New York's highest court on Tuesday dismissed former President Donald Trump's appeal of the gag order in his criminal hush money trial. The New York Court of Appeals in a brief decision declined to hear Trump's bid "upon the ground that no substantial constitutional question is directly involved." The decision means Trump's gag order, which bars him from speaking about jurors, witnesses and other parties involved in the Manhattan Supreme Court case, remains in effect. Trump's attorneys asked Judge Juan Merchan, who presided over the trial, to terminate the gag order because the trial is over. The Trump campaign and the lawyer who filed the gag order appeal to the state's top court did not immediately respond to CNBC's requests for comment.

Supreme Court Justice Clarence Thomas has omitted at least three private jet trips gifted by Republican megadonor Harlan Crow from his annual financial disclosures, a top Senate Democrat alleged Thursday. Those trips included private flights in 2017, 2019 and 2021 that Thomas failed to disclose, according to Judiciary Committee Chairman Dick Durbin of Illinois. The Senate probe of the Supreme Court "makes it crystal clear that the highest court needs an enforceable code of conduct, because its members continue to choose not to meet the moment," Durbin said in a statement. But the new analyses could be warning signs for Trump Media, whose business depends in large part on growing its user base. Truth Social users were down 19.7% year over year, according to Similarweb. Truth Social users on average check the site fewer than two days a week — falling behind apps like Facebook, X, TikTok, Reddit and Pinterest. Truth Social users also clock fewer minutes of engagement on the platform that do the users of other social media networks. "Compared to other social media platforms, Truth Social users are accessing the app much less frequently and are spending much less time on it per session," the firm's CEO, Dr. Paul Carter, told CNBC in an email.
