CNN —The policy-making body of the federal judiciary is clamping down on the system that conservatives have successfully used in recent years to hamstring President Joe Biden’s agenda and other federal policies, including those concerning reproductive rights. The new policy seeks to curb “judge-shopping,” the strategy where litigants strategically file lawsuits in courthouses where the cases will be guaranteed to be heard by judges perceived to be sympathetic to their arguments. While the strategy has long been used in patent cases, there been a concerted uptick for politically charged, wide-reaching cases that have been filed in Texas by Republican state attorneys general or conservative, private-sector parties. Under the new policy, such cases seeking nationwide or state-wide orders will go into the lottery system used by the entire district. “The current issue relates to nationwide injunctions or statewide injunctions,” Sutton said at a news conference Tuesday.

In Florida, Trump’s attorneys told Judge Aileen Cannon his Mar-a-Lago classified documents case should wait until after the 2024 election. But both hearings could have a significant impact on when – or whether – Trump will face trial in each of those two cases. The only case that appears set: Trump’s New York criminal trial will begin March 25, which Trump’s attorneys said was a “firm” date in court Friday. In Florida, meanwhile, a federal judge could push back Trump’s trial date in the classified documents case. Prosecutors and defense attorneys submitted a list of questions for potential jurors for the judge overseeing the case to review. The proposed jury questionnaire form gives insight into how each side in the case is approaching voir dire, or the process of questioning potential jurors, for the historic trial. The special counsel also opposes a question proposed by the defense seeking negative views potential jurors have of politicians. The documents case is one of four criminal prosecutions the former president and 2024 GOP frontrunner is facing. Every time the Supreme Court grants an appeal it settles on a specific legal question to resolve. In the immunity matter, the court didn’t embrace Trump’s framing – nor the question Smith posed when he sought review on the same issue in December. “The question implicitly rejects Trump’s position of absolute immunity because of that language ‘whether…and to what extent,’” Eisen said. By taking the appeal, the Supreme Court has effectively pushed back the start of a trial in the federal election subversion case by weeks, at least.

CNN —Twitter turned over at least 32 direct messages from former President Donald Trump’s account – @realDonaldTrump – to special counsel Jack Smith earlier this year as part of the federal election subversion investigation, according to newly unsealed court filings. The unsealed filings shed new light on the extent of the special counsel investigation into Trump’s efforts to overturn his 2020 election loss. Much of that conduct played out publicly, including on Trump’s Twitter account, where he promoted bogus claims of mass fraud and urged government officials to disrupt certification of the results. At the time of the prosecutors’ court argument to the appeals court, Trump wasn’t charged in federal court in either case. Another court filing unsealed Friday said that the warrant sought information from October 2020 through January 2021.

McAfee’s order shuts down the effort by Fulton County District Attorney Fani Willis to have all 19 defendants tried together in October. Smith took more streamlined approach than Willis against Trump, and charged him by himself, without any co-defendants. Additionally, several of the Georgia case defendants have parallel proceedings in federal courts underway. If any of those requests are successful, it is still unclear what that would mean for the rest of Willis’ case. Meadows will continue to fight in federal court to move the proceedings out of state court.

CNN —Former President Donald Trump will be restricted on how and when he can look at, and talk about, classified information, a judge decided Wednesday after a sealed hearing the day before. The development is one of the first times the court has set terms around classified information in a case where Trump’s team has tried to downplay the seriousness of how records were handled. Cannon held a sealed hearing about the handling of classified information in the case on Tuesday in South Florida, according to multiple sources familiar with the proceeding. But the judge said the SCIF areas would be overseen by a third-party officer from the federal government designated to guide the handling of the classified information in the federal case. Cannon’s order on Wednesday also specifies that apparently classified information in the case that hasn’t clearly been identified as being declassified should be treated with sensitivity.

CNN —Former President Donald Trump is asking Judge Tanya Chutkan to recuse herself from the 2020 election subversion case against him brought by special counsel Jack Smith. Trump, in a new court filing Monday, pointed to comments that Chutkan made in cases involving January 6 US Capitol rioters. “Presidents are not kings, and Plaintiff is not President,” Chutkan wrote in that ruling. CNN —A federal appeals court on Friday said the Biden administration likely violated the First Amendment in some of its communications with social media companies, but also narrowed a lower court judge’s order on the matter. The opinion was handed down jointly by Circuit Judges Edith Clement, Jennifer Walker Elrod and Don Willett – all appointees of Republican presidents. The conservative appeals court sided with many of the arguments put forward by the plaintiffs, which included private individuals as well Missouri and Louisiana, but also narrowed the injunction’s scope so that it only applied to the White House, the surgeon general, the CDC and the FBI. CNN —Special counsel Jack Smith said in a court filing Tuesday that former President Donald Trump has made “daily extrajudicial statements that threaten to prejudice the jury pool” in the 2020 election subversion case. The allegation arose in a court fight that remains largely under seal, so additional details are not public. The brief reference to Trump’s statements affecting the jury pool at the Washington, DC, courthouse came in a public filing in the federal criminal case. Smith’s office has been sparring with Trump’s team over how much of the underlying sealed dispute should be made public. Prosecutors tried earlier Tuesday to file court documents partially under seal – and partially on the public docket.

CNN —Far-right TV network One America News and one of its on-air personalities settled a defamation lawsuit brought by a former executive at Dominion Voting Systems, the election technology company that was falsely accused of rigging the 2020 election, according to new court filings. By negotiating a deal with Coomer, OAN is resolving one of several pending lawsuits tied to the 2020 presidential election that could lead to dire financial consequences for the small network. The conspiracy-peddling channel still faces two blockbuster defamation suits from Dominion Voting Systems and Smartmatic, voting technology companies that OAN falsely claimed had rigged the election against Trump. As a correspondent for OAN, Rion has been at the forefront of the network’s pro-Trump propaganda, and she hosted a special called “Dominion-izing the Vote,” which promoted debunked conspiracies about the 2020 election results. In the wake of the 2020 election, Dominion, Smartmatic and Coomer have transformed from relatively unknown figures to prominent players in the effort to seek accountability for Trump’s election lies.

CNN —Former White House trade adviser Peter Navarro goes on trial Tuesday as the second ex-aide to former President Donald Trump to be prosecuted for criminal contempt of Congress. With the judge finding that Trump did not make a formal invocation of privilege, Navarro will be severely limited in the defenses he can put in front of the jury. It declined to prosecute former Trump White House officials Mark Meadows and Dan Scavino, who were also subpoenaed by the committee and referred by the House to the Justice Department for contempt. Navarro told reporters outside the courthouse last week that his legal bills, including appeals of the case, would exceed $1 million. This is the same suit I wore in 2017 going into the White House,” he said.

This will be the first time that substantive arguments will be made in court about the four criminal cases brought against Trump this year. While he may still face an uphill battle to move his case, Meadows is “uniquely situated” in Willis’ case, said Steve Vladeck, a CNN analyst and professor at the University of Texas School of Law. The orders the judge has already issued have hewed tightly to the relevant statutes and case law, and he has moved the proceedings along efficiently. According to the grand jury indictment, Meadows arranged a call between Trump and Watson, and texted Watson himself to offer Trump campaign funding toward speeding up a ballot review in Fulton County. Willis also subpoenaed two lawyers who were on the Trump-Raffensperger phone call on Trump’s behalf: Kurt Hilbert and Alex Kaufman.

CNN —A federal judge on Wednesday rejected efforts by former Trump White House chief of staff Mark Meadows and ex-Justice Department official Jeffrey Clark to avoid arrest if they fail to turn themselves in by Friday’s deadline in the Georgia election subversion case. US District Judge Steve Jones declined the emergency requests by Meadows and Clark, who are both trying to move Fulton County District Attorney Fani Willis’ prosecution to federal court. Meadows argued he should be allowed to avoid processing in the Fulton County election subversion case that has been brought against former President Donald Trump and 18 others ahead of a hearing scheduled Monday. Such rulings would require state court proceedings for entire case – for all the defendants – to automatically be paused and moved to federal court, Clark argued in court filings earlier this week. She submitted to the federal court a state court ruling during those proceedings that described the special grand jury as criminal in nature.
