The Beastie Boys sued Chili’s Grill & Bar in federal court on Wednesday, accusing the restaurant chain’s main operator of infringing on their copyright of the 1994 hit “Sabotage” by using it in advertisements without permission. According to the complaint, Brinker International, which operates more than 1,600 Chili’s and other restaurants worldwide, rolled out promotional videos on social media beginning in November 2022 that used significant portions of the song and parodied its music video, directed by Spike Jonze. The music video playfully pays homage to 1970s television crime dramas and features a fictitious opening credit scene and the group’s members dressed in fake wigs, mustaches and sunglasses of the era. In the Chili’s video advertisement, three characters dressed in similar ’70s attire rob ingredients from a Chili’s restaurant scored to the sound of “Sabotage,” said the lawsuit, filed in the U.S. District Court for the Southern District of New York.

CNN —Bill Hwang, founder of Archegos Capital Management, was found guilty of fraud Wednesday by a Manhattan federal court after the 2021 collapse of his investment firm wiped billions of dollars off financial markets and nearly brought down Wall Street. The jury delivered a speedy conviction, finding Hwang guilty on 10 of 11 criminal counts after beginning deliberations Tuesday afternoon. Archegos’ implosion cost shareholders $100 billion and banks $10 billion, the prosecutors argued. In a statement, the US Attorney’s office for the Southern District of New York said Hwang’s guilty verdict sends a message that market manipulation would be held accountable. “Hwang and Halligan were able to fraudulently inflate a $1.5 billion portfolio into a $36 billion portfolio,” the statement said.

New York CNN —In lower Manhattan, a jury is now weighing a case against a little-known investor who made it big, lost everything, and briefly brought Wall Street to its knees. His positions were so large that when the stocks started falling, it had a seismic effect on the market. And on Tuesday, after a two-month trial in New York federal court, the case was handed over to a jury that will decide their fate. Before Archegos, market watchers knew unregulated family offices were a problem, and they knew that swaps going unreported was a problem. “Fifteen years after the global financial crash, we still have gross under-regulation of non-banks, and we have Wall Street megabanks engaged in high-risk activities that aren’t properly regulated,” Kelleher told me.

The jury, which began deliberations on Tuesday, found Hwang guilty on 10 of 11 criminal counts and Patrick Halligan, his Archegos deputy and co-defendant, guilty on all three counts he faced. Hwang and Halligan sat flanked by their lawyers as the verdict was read by a soft-spoken foreperson. Hwang, 60, had pleaded not guilty to one count of racketeering conspiracy, three counts of fraud and seven counts of market manipulation. At its peak, prosecutors said Archegos had $36 billion in assets and $160 billion of exposure to equities.

Last September, a prominent white-collar defense lawyer met with federal prosecutors in Manhattan in a last-ditch effort to stave off an indictment against his client. In the meeting, the lawyer, Abbe D. Lowell, used a PowerPoint presentation to convey explanations for certain financial payments that were under scrutiny by the government. It was a moment of great risk and potential peril for Mr. Menendez — and the effort failed. Less than two weeks later, prosecutors announced an indictment charging the senator and his wife, Nadine Menendez, with conspiring to accept thousands of dollars in bribes in exchange for political favors. The government has made it clear that Mr. Lowell, who represented Mr. Menendez only during the investigation and not afterward, engaged in no wrongdoing.

CNN —Adria English, a former adult film actor who says she worked for Sean “Diddy” Combs between 2004 and 2009, accused the embattled music mogul of sex trafficking and sexual assault, according to a lawsuit filed Wednesday. The lawsuit marks the ninth against Combs since last November and the eighth directly accusing him of sexual assault. One of the eight lawsuits, filed by former girlfriend Cassie Ventura, has been settled. Another lawsuit accused his son Christian Combs of sexual assault, and Sean Combs is accused of aiding and abetting. Combs has vehemently denied claims from many of the civil suits but has not responded to all of the allegations.

But the court’s opinion also makes clear that this ruling is not a death knell for Smith’s case. Smith charged Trump with engaging in a “criminal scheme” to subvert the 2020 election; Trump has pleaded not guilty to four counts. In Nixon v. Fitzgerald, the Supreme Court held that a president enjoyed civil immunity for all “official acts.” Now, in Trump v. United States, the court grappled with which “official” acts should also receive criminal immunity. In order to settle the extent of Trump’s immunity, Chutkan should expeditiously schedule the mini-trial to hear witness testimony and receive other relevant evidence from both parties. In response to Trump’s assertion of civil immunity there, the DC Circuit put in place a lengthy discovery schedule for the lower court to determine the extent of Trump’s civil immunity.

Nearly four years after Patrick Braxton won the mayoral election for the small town of Newbern, Ala., in November 2020, he could soon get to serve his first term. Mr. Braxton said in a lawsuit that, after he won the election, he never received access to manage the town’s finances, was barred from opening the municipal mailbox and was even locked out of the town hall, after the locks had been changed twice in six months. Finally, on Friday, Newbern and Mr. Braxton filed a settlement agreement that, if approved by Judge Kristi K. DuBose of the Southern District of Alabama, will allow Mr. Braxton to begin his first term — three and a half years after it started. “Every time I turned a corner, there was another obstacle in my way,” Mr. Braxton, a handyman who has long worked as a community volunteer, said in an interview.

Shortly after Judge Aileen M. Cannon drew the assignment in June 2023 to oversee former President Donald J. Trump’s classified documents case, two more experienced colleagues on the federal bench in Florida urged her to pass it up and hand it off to another jurist, according to two people briefed on the conversations. The judges who approached Judge Cannon — including the chief judge in the Southern District of Florida, Cecilia M. Altonaga — each asked her to consider whether it would be better if she were to decline the high-profile case, allowing it to go to another judge, the two people said. But Judge Cannon, who was appointed by Mr. Trump, wanted to keep the case and refused the judges’ entreaties. Her assignment drew attention because she has scant trial experience and had previously shown unusual favor to Mr. Trump by intervening in a way that helped him in the criminal investigation that led to his indictment, only to be reversed in a sharply critical rebuke by a conservative appeals court panel. The extraordinary and previously undisclosed effort by Judge Cannon’s colleagues to persuade her to step aside adds another dimension to the increasing criticism of how she has gone on to handle the case.

Signage is displayed outside a permanently closed Bed Bath & Beyond retail store in Hawthorne, California, on May 1, 2023. The billionaire activist investor Ryan Cohen won the dismissal on Tuesday of a shareholder lawsuit accusing him of profitably cashing out of Bed Bath & Beyond shares too quickly as the home goods retailer was hurtling toward bankruptcy. Cohen revealed a 9.8% stake in Bed Bath & Beyond in March 2022 and pushed for changes that would include new directors and exploring a sale of the Buy Buy Baby brand. Bed Bath filed for bankruptcy in April 2023, and its common shares were canceled when its Chapter 11 plan became effective in September. More than two months after deputies were sentenced for torturing two Black men in central Mississippi, federal prosecutors have widened their investigation and may sue the Rankin County sheriff’s department for civil rights violations, a serious escalation that could lead to federal monitoring. Todd Gee, the U.S. attorney for the Southern District of Mississippi, talked about the possibility at a meeting last month, where he urged local residents who attended to come forward if they had experienced violence or discrimination at the hands of deputies. More than 50 people, including defense attorneys and civil rights advocates, packed into a library outside Jackson, Miss. Some shared stories of being harassed or falsely accused of crimes by deputies, according to several people who attended the meeting, which was closed to the press. “Information from people like you can make a difference,” Mr. Gee told the crowd, according to video of the meeting obtained by reporters.

CNN —Judge Aileen Cannon had been on the federal bench for little more than a year when a senior judge offered to preside over one of her first criminal trials in her isolated south Florida courthouse. In her seven years as a Justice Department attorney, Cannon participated on the trial teams of just four criminal cases. Still, Cannon has asked questions in the Trump case that appear out of left field. Her orientation toward such legal rabbit holes is not distinct to the Trump case, veterans of her courtroom say. Ultimately, nearly every attorney CNN spoke to said that Cannon, despite the criticism, is unwavering in her beliefs about how each case in her courtroom should proceed.

Cannon is planning on holding a sprawling hearing on Trump’s request to declare Jack Smith’s appointment as special counsel invalid, signaling she could be more willing than any other trial judge to veto the special prosecutor’s authority. Wednesday, Cannon went further, adding a hearing on a gag order request from prosecutors to limit Trump’s rhetoric about law enforcement and allotting more time to hear arguments on the special counsel issue. Cannon’s signal of willingness to entertain challenges to the special counsel comes in the same week Republicans are bearing down on Attorney General Merrick Garland for his use of special counsels. A third group says the Department of Justice’s use of a special counsel should be upheld. Cannon still agreed to the hearing Trump wanted.

The incredible oblivion of Judge Marvin Isgur

On a mild Houston day in March 2021, Judge Marvin Isgur prepared to oversee the only case on his docket that morning. In October 2023, the Fifth Circuit Court rebuked Judge David Jones but said that his longtime colleague, Judge Marvin Isgur, had been "unaware" of Jones' inappropriate relationship. "But only Judge Isgur knows what he knew or didn't know about the relationship." Much of this work was in cases before either Judge Isgur or Judge Jones. Isgur can continue to hear the case, he ruled, writing in the December 2023 opinion that lawyers for the creditor "failed to demonstrate much other than that former Judge Jones and Judge Isgur are close friends."

CNN —Ryan Salame, the former co-CEO of FTX’s Bahamian subsidiary and a top lieutenant to the bankrupt cryptocurrency exchange’s founder, Sam Bankman-Fried, was sentenced on Tuesday to 90 months in prison, U.S. federal prosecutors said on Tuesday. Salame pleaded guilty in September to making tens of millions of dollars in unlawful campaign donations to boost causes supported by his boss. Bankman-Fried himself was sentenced earlier this year to 25 years in prison for stealing $8 billion from FTX customers. Prosecutors say Salame, Bankman-Fried and former FTX engineering chief Nishad Singh used FTX customer funds to donate to political candidates supporting crypto-friendly legislation. He had pleaded guilty to one count of conspiracy to make unlawful political contributions and one count of conspiracy to operate an unlicensed money transmitting business.

In a potential setback for the government, a federal judge on Friday blocked the introduction of certain evidence that prosecutors wanted to use to support their case that Senator Robert Menendez of New Jersey accepted bribes in exchange for approving billions of dollars in aid to Egypt. The judge’s order, which comes two weeks into Mr. Menendez’s corruption trial in Manhattan, could undermine prosecutors’ ability to prove certain elements of the multifaceted bribery charges against the senator. The ruling rests on protections afforded to members of Congress under the Constitution’s “speech or debate” clause, which bars the government from citing specific legislative actions in seeking to prove a federal lawmaker committed a crime. The U.S. attorney’s office for the Southern District of New York has said it intended to sidestep discussion of official legislative acts and focus instead on promises it says preceded Mr. Menendez’s votes and congressional actions.
