The decision comes just days before a trial on Trump's eligibility for the ballot is expected to begin. In a 24-page ruling, Colorado District Judge Sarah Wallace pushed back on Trump's argument that Congress, not courts, should handle questions related to his ballot eligibility. She also sided against Trump's claim that state election officials lack the power to enforce Section 3 of the 14th Amendment. Wallace's ruling Wednesday comes after Chief U.S. District Judge Philip A. Brimmer denied Trump's request to move the Colorado ballot case to federal court. In a four-page order, Brimmer sent the lawsuit back to the same state court in Denver County where it was filed on behalf of the group of voters.

Three of the 11 Crop Watch producers increased their corn yield expectations this week, the most notable coming in eastern Iowa. A 3.77 for average Crop Watch corn yield is still below what was expected in July and August, and it would land above the 2022 yield but below that of 2021. Rite Aid filed plans to close 154 stores on Monday as part of its Chapter 11 bankruptcy. Rite Aid is the smallest of the three major drugstore chains, well behind CVS and Walgreens. Rite Aid was expected to close stores as part of its bankruptcy. Rite Aid told Insider that it considers a variety of factors when deciding to close a store, "including business strategy, lease and rent considerations, local business conditions and viability, and store performance." "We will also strive to transfer associates to other Rite Aid locations where possible," the company said.

Crop Watch producers reported quick harvest progress in the first week of October, and soybeans were the prime beneficiary as many areas are close to wrapping up those efforts. Five Crop Watch soybean fields were harvested between last Monday and Sunday, three with slightly better than expected results and two with notably worse ones. Just two Crop Watch soybean fields await harvest: Ohio and North Dakota. Average Crop Watch corn yield remains unchanged at 3.61, and there were no adjustments to any individual scores this week. Only four of the 11 Crop Watch corn fields have been harvested as of Monday morning, and the most recent one was completed on Sept. 29.

David Minkin, an attorney for Maui County, told Reuters that only a small portion, if any, of its land was involved in the blaze. Wildfire victims have struggled over the years to hold landowners liable, even for fires ignited on their property. Rick Linkert, a California attorney who specializes in defending wildfire cases, said it may not be easy for Wells' legal team to show negligence. They would have to demonstrate there was an accepted standard for managing grasslands and that the landowners ignored it, he said. Maui County has filed its own lawsuit against Hawaiian Electric, which it blames for the fire.

DES MOINES, Iowa (AP) — Hundreds of communities around the country will share more than $1 billion in federal money to help them plant and maintain trees under a federal program that is intended to reduce extreme heat, benefit health and improve access to nature. U.S. Department of Agriculture Secretary Tom Vilsack will announce the $1.13 billion in funding for 385 projects at an event Thursday morning in Cedar Rapids, Iowa. Cedar Rapids has made the restoration of its tree canopy a priority since that storm, called a derecho, and will receive $6 million in funding through the new grants. She told reporters earlier that many communities have lacked access to nature and that all the tree grants would benefit marginalized and underrepresented communities. “Urban forests can really play a key role in ensuring both that access but also increasing the climate resilience of communities, helping reduce extreme heat and making communities more livable.”The federal money comes from the Inflation Reduction Act.

CNN —US stocks typically see their worst performance of the year in September, but there are signs the market could avoid a steep downturn this time around. This month has been the worst for stocks on average since 1928, according to Yardeni Research. That’s partly because, much like August, there is a lull in economic data that could catalyze a stock rally. While stocks fell roughly 2% in August, they still outperformed their 4% loss during the same month last year. It’s the latest example of how extreme weather, exacerbated by climate change, impacted major North American attractions this summer, reports my colleague Nathaniel Meyersohn.

It’s the latest example of how extreme weather, exacerbated by climate change, impacted major North American attractions this summer. Extreme heat in Florida also disrupted attendance at Walt Disney World and Universal Orlando this summer. Theme parks are building indoor rides and changing ticket policies to respond to brutal weather conditions. Golding has lowered his estimates for the theme park industry because of growing risks from extreme weather. SeaWorld warns in its annual report to investors that extreme weather events could cause it to “incur significant costs.”“The series of extreme weather events experienced in recent years presents an alarming trend,” SeaWorld said.
