U.S. shale production costs are soaring and there is no sign that tight-fisted investors will change their demands for returns rather than investment in expanding drilling. At Helmerich & Payne (HP.N), one of the largest drilling contractors, its R&D budget will rise only $1 million, from 2022's $27 million. The U.S. government expects overall oil production to reach a new peak next year, but it has several times this year cut its forecasts. Shale production declines rapidly after peaking compared to conventional oil wells, falling about 50% after the first year. Lower production rates are "a longer-term prospect," said Mike Oestmann, chief executive of shale producer Tall City Exploration.

Traders are watching oil vs. oil stocks and thinking something has to give. Energy bulls insist supplies will remain tight and oil prices will likely be higher in 2023. Variable dividends Lower oil prices are not just a threat to profits: many oil companies have instituted variable dividends, where the variable portion of the payouts are dependent on cash flow. Companies with a variable dividend include Pioneer (PXD), ConocoPhillips (COP), Devon Energy (DVN), Diamondback Energy (FANG), and Coterra Energy (CTRA). The downside: No one is sure what the total payout (the fixed dividend plus the "variable" dividend) will be from quarter to quarter.

Mexican leaders have for years blasted illegal arms smuggling from the United States, with military-style guns often turning up at deadly crime scenes in the country. All of the retailers named as defendants are based in the southwestern U.S. state of Arizona, which borders northern Mexico's Sonora state. The new suit follows a $10 billion civil lawsuit filed by the Mexican government against U.S. gun manufacturers last year in Boston, which was dismissed by a U.S. judge late last month. "There is traceability information that shows that weapons that have been found in criminal scenes in Mexico were sold by those corporations we are suing today," Celorio said.
