A ballot measure that would have enshrined abortion rights in Florida's constitution failed on Tuesday, NBC News projects, after a political fight that was among the most hotly contested in the state this election cycle. The amendment won majority support from Florida voters, but it needed to cross the 60% threshold to pass under state law. Its defeat is a setback for reproductive rights groups in the red-leaning state and a victory for Republican Gov. Even though the ballot measure failed, the NBC News Exit poll found that 65% of Florida voters said abortion should be legal in all or most cases. Another ballot measure DeSantis opposed, the effort to legalize the use of recreational marijuana in Florida, also failed on Tuesday, NBC News projected.

North Carolina Attorney General Josh Stein defeated scandal-plagued Republican Lt. Gov. Mark Robinson in the state’s gubernatorial race, NBC News projects, keeping the seat in Democrats’ hands. In other Facebook comments on a livestream from 2019, Robinson said abortion “is not about protecting the lives of mothers. Stein’s victory was boosted by female voters, college-educated voters and independents, a key group needed for victories in battleground races. And while 63% of female voters in the state cast their ballots for Stein, while just 34% of women pulled the lever for Robinson.

An effort to legalize the use of recreational marijuana in Florida has failed at the ballot box, NBC News projects. Despite endorsements running the gamut from the Florida Democratic Party to former President Donald Trump, Amendment 3, which would have legalized the recreational use and manufacturing of marijuana in the state, failed to get the 60% voter support needed to pass a state constitutional amendment. Florida voters expanded eligibility for medical use in a successful 2016 statewide vote. For the foreseeable future, however, recreational use of the drug will remain illegal in Florida. We don’t need that in Florida,” DeSantis said of the drug, also urging voters to reject Amendment 4, which would enshrine Roe-era reproductive health protections in the Florida Constitution.

Jim Justice won the state’s open Senate seat Tuesday, NBC News projects, moving Republicans one step closer to flipping the balance of power in the chamber. Justice faced little competition from Wheeling Mayor Glenn Elliott, a Democrat, in a race that Republicans were heavily favored to win after the retirement of independent Sen. Joe Manchin, who left the Democratic Party in May. Justice won election as governor in 2016, the year Trump won the state by more than 42 percentage points. After months of publicly clashing with his party, Manchin announced he wouldn’t seek re-election. But Justice cruised to victory, defeating Mooney by 35 points in May, and faced little political opposition since.

In the top-of-the-ticket presidential race, Vice President Kamala Harris and former President Donald Trump entered the day virtually deadlocked in national polling and surveys of the pivotal battleground states. Voting has now wrapped up in all seven swing states and most others. But no swing states have been called, and the race will hinge on their results. Bomb threats roiled polling places in swing states, including Georgia, Arizona and Michigan. Though the election is by no means over, Mr. Trump is showing strength, winning states like Texas and Florida easily. Democrats will have to run the tables in the Republican states of Ohio and Montana to maintain their one-seat control of the Senate.

CNN —Vice President Kamala Harris and former President Donald Trump have tied with three votes each in the tiny New Hampshire township of Dixville Notch, kicking off Election Day in one of the first places in the country to report its presidential preference. By tradition, all eligible voters gather at the now-dormant Balsams Hotel in Dixville Notch to cast their secret ballots once polls open at midnight. Once every ballot is cast, votes are tallied and results announced – hours before anywhere else, making it a destination for national reporters, who often outnumber the voters. In January, four registered Republican voters and two independents participated in the GOP primary, casting six unanimous votes for former South Carolina Gov. Political experts told Business Insider that the Iowa poll is significant for the Harris campaign given that the demographic makeup of Iowa — rural, older, and largely white voters — is similar to some key swing states. Glenn Youngkin’s effort to purge 1,600 people he says are suspected noncitizens from the state’s voter registration rolls using records from the Department of Motor Vehicles. Nadra Wilson was also listed as a noncitizen and was purged from Virginia’s voter rolls. She also didn’t realize she had been purged from Virginia’s voter registration rolls until she received a call from CNN. She said she is still undecided but “I have the right to vote.”Saule Bohoney was also wiped off of Virginia’s voter registration rolls. Henry McMaster to reduce his sentence to life in prison without parole because of his spotless prison record and willingness to be a mentor to other inmates. A prison employee announced the execution could begin at 6:01 p.m. Moore took several deep breaths that sounded like snores over the next minute. Three jurors who condemned Moore to death in 2001, including one who wrote Friday, sent letters asking McMaster to change his sentence to life without parole. They were joined by a former state prison director, Moore’s trial judge, his son and daughter, a half-dozen childhood friends and several pastors. Moore is the second inmate executed in South Carolina since it resumed executions.

In states where tensions have long boiled over reproductive rights, family planning experts say women face mounting barriers to getting birth control. In June, Senate Republicans blocked a bill that would have enshrined a national right to birth control into law. States have been left to decide if they will protect access to birth control. The Right Time initiative is part of Michelle Trupiano's work at Missouri Family Health Council that reduces costs and helps Missourians to obtain birth control. She works at a family planning clinic that is benefiting from Title X funding, which means right now, uninsured patients can get birth control through the clinic.
