CNN —A former dive boat captain could be sentenced to up to 10 years in prison Thursday on a negligence conviction known as “seaman’s manslaughter” after 34 people were killed in a fire that broke out on his boat in 2019. Jerry Nehl Boylan was found guilty in 2023 of one federal felony count of misconduct or neglect of ship officer last year. Thirty-three passengers and one crew member below deck died of smoke inhalation, police said. Thirty-four people were killed in the boat fire. In 2019, an attorney for the boat’s owner, Truth Aquatics, said that a crew member had checked the area where the fire was believed to have been concentrated before it ignited.

The captain of a dive boat that caught fire off the coast of Southern California in 2019, killing all 33 of its passengers and a crew member, was sentenced on Thursday to four years in prison after a lengthy hearing that included emotional testimony from relatives of the victims. A federal jury in November found the captain, Jerry Nehl Boylan, guilty of misconduct or neglect of ship officer, a crime also known as “seaman’s manslaughter.”Mr. Boylan, 70, of Santa Barbara, Calif., was the captain of the Conception, a commercial scuba diving vessel, when a fire broke out in the early hours of Sept. 2, 2019, while the ship was anchored near Santa Cruz Island, according to prosecutors. Mr. Boylan and four other crew members were able to escape the fire, but the 33 passengers, who were sleeping below deck, died, prosecutors said. One crew member also was killed. Prosecutors said Mr. Boylan failed to try to save them.

Prosecutors in Arizona said on Monday that they would not retry a rancher who was charged with murdering an unarmed migrant on his property last year after a mistrial was declared last week. Judge Thomas Fink of Santa Cruz County Superior Court declared a mistrial on April 22. The Santa Cruz District Attorney’s Office said in a statement on Monday that “because of the unique circumstances and challenges surrounding” the case, Mr. Kelly would not be retried. “However, our office’s decision in this case should not be construed as a position on future cases of this type,” the office said. “Our office is mandated by statute to prosecute criminal acts, and we take that statutory mandate seriously.”

A judge on Monday declared a mistrial in the case of an Arizona rancher who was accused of murdering an unarmed migrant on his property after he crossed the U.S.-Mexico border last year, in a case that inflamed people on both sides of the national debate over immigration. The mistrial was declared after jurors were unable to reach a unanimous verdict during deliberations that began on Thursday. The judge scheduled a hearing for April 29, according to the Arizona Superior Court in Santa Cruz County. Calls on Monday evening to prosecutors and to Brenna Larkin, a lawyer for Mr. Kelly, were not immediately returned. Gabriel Cuen-Buitimea was among a group of undocumented migrants who were crossing the high desert in Kino Springs, Ariz., near the border with Mexico on Jan. 30, 2023, when they spotted a Border Patrol vehicle and scattered, according to the authorities.

Gavin Newsom last year vetoed legislation that would have decriminalized the possession and personal use of several plant-based hallucinogens, including psychedelic mushrooms. Colorado and Oregon have already decriminalized psychedelic mushrooms and establish regulated systems for therapeutic use of the substances. In California, San Francisco, Oakland and Santa Cruz have effectively decriminalized possession of psychedelic mushrooms, meaning a person cannot be arrested or prosecuted for possessing limited amounts of plant-based hallucinogens. California already has “a massive network" of underground therapists who provide psychedelic therapy, Wiener said. Touted as a mind-bending drug in the 1960s, psychedelic mushrooms have been used in religious or spiritual practices in some cultures for centuries and possibly thousands of years.

CNN —A stronger and longer-lasting atmospheric river event is set to hit California this weekend, bringing a considerable risk for flash flooding, mudslides, damaging winds, and heavy mountain snow. Nearly 40 million people are under flood watches including San Francisco, Sacramento, Los Angeles, and San Diego. In Southern California, widespread rainfall totals of 3 to 6 inches are expected – more than a month’s worth of rain for most. A more widespread Level 2 exists for much of coastal California including San Francisco down through Los Angeles. On Monday, the Level 3 of 4 risk expands farther south to include Los Angeles.
