The House Ethics Committee investigating Rep. Matt Gaetz has reached out to the woman whom the congressman allegedly had sexual relations with when she was a 17-year-old minor, according to a source familiar with the committee’s work. The federal probe, which also included allegations he had sex with a minor, concluded in 2023 with no charges brought against the congressman. The increased activity under Republican leadership is notable given the committee probe was started by House Democrats in 2021. But McCarthy has repeatedly denounced those accusations and has said Gaetz worked to oust the former speaker because of the ethics probe. The probe expanded over the years before the Justice Department officially decided last year not to charge the congressman.

That should be no surprise considering that a consistent proponent of this inquiry was former President Donald Trump. I make that judgment based on my work as a scholar of impeachment and also as a practitioner who helped lead the first Trump impeachment and trial as counsel to the House Judiciary Committee. McCarthy bitterly — and now hypocritically — criticized former Speaker Nancy Pelosi for announcing the first Trump impeachment before a vote (she later scheduled one). That includes examples like the inquiry into President Richard Nixon and the second Trump impeachment. The proposed Biden impeachment is a revenge mission and nothing more.

When Fulton County District Attorney Fani Willis filed criminal charges against former President Donald Trump and over a dozen of his allies for their attempt to overturn Georgia’s 2020 presidential election results, she did something ingenious. In contrast to Special Counsel Jack Smith’s latest laser-focused federal indictment of Mr. Trump, Ms. Willis charges a wide range of conspirators from the Oval Office to low-level Georgia G.O.P. functionaries and is the first to plumb the full depths, through a state-focused bathyscope, of the conspiracy. Her case also provides other important complements to the federal matter: Unlike Mr. Smith’s case, which will almost certainly not be broadcast because of federal standards, hers will almost certainly be televised, and should Mr. Trump or another Republican win the White House, Ms. Willis’s case cannot be immediately pardoned away. It is a reminder of the genius of American federalism: When our democracy is threatened, states have an indispensable part to play in protecting it.

By charging the case in the Southern District of Florida, the special counsel has wisely pre-empted one other potential defense: improper venue. On the one hand, he has to ensure that Mr. Trump, like any defendant, has sufficient time to file motions challenging the charges and evidence and time to prepare for trial. In a Vox article, senior correspondent Ian Millhiser pointed out that there is "something painfully anticlimactic" about the indictment against Trump. Trump was indicted on 34 felony counts of falsifying business records in connection to a 2016 hush-money payment to the adult film star Stormy Daniels. "If I were the prosecution, I would ask for a gag order covering the parties and their attorneys," Neama Rahmani, a former federal prosecutor, told Insider. Indeed, House Republicans vowed revenge on Trump's behalf and said Tuesday that they would go after Bragg and President Joe Biden in light of Trump's indictment.
