protect Trump from civil liability in the suit. In May, three of Trump's children, Donald Trump Jr., Eric Trump, and Ivanka Trump, were dismissed as defendants from the case after Kaplan proposed that move. The payments were made shortly before the 2016 presidential election, in which Trump defeated Democratic nominee Hillary Clinton.

State law would still apply if the case is moved to federal court. The federal officer removal law protects people from state prosecution for carrying out official federal duties. It says that if a person were carrying out duties placed on them by federal law, they cannot be prosecuted for committing a state crime. Legal experts said Jones could allow the case to proceed in federal court and address immunity at a later hearing. If he determines immunity did not apply to the accused actions, the jury trial would take place in federal court, with the broader jury pool.

A federal judge set Trump's election interference trial in Washington, DC, for March 4, 2024. Prosecutors want a trial quickly because Trump's social media attacks could influence the jury pool. Lucian Chalfen, a spokesperson for the New York state court system, told Insider that Trump's trial date in Manhattan has not been changed. Judges have sought to reign in Trump's social media posts in other ways. Lauro has previously said he wants the case trial in West Virginia, which legal experts say is unlikely to happen.

No defendants have entered a plea in the Georgia case. The federal officer removal law protects people from state prosecution for carrying out official federal duties. Legal experts said the accused acts in the Georgia case are more plausibly related to official duties than the hush money payments in the New York case. Legal experts said Jones could allow the case to proceed in federal court and address immunity at a later hearing. If he determines immunity did not apply to the accused actions, the jury trial would take place in federal court, with the broader jury pool.

Donald Trump might make new campaign merch soon — featuring his Georgia mugshot. But New York doesn't make mugshots public like Georgia does, so the Trump campaign had to get creative. Immediately following that first New York indictment, the Trump campaign started advertising a new T-shirt featuring a clearly fake mugshot of the former President emblazoned with the words "NOT GUILTY." (AP Photo/Alex Brandon)Now that he has the public mugshot he wanted, Trump's team might swap out the fake mugshot on his campaign merch for the real one. Fulton County has spent eight months picking jurors for the trial of Young Thug and his associates. One involves the prolific Atlanta rapper Young Thug and his associates, who prosecutors allege are all part of a "criminal street gang" called Young Slime Life or YSL. Defendants, including Young Thug, whose real name is Jeffery Williams, have maintained that YSL is just an artist label. In the past eight months, the Fulton County courthouse has been slogging through more than 2,000 potential jurors for the Young Thug trial. Similarly, jurors will be questioned about their political beliefs and if they will be able to put that aside in the Trump case.

Trump and his allies had hoped to use arraignments to get media attention, media reports previously said. The sheriff who oversees the jail system has said Trump's mugshot and fingerprints will be taken for the National Crime Information Center. A presidential historian said in March that if Trump's mugshot is made public, it'll likely cement himself as "folk hero" among his supporters. At the arraignment, Trump and the other defendants will be formally presented with the criminal charges and can enter pleas. Trump is the first former president to face any criminal charges for a first, second, third, or fourth time.

The Republican-led House Judiciary Committee opened an investigation into the work of the Atlanta prosecutor who has criminally charged Donald Trump and others with interfering in the 2020 presidential election in Georgia. Trump is due to surrender at an Atlanta jail on Thursday evening to be booked in the case. Eighteen other people, including lawyers who promoted false claims about the 2020 election, also were indicted in the case. Traditionally, the committee's jurisdiction is limited to oversight of federal courts and federal officials. The House Judiciary Committee earlier this year demanded similar information from the office of Manhattan District Attorney Alvin Bragg Jr., who is prosecuting Trump in another criminal case.

Former President Donald Trump on Thursday opposed a request by an Atlanta prosecutor that he stand trial starting Oct. 23 in his Georgia election interference criminal case. Trump attorney Steve Sadow, in a court filing, also notified a judge that Trump soon will file another motion to sever his case from co-defendant Kenneth Chesebro, who on Wednesday demanded a speedy trial in Fulton County Superior Court. Fulton County District Attorney Fani Willis earlier Thursday asked Judge Scott McAfee to schedule the trial of Trump, Chesebro and the 17 co-defendants to begin Oct. 23. Trump is due to surrender later Thursday to be booked in the case. Follow our live coverage of Donald Trump's arrest in the Georgia election case.

Trump and his Georgia co-defendants have had a strategic legal breakdown. Attorney Kenneth Chesebro, one of the 19 defendants in Trump's Georgia indictment, requested an October trial date. The move for a speedy trial may have been a bet by Chesebro that prosecutor Fani Willis wouldn't be prepared. In other criminal proceedings, Trump has tried to delay trials until after the 2024 election.

"The federal government has a substantial interest in the welfare of former presidents," Jordan wrote in a five-page letter to Willis. "And because this former president is a current candidate for that office, the indictment implicates another core federal interest: a presidential election," Jordan said. The House investigation was disclosed three days after Trump accused Willis on his social media platform of "continuing to campaign, and raise money on, this WITCH HUNT. In the case brought by Willis, Trump was accused of unlawfully pressuring Georgia state officials to reverse his 2020 election loss to Biden in the state. House Republicans have sought to defend Trump in the four cases by alleging that the U.S. justice system has been "weaponized" against him by Biden.

Eastman said in a statement he would surrender, the day after agreeing to a $100,000 bond agreement. "I am here today to surrender to an indictment that should never have been brought," Eastman said in the statement. Trump on Monday agreed to post a $200,000 bond and accepted bail conditions that would bar him from threatening co-defendants or witnesses in the case. In a 41-count Georgia indictment unveiled last week, Trump and 18 other defendants were charged with racketeering and other crimes over their efforts to reverse Trump's loss in the state to Biden. Prosecutors are seeking a trial in March, but the number of defendants and complexity of the case could lead to delays.
