Smartmatic and Newsmax have reached a settlement in the voting technology company’s election defamation lawsuit against the right-wing news outlet shortly before the case was set to go to trial. The lawsuit focused on Newsmax's false claims that Smartmatic's machines rigged the 2020 presidential election for Joe Biden. Smartmatic sued Newsmax Media in 2021, alleging it claimed Smartmatic’s devices rigged the 2020 election. Former President Donald Trump and his allies have continued to promote false claims that the 2020 election results were manipulated to favor Biden. Smartmatic in April settled a similar defamation lawsuit against One America News for a sum that was not disclosed publicly.

Senate Foreign Relations Committee Chairman Ben Cardin was targeted by a caller who posed as a former top Ukrainian official during a recent Zoom call, according to a notice circulated to Senate offices and obtained by NBC News on Wednesday. According to the notice, the caller's questioning was "likely trying to bate the Senator into commenting on a political candidate." Cardin and his staff ended the call, the notice said, adding that Cardin's office contacted the State Department, which confirmed the caller was not Kuleba. Cardin referred to the caller as a "malign actor" in a statement about the incident his office released Wednesday night. NBC News reported this month that the Justice Department plans to file criminal charges in connection with the hacking of Trump’s campaign, according to two law enforcement officials.

"All these thugs better get their mind right and their ass out of our country before January 20th," the post concluded. That would be the day Trump and Vance would be sworn into office if they win November's election. Higgins' fellow Republican congressman from Louisiana, Majority Leader Steve Scalise, said, "The tweet has been deleted already and removed, but I object to the motion." Horsford told reporters afterwards that he'd spoken to Higgins earlier and that the Louisiana congressman had told him he would not remove the post.

Former President Donald Trump plans to return to Butler, Pennsylvania, where he faced an assassination attempt in July, for a rally next month, according to three sources familiar with the campaign’s schedule. Trump has long teased a return to the town where he was shot in the ear during an assassination attempt on July 13. It was not immediately clear whether the Oct. 5 rally will take place at the same venue in Butler. Iranian hackers have continued to make attempts since late June to transmit nonpublic stolen material tied to Trump’s campaign to media organizations, according to Wednesday’s statement, which noted that the FBI is tracking the activity. A federal judge Monday rejected an effort by former White House chief of staff Mark Meadows to move his Arizona indictment to federal court in a case focused on efforts to overturn Donald Trump's 2020 electoral defeat. U.S. District Judge John J. Tuchi said that Meadows missed a deadline to file his request and "has failed to show good cause that might permit the Court to excuse the untimeliness." An attorney for Meadows did not immediately respond to a request for comment Monday night. In April, a state grand jury in Arizona indicted Meadows and two other former Trump aides — Rudy Giuliani and Boris Epshteyn — and several so-called “fake electors” over efforts to overturn Trump's election loss in the state in 2020. Meadows previously lost an attempt to move his Georgia indictment to federal court in a similar case.

The counting and certification of electoral votes at the Capitol in January — the first since the Jan. 6 riot in 2021 — will come with significantly increased security, the Secret Service said Wednesday. The Department of Homeland Security has designated the Jan. 6 count as a national special security event, affording it a level of security similar to events like the State of the Union address and the Super Bowl. “National Special Security Events are events of the highest national significance,” Eric Ranaghan, the special agent in charge of the Secret Service’s Dignitary Protective Division, said in a statement Wednesday. The Secret Service, which is part of the Department of Homeland Security, also cited reports from the former House Jan. 6 committee and the Government Accountability Office, which had asked Homeland Security Secretary Alejandro Mayorkas to consider the enhanced security measures. The designation will unlock federal, state and local resources to be used in its security plan, the Secret Service said.

Prosecutors in Donald Trump's classified documents case in Florida asked a federal judge on Friday to block the former president from making public statements that pose "a significant, imminent, and foreseeable danger to law enforcement agents" investigating and prosecuting the case. The Trump campaign also claimed in a fundraising email that President Joe Biden was "locked & loaded ready to take me out" during a search of his Mar-a-Lago property for classified documents. In making the allegations, Trump and his campaign appeared to be citing recently unsealed court filings related to the 2022 search. In making the request, prosecutors are asking for Trump to face higher stakes if he makes statements that the court finds endangers law enforcement. "Repeated attempts to silence President Trump during the presidential campaign are blatant attempts to interfere in the election," campaign spokesperson Steven Cheung wrote.

Former U.S. President Donald Trump speaks after attending a wake for New York City Police Department (NYPD) officer Jonathan Diller, who was shot and killed while making a routine traffic stop on March 25 in the Far Rockaway section of Queens, in Massapequa Park, New York, U.S., March 28, 2024. Former President Donald Trump has posted a $175 million bond in the New York civil fraud case, preventing seizure of his assets while the case is on appeal. The bond comes after a state appeals court ruled last week that the former president and his co-defendants had 10 days to post the amount, which was reduced from the $464 million judgment that was originally due March 25. Before last week's ruling, Trump was liable for $454 million, most of the fraud judgment, but the amount he owed had been growing by more than $111,000 daily due to added interest.

A Kansas man is suing Rep. Tim Burchett, R-Tenn., over social media posts that falsely identified him as an undocumented immigrant and one of the shooters in the Kansas City Chiefs Super Bowl parade that turned deadly last month. "At no time was Plaintiff an 'alien,' an 'illegal alien,' nor a 'shooter' and the assertions to the contrary were false and were circulated widely among Defendant's followers," the lawsuit states. Burchett in February posted an image of Loudermill on X, identifying him as "one of the Kansas City Chiefs victory parade shooters" and "an illegal Alien." Federal courts require cases seeking damages between people in different states, such as this one, to exceed $75,000. Although he was released and not cited or charged with a crime, the lawsuit states, his image began circulating on social media, eventually landing on Burchett's page.
