A Georgia judge said Wednesday he will issue a protective order barring the public release of sensitive evidence exchanged between prosecutors and lawyers representing former President Donald Trump and his co-defendants in their election interference criminal cases in that state. "Until we decide what's going to be relevant and admissible, this case should be tried and not in the court of public opinion," said Fulton County Superior Court Judge Scott McAfee at a hearing on the proposed order. At Wednesday's hearing, the attorney Jonathan Miller, who is representing the defendant Misty Hampton, told McAfee that he gave the videos to "one media outlet." Miller said the public had the right to know what the four co-defendants had told the Fulton County District Attorney's Office, arguing that the statements they made "help my client." ABC News had first reported statements that Ellis and Powell made in their so-called proffer videos, while The Washington Post first reported statements made by Chesbro and bail bondsman Scott Hall in their own proffer sessions.

New details unearthed in snippets of recorded interviews with four of Donald Trump’s co-defendants who pleaded guilty in the Georgia election interference case spell trouble for the former president and others indicted in the sprawling racketeering scheme. The confidential taped proffers with Fulton County prosecutors were leaked on Monday to ABC News and The Washington Post. “Whether you're talking about racketeering or you're talking about a drug conspiracy, the same principles always apply,” Copeland says. A lot of times the state looks bottom up – the smaller fish will talk about the bigger fish. “In this particular case, it really is an interesting assortment of folks who have come forward, especially from the attorneys' part,” she adds.

Former Trump lawyer Jenna Ellis said an advisor told her the president would not leave his post. Per Ellis, during the December 19 Christmas party, she had told Scavino that their cause was "essentially over." Portions of proffer videos – the legal term for videotaped conversations some of Trump’s co-defendants had with prosecutors – were leaked to several news outlets on Monday. The Fulton County district attorney’s office did not immediately respond to CNN’s request for comment about the emergency protective order or leaked videos. The videos provide some new details about efforts by those close to Trump to reverse the election in his favor. In the months since the motion, the district attorney’s office did not follow up to ask for an official ruling. “Instead, defendants must come to the District Attorney’s Office to view confidential video recordings of proffers.

In the aftermath of the 2020 election, former President Donald J. Trump planned to refuse to leave the White House “under any circumstances” despite losing at the polls, a longtime Trump aide told one of the lawyers who is cooperating with prosecutors in Atlanta as part of a plea agreement. The lawyer, Jenna Ellis, described the aide’s statement during an interview with the district attorney’s office in Fulton County, Ga., parts of which were obtained and published on Monday by ABC News. Such interviews, known as proffer statements, have been conducted with Ms. Ellis and three other defendants who reached plea agreements in the Georgia election interference case against Mr. Trump and more than a dozen of his allies. ABC obtained excerpts from the interviews with Ms. Ellis and Sidney Powell, another lawyer indicted in the case.

"If such media reports are accurate, Meadows testified under oath that his Book contains known falsehoods," Meadows' publisher All Seasons Press says in its suit in Sarasota County court in Florida. Instead, Meadows "chose to emphasize events from the 2020 presidential election through the January 6th Attack." "One of the Book's primary theses is that President Trump was the true winner of the 2020 Presidential Election and that the election was stolen by President Biden through widespread election fraud," the suit says. In another part of the book, Meadows wrote that Trump was "absolutely correct" in claiming that he did not lose the election. A day after that report, CBS News reported that Meadows was "extensively cooperating with" Smith's election interference probe of Trump.

ATLANTA (AP) — Some Republican lawmakers continued to press Wednesday for changes to protect Georgia's voting system from security weaknesses, but a deputy to Secretary of State Brad Raffensperger accused them of acting in bad faith and promoting lies that Georgia's 2020 election was stolen from Donald Trump. The dispute with some Republicans in the state Senate stems from vulnerabilities in Dominion Voting Systems equipment identified by J. Alex Halderman, an expert witness in a lawsuit challenging the constitutionality of Georgia’s election system. However, they say it's impractical to update all 40,000 electronic voting machines and scanners statewide before the 2024 election cycle begins. Senate Ethics Committee Chairman Max Burns, a Sylvania Republican, said at the end of the hearing he wanted to see changes. Fueling interest in voting changes are Republican Party activists who say that Georgia's 16 electoral votes were stolen from Trump in 2020.

Manhattan Supreme Court Justice David B. Cohen rejected Fox Corp. and Fox News’ attempts to subpoena George Soros, his son Alex Soros, and their philanthropic organization Open Society Foundation (OSF) for documents related to the election defamation case. Fox argued that Alex and George Soros, as well as OSF, possess material necessary to the network’s defense in the defamation trial. The documentation, Fox argued, would establish a connection between George Soros and Smartmatic. “I base that on the finding that the crux of Smartmatic’s claims is that Fox has asserted they were part of rigging [the election], not that Smartmatic was affiliated with George Soros, Alex Soros, or the OSF,” Cohen said. “We’re interested in the closeness of the relationship, what Soros has done for Smartmatic over time,” Marks said.

Former President Donald Trump faces a key week ahead, and yet again the drama won’t be on the campaign trail but in the courtroom as the GOP front-runner’s children prepare to testify before a judge. Ivanka Trump was initially listed as a co-defendant, but a New York appeals court dismissed that status, finding that the claims against her were too old. Chutkan had imposed a narrow gag order on Trump earlier this month, barring him from making public statements targeting prosecutors, court staff and potential witnesses. But she paused the gag order to allow Trump’s defense team time to argue why his speech should not be restricted. The ACLU has sided with Trump, arguing that the gag order is a violation of First Amendment free speech protections.

With so many lawyers involved in the Watergate criminal scheme, the American Bar Association started requiring law schools to provide ethics instruction or risk losing their accreditation. In Fulton County, Ga., three of former President Donald Trump’s lawyers — Kenneth Chesebro, Sidney Powell and Jenna Ellis — have now pleaded guilty to crimes in service of Mr. Trump’s scheme to overturn the 2020 election and stay in the White House. All three have agreed to cooperate with prosecutors in the sprawling state RICO case against Mr. Trump. Two other Trump lawyers, Rudy Giuliani and John Eastman, still face criminal charges in the Georgia case. If Mr. Trump’s 2020 racket was “a coup in search of a legal theory,” as one federal judge put it, these lawyers provided the theory, and the phony facts to back it up.

On Tuesday morning, Jenna Ellis became the third Donald Trump-allied lawyer to plead guilty in Fulton County, Ga., to state criminal charges related to Trump’s efforts to overturn the results of the 2020 presidential election in Georgia. The Ellis, Powell and Chesebro guilty pleas represent an advance for both the state election prosecution in Georgia and the federal election prosecution in Washington. At the same time, however, it’s far too soon to tell whether the prosecution has made real progress on Trump himself. The ultimate importance of the plea deals depends on the nature of the testimony from the lawyers, and we don’t yet know what they have said — or will say. To understand the potential significance of these plea agreements, it’s necessary to understand the importance of Trump’s legal team to Trump’s criminal defense.

(CNN) – Fulton County prosecutors have discussed potential plea deals with at least six additional co-defendants charged alongside Donald Trump for attempting to subvert the 2020 presidential election, multiple sources tell CNN. Pro-Trump lawyer Robert Cheeley is among those who have been offered a plea deal in the Georgia case but, according to his lawyer, turned it down. A source with knowledge of the Fulton County DA’s strategy tells CNN that it would be open to discussing plea deals with anyone, but there is little room for compromise when it comes to the charges against Trump. To be clear, there is no indication that prosecutors or Trump’s legal team are interested in discussing a plea deal. John Eastman, who is also considered one of Trump’s most high-profile co-defendants, has not been offered a plea deal either, his lawyer told CNN.

“Mark Meadows always thought it was rigged, the whole thing was rigged,” Trump said. Trump was indicted by Smith in August in Washington, D.C., for attempting to overturn the 2020 presidential election and for inciting a riot at the Capitol on Jan. 6, 2021. The report from ABC News comes at a precarious moment for Trump, the GOP presidential primary front-runner who faces a total of 91 criminal charges stemming from four indictments. "If I knew then what I know now, I would have declined to represent Donald Trump in these post-election challenges. He reiterated those points on social media, where Trump also posited that perhaps Meadows, after years of being pressured by Smith and other prosecutors, finally told Smith what he wanted to hear in order to secure his own immunity.

Unnamed sources familiar with the situation told ABC News and Bloomberg that Meadows testified before a federal grand jury hearing evidence in the election interference probe. It was not clear what Terwilliger told ABC News was inaccurate. Both ABC News and Bloomberg reported that Meadows told the grand jury he had informed Trump in the immediate aftermath of the 2020 election that claims of mass election fraud were baseless. CNN —It’s raining “guilty” pleas in Trump-world. The rapid succession of guilty pleas not only marks a big blow to Trump, but also to the right-wing media apparatus that championed and disseminated his election lies to the masses. In the aftermath of the 2020 election, both Ellis and Powell toured across MAGA Media, becoming heroes to Trump’s fans as they sowed doubt about the legitimacy of the election. Fox News, which repeatedly hosted Ellis in the wake of the 2020 election, suddenly became disinterested in the former Trump lawyer. The result is that a good portion of the channel’s audience, made up of legions of viewers who willfully seclude themselves in right-wing media safe spaces, will likely miss the consequential news.

WASHINGTON, Oct 24 (Reuters) - A former lawyer for Donald Trump, Jenna Ellis, pleaded guilty on Tuesday to helping the then-U.S. president's efforts to overturn his 2020 election defeat in the state of Georgia and agreed to testify against Trump if called upon. "What I did not do and should have done, your honor, was to make sure that the facts the other lawyers alleged to be true were in fact true," Ellis told Fulton County Superior Court Judge Scott McAfee. Ellis, 38, pleaded guilty to aiding and abetting false statements and writings. Prosecutors said she attended a meeting with Georgia lawmakers where Trump personal lawyer and former New York Mayor Rudy Giuliani made false claims about voting irregularities. It is unclear what Powell, Chesebro and Ellis have told prosecutors or how broad their testimony could be.

Trump’s Loss of Loyalty

But for Trump, Ellis' plea was especially damaging, since it underscored the steady evaporation of something Trump has demanded from staff and associates since his days as a New York businessman: loyalty. "If I knew then what I know now, I would have declined to represent Donald Trump in these post-election challenges. The three former Trump lawyers who pleaded guilty in Georgia were facing some serious potential consequences, he noted, including not just time behind bars but the loss of their law licenses – and that may take priority over honoring Trump's demands for loyalty. "This is not about Donald Trump vs. Michael Cohen," Cohen said as he entered the New York courtroom. Jenna Ellis, the right-wing attorney who worked on the Trump 2020 presidential campaign, pleaded guilty Tuesday to a criminal charge in the Georgia election interference case. Ellis is the latest co-defendant of former President Donald Trump to take a deal with prosecutors, joining Sidney Powell and two others. Ellis, 38, pleaded guilty in Fulton County Superior Court to one count of aiding and abetting false statements and writings. The charge related to false claims of voter fraud that were made to members of the Georgia Senate at a hearing in early December 2020. In a tearful statement before Judge Scott McAfee, Ellis expressed regret for her actions in the wake of Trump's loss to President Joe Biden in the 2020 election.

That happened Sunday when Trump posted on social media, in capital letters, that Powell “was not my attorney, and never was." Smith's indictment notes Trump privately told others that he thought her election fraud ideas sounded “crazy." Campaigning in New Hampshire on Monday, Trump appeared to refer to Powell and Cheesbro as “good people” and said prosecutors worked to “hound” and “scare” them. Steve Sadow, Trump's lead attorney in the Georgia case, expressed confidence that Powell’s plea wouldn’t hurt Trump, saying last week that any truthful testimony offered would be "favorable to my overall defense strategy." The Georgia indictment accuses Powell in a plot to illegally access a county's voting equipment.

Former Trump attorney Jenna Ellis broke down as described her efforts to overturn the 2020 election. Ellis pleaded guilty to one count related to her efforts to overturn Georgia's 2020 election results. She pleaded guilty to one count of aiding and abetting false statements, stemming from her falsely telling Georgia lawmakers that fake votes were counted in the 2020 election. Powell, last week, pleaded guilty to her own set of criminal charges in the case, and Giuliani faces numerous other legal problems. A Colorado judge said she "undermined the American public's confidence in the presidential election" as he handed down a censure.

A spokesman for Mr. Giuliani did not immediately respond to a request for comment. With her guilty plea, Ms. Ellis became the fourth defendant — and the third lawyer — in the case to reach a cooperation deal with Fani T. Willis, the Fulton County district attorney. While a person familiar with Ms. Ellis’s thinking described her as being extremely angry at Mr. Giuliani, her cooperation could be perilous for Mr. Trump as well. Indeed, if Ms. Ellis, Ms. Powell and Mr. Chesebro all end up taking the stand, they could paint a detailed collective portrait of Mr. Trump’s activities in the postelection period. They could touch upon a brazen plot, rejected by Mr. Trump, to use the military to seize the country’s voting machines.
