A Georgia judge said Wednesday he will issue a protective order barring the public release of sensitive evidence exchanged between prosecutors and lawyers representing former President Donald Trump and his co-defendants in their election interference criminal cases in that state. "Until we decide what's going to be relevant and admissible, this case should be tried and not in the court of public opinion," said Fulton County Superior Court Judge Scott McAfee at a hearing on the proposed order. At Wednesday's hearing, the attorney Jonathan Miller, who is representing the defendant Misty Hampton, told McAfee that he gave the videos to "one media outlet." Miller said the public had the right to know what the four co-defendants had told the Fulton County District Attorney's Office, arguing that the statements they made "help my client." ABC News had first reported statements that Ellis and Powell made in their so-called proffer videos, while The Washington Post first reported statements made by Chesbro and bail bondsman Scott Hall in their own proffer sessions.

ATLANTA (AP) — Jury selection is set to begin Friday for the first defendant to go to trial in the Georgia case that accuses former President Donald Trump and others of illegally scheming to overturn the 2020 election in the state. CHESEBRO WILL BE TRIED BY HIMSELFUntil Thursday morning, Chesebro was set to go on trial alongside Powell after each filed a demand for a speedy trial. On Monday, prospective jurors will be called in groups of 14 for individual questioning. CNN —Rudy Giuliani has filed a new legal challenge against the criminal charges he’s facing in Georgia over his attempts to subvert the 2020 presidential election. And he faces defamation suits from Dominion and Smartmatic, voting technology companies that he falsely said rigged the 2020 election. In a separate case, a judge ruled that he defamed two Georgia election workers, and a jury will decide what he owes damages. Georgia election workers want another $100,000 in attorneys’ feesThe Georgia election workers who won a defamation lawsuit against Giuliani for his bogus fraud claims in the 2020 election say they are entitled to another $104,000 in attorneys’ fees stemming from the discovery disputes that arose in the case. Last month, Howell determined that Giuliani had lost the lawsuit brought by Georgia election workers Ruby Freeman and Shaye Moss after he failed to provide information sought in subpoenas.

The preemptory step by Fulton County District Attorney Fani Willis comes after the grand jurors who returned the 41-count indictment against Trump and 18 others were subjected to harassment when their information was posted online. Two of Donald J. Trump’s co-defendants in the Georgia election-interference case will go to trial together on Oct. 23, a judge ruled on Wednesday. The defendants, Sidney Powell and Kenneth Chesebro, had asked to be tried separately from one another. The ruling from Judge Scott McAfee of Fulton County Superior Court, however, is contingent on the case remaining in state court — a situation that could change if other defendants succeed at moving the case into a federal courtroom. Fani T. Willis, the district attorney of Fulton County, is still holding out hope that all 19 defendants in the racketeering case can be tried together.
