Robert Roberson, 57, was set to become the first person in the U.S. executed in a "shaken baby" case until members of the state House Criminal Jurisprudence Committee issued a subpoena to have him testify at a legislative hearing this week. Despite efforts by the attorney general's office to appeal, as the execution was scheduled to get underway on the evening of Oct. 17, the Texas Supreme Court, in an 11th-hour decision, sided with the lawmakers, handing Roberson a temporary reprieve. Postal Service mailbox in Phoenix, Arizona, was set on fire at approximately 1:20 a.m. local time Thursday morning, damaging several ballots and other pieces of mail, according to the Phoenix Fire Department. McDade originally said Thursday that approximately 20 ballots were damaged, but Arizona Secretary of State Adrian Fontes later said that five ballots were affected. Robert Roberson, the condemned man whose execution was halted late Thursday because of an unprecedented legal gambit by Texas lawmakers, is expected to appear in person Monday at a legislative hearing in Austin, his legal representatives said. The subpoena was issued to help buy more time for Roberson, who has bipartisan support. The Office of the Attorney General quickly appealed the district court judge’s temporary injunction to the state’s highest criminal court, which agreed with allowing Roberson’s execution to continue. But lawmakers then petitioned their case to the Texas Supreme Court late Thursday as the hours ticked down before midnight — when Roberson’s death warrant was set to expire. State Rep. Brian Harrison, a Republican who helped to introduce the motion to subpoena Roberson, acknowledged Friday that although the execution was blocked, various issues remain at play.

Texas is preparing to put a man to death Thursday in what would be the nation’s first execution involving a case of “shaken baby syndrome,” a diagnosis that has been re-evaluated in more recent years, leading to the overturning of similar convictions. Prosecutors argued that Nikki must have been shaken to death because she had been diagnosed with “the triad” — a swollen and bleeding brain and retinal hemorrhaging — symptoms once believed to be indisputable evidence of shaken baby syndrome. In 2009, the American Academy of Pediatrics changed the name of shaken baby syndrome to the more broadly defined “abusive head trauma” to include injuries caused by mechanisms other than shaking alone. It is now medical consensus that other medical conditions, including infections, accidental trauma and pre-existing illnesses, can also cause the symptoms associated with shaken baby syndrome. Hundreds of possible shaken baby and abusive head trauma cases are reported to hospitals in the U.S. every year, according to a nonprofit advocacy group.

Two former Indiana University basketball players have sued their alma mater alleging their team doctor repeatedly sexually assaulted them and their teammates and the school did nothing to stop him. Delaney names the Trustees of Indiana University as defendants in the lawsuit, alleging Title IX violations by the school for failing to protect the students. The Nebraska Supreme Court ruled that convicted felons who served their sentences are allowed to vote, after the state's top election official sought to keep them from casting ballots ahead of the Nov. 5 election. Nebraska has historically restored the voting rights of former felons two years after they completed the terms of their sentences. While Nebraska is solidly Republican state, it awards an electoral vote to the winner of each of its congressional districts. The Sentencing Project, criminal justice reform advocacy group, estimated that eliminating the waiting period for convicted felons in Nebraska would restore voting rights for 7,000 people. Far more completed their felony sentences more than two years ago, too, and were affected by the state officials prohibition on their voter registration.

County election boards in Georgia are not allowed to refuse to certify election results, a state judge ruled on Tuesday. “If election superintendents were, as Plaintiff urges, free to play investigator, prosecutor, jury, and judge and so -- because of a unilateral determination of error or fraud -- refuse to certify election results, Georgia voters would be silenced. McBurney said the law was clear when it says that county officials "shall" certify the results. She is one of a growing number of Georgia officials who have refused to certify election results since 2020, worrying election experts that county officials might try and block the routine certification of election results in the name of baseless conspiracy theories. Adding to these concerns, the Republican-controlled Georgia State Election Board voted earlier this year to allow local boards to conduct “reasonable inquiry” into election results.

One year after an Army reservist perpetrated a mass shooting across Lewiston, Maine, lawyers representing survivors and families of the victims said Tuesday they are pursuing negligence claims against the federal government that could pave the way for 100 individual lawsuits. “Today marks the first step toward ensuring accountability and justice for the families and victims of the worst mass shooting in Maine history,” lawyer Benjamin Gideon of Gideon Asen LLC said in a statement.
