A federal judge in Pennsylvania on Tuesday declined to block the Federal Trade Commission’s ban on noncompete agreements, diverging from another judge’s recent finding that the agency’s move was on shaky legal ground. The decision clears one obstacle to the F.T.C.’s move to prohibit virtually all noncompete agreements, which prohibit employees from switching jobs within an industry and affect roughly one in five American workers. Several business groups sued to block the ban as soon as the F.T.C. voted to adopt it in April, saying it would limit their ability to protect trade secrets and confidential information. Denying the company’s motion for a preliminary injunction, she said the lawsuit was unlikely to ultimately prevail on the merits.

CNN —Incoming Utah State cornerback Andre Seldon Jr. died Saturday in an apparent cliff-diving accident at a reservoir about 20 miles from the school’s campus, the university said in a statement. The university identified the victim as Seldon, 22, who was joining the football team this year after two seasons at New Mexico State University and two at the University of Michigan. “Our football program is heartbroken to have to endure the loss of one of our own,” said Utah State interim Head Coach Nate Dreiling, who had joined the program after serving as New Mexico State’s defensive coordinator for two seasons. Seldon, who played all 15 New Mexico State games in 2023, transferred into the football program over the summer and was set to start classes this fall, according to the university. “Having had a previous relationship with Andre during our time together at New Mexico State, I can tell you he was an incredible person and teammate,” Dreiling said.

Imagine a system that lets big landlords in your city work together to raise rents, using detailed, otherwise-private information about what their competitors are charging. Such a system is already underway, according to a series of lawsuits filed by tenants and prosecutors across the country. The plaintiffs argue that real estate software from a company called RealPage is being used by apartment owners to increase rents. In a vast majority of cases, landlords adopt the suggested prices, passing the costs on to tenants, the plaintiffs assert. RealPage, owned by the private equity firm Thoma Bravo, advertises its software to landlords as a tool that can help them outperform the market by 3 to 7 percent.

Boeing agreed on Sunday to plead guilty to a felony charge of conspiring to defraud the federal government over two fatal crashes of the 737 Max in 2018 and 2019, according to a late-night court filing. The company will be put on probation, supervised by the Federal District Court for the Northern District of Texas, for three years. As part of the probation, the Justice Department will appoint an independent compliance monitor who will make sure that safety measures are in place and followed, submitting annual reports to the government. The decision by Boeing to plead guilty is significant because the company has not been convicted of a federal felony in decades. In the filing, the department described the charge of conspiring to defraud the federal government as “the most serious readily provable offense.”

The agreement may help Boeing put to rest a federal case stemming from two fatal crashes of the 737 Max in 2018 and 2019. Boeing and the Justice Department first reached an agreement in 2021 about the two crashes that allowed the company to avoid criminal charges. But federal prosecutors this year said that the company had violated the terms of that agreement and came up with a new one, which was agreed to in principle on Sunday.
