The Supreme Court on Tuesday declined to hear arguments in a case challenging the Food and Drug Administration's authority to reject approvals of flavored electronic cigarettes. The FDA issues marketing denial orders to reject product applications. A spokesperson for the FDA did not immediately respond to a request for comment on the Supreme Court's decision. In 2016, the FDA determined that e-cigarettes were subject to its regulation, like traditional tobacco products. The agency gave companies until September 2020 to submit applications for approval of each of their vape products, even if they were already on the market.

Those measures include free vape kits, a voucher scheme to incentivise pregnant women to quit, and consulting on mandatory cigarette pack inserts, the spokesperson added. The move escalates a dispute between the two e-cigarette makers after Juul filed a similar patent infringement case against NJOY at the ITC in June. NJOY said in its filings that Juul products infringe two of its patents, and that it intends to obtain a ban on products including its currently marketed Juul device and Juul pods. NJOY also sued Juul in Delaware on Tuesday for infringing the same patents, seeking an unspecified amount of damages. Juul filed its own patent lawsuits against NJOY and Altria at the ITC and in Arizona federal court in June, seeking money damages and a ban on imports of NJOY's Ace vapor device. Altria won more than $95 million from cigarette rival R.J. Reynolds in North Carolina federal court last year after a jury found RJR infringed other Altria e-cigarette patents.

Altria Group sues Juul over e-vapor patent infringement

Marlboro maker Altria Group said Tuesday its subsidiary NJOY has sued Juul Labs — the e-cigarette company it once held significant stake in — over patent infringement of certain e-vapor products. Altria has called for a ban on the importation and sale of these Juul products. Altria bought full global ownership of NJOY's e-vapor product portfolio in June for approximately $2.75 billion. The deal included the product NJOY ACE, the only pod-based vape with market authorizations from the U.S. Food and Drug Administration. In addition to the lawsuit filed with the ITC, Altria filed a similar suit against Juul in the U.S. District Court for the District of Delaware.

A new CDC study found that some people have taken to smoking both cigarettes and vapes. Vapes were previously pitched as a way to switch or quit smoking cigarettes. Vapes have previously been marketed as a way to quit smoking cigarettes. Among all American adults, the CDC study found that 10.2% smoked only cigarettes, 3.2% smoked only e-cigarettes, and 1.3% smoked both. Meanwhile, adults aged 45 and over largely preferred cigarettes only, reporting the lowest percentages of e-cigarette use or dual use.

UK councils call for ban on disposable vapes by 2024

LONDON, July 15 (Reuters) - Councils in England and Wales have called on the UK government to ban the sale of single use vapes by 2024 on both environmental and health grounds. The LGA said 1.3 million disposable vapes were thrown away every week. The LGA said councils were also concerned about the impact vaping was having upon children and young people. "Disposable vapes are fundamentally flawed in their design and inherently unsustainable products, meaning an outright ban will prove more effective than attempts to recycle more vapes," David Fothergill, Chairman of the LGA's Community Wellbeing Board, said. The UK Vaping Industry Association defended disposable vapes.

July 2 (Reuters) - A Russian arms dealer freed last December in a prisoner swap for U.S. basketball star Brittney Griner has been chosen as the candidate of a far-right party for a seat in a Russian regional legislature, state news agency RIA reported on Sunday. RIA cited an official in Russia's ultra-nationalist Liberal Democratic Party (LDPR)'s local organisation as saying that Bout had been nominated as a candidate for the legislative assembly of the Ulyanovsk region in central Russia. Bout publicly joined the LDPR following his return to Russia. Despite its name, the LDPR holds far-right, ultra-nationalist views and strongly supports President Vladimir Putin's invasion of Ukraine. Lugovoi has served as an LDPR member of Russia's national parliament since 2007.

Flavored e-cigarettes represented 41.3% of U.S. retail-store e-cigarette unit sales in December 2022, up from 29.2% in January 2020, the organizations found. Overall e-cigarette sales in the U.S. rose about 47% in the period. The spike in sales comes despite a federal crackdown that placed more restrictions on the flavors and marketing for tobacco products. From January 2022 to December 2022, disposable e-cigarette unit share increased from 24.7% to 51.8% of total unit sales. Last year, the FDA ordered Elf Bar and Breeze Smoke off the U.S. market, according to the CDC report.
