In November 2021, Google asked the Justice Department to consider requiring Jonathan Kanter, assistant attorney general in charge of antitrust, to recuse himself because of his work for a long list of Google critics. The Justice Department filed the advertising lawsuit in January in Arlington, Virginia, along with eight states, and nine other states joined in April. While Brinkema declined to order Kanter recused, she seemed skeptical during a court hearing that he should be involved and added that the Justice Department should "use some wisdom" in deciding what to do.

The second defendant, Ethan Nordean, was a leader of the group who was convicted of seditious conspiracy and other crimes. The sentencing of Pezzola and Nordean follows U.S. District Judge Timothy Kelly on Thursday ordering two other former Proud Boys leaders, Joseph Biggs and Zachary Rehl, to serve 17 years and 15 years in prison, respectively. The government is seeking a 20-year prison term for Pezzola and a 27-year term for Nordean. Former Proud Boys Chairman Enrique Tarrio will be sentenced on Sept 5.
