The situation has prompted Hunter Biden to add noted defense attorney Mark Geragos, who runs his firm out of Los Angeles, for the tax trial. The Delaware trial lasted seven days, but a tax trial is expected to last much longer, meaning at a far greater cost for the defendant. A previous deal between Hunter Biden and special counsel David Weiss to avoid trials and potentially prison time a year ago fell apart in dramatic fashion. Lunden Roberts, the mother of one of Hunter Biden’s children whom he had a child support battle over, has also been subpoenaed to testify, her lawyer says. Hunter Biden’s attorneys Lowell and Geragos have experience advocating for high-profile pardons.

CNN —Hunter Biden is set to be sentenced on his gun crime convictions days after the 2024 election. Federal Judge Maryellen Noreika has scheduled the sentencing proceeding in Delaware’s federal court for November 13, according to an order from the court on Friday. Hunter Biden faces a maximum sentence of up to 25 years in prison and a fine of up to $750,000 at sentencing. He also faces an upcoming second federal criminal trial, on tax charges in California, that could complicate his sentencing. In Delaware’s federal court, a jury unanimously voted to convict Hunter Biden in June on three felony gun charges intended to prevent drug addicts from possessing firearms.

CNN —Rudy Giuliani’s trip to Milwaukee for last week’s Republican National Convention was bankrolled by the media platform started by “My Pillow Guy” Mike Lindell, Giuliani’s lawyer told a bankruptcy court that is scrutinizing the former New York City mayor’s finances. Lindell told CNN on Tuesday that Giuliani is an employee of the media company, but declined to say how much he was being paid for the job, which he said started July 1. Judge Sean Lane of the federal bankruptcy court in White Plains, New York, is expected to issue a ruling any day on how to move forward. Lindell told CNN on Tuesday that he paid for Giuliani’s travel because the former New York mayor was hired on July 1 as a host for Lindell’s right-wing broadcast platform, FrankSpeech TV. Giuliani said he had “no regrets at all” about how he treated Moss and Freeman during the 2020 election.

CNN —The Biden-Harris campaign on Sunday formally amended filings with the Federal Election Commission to rename its principal committee and declare Kamala Harris a candidate for president. The move means that should she remain on the ticket for the general election, according to the Campaign Legal Center, Harris could assume control of the Biden-Harris campaign account, which had nearly $96 million cash in hand at the end of June. It’s possible the Biden campaign will need to ask the Federal Election Commission for guidance, in the form of an advisory opinion, in the coming weeks, Engle added. That could allow Harris to start a new campaign account, revisit donors who had already maxed out contributions to the Biden-Harris campaign and hit them up again, one election attorney said. “I think the general consensus view is, because Harris’s name is already on the paperwork, she can accept it for the general election.

Giuliani only appears to have a portion of that amount in his personal bank account, which keeps being depleted to pay other bills, Wednesday’s federal court proceedings in White Plains, New York, revealed. Giuliani has been slow to disclose what cash he has on hand in liquid accounts, and hasn’t been fully transparent, the judge has found. Last Friday, Giuliani’s bankruptcy protection ended, and creditors such as the 2020 election workers Ruby Freeman and Shaye Moss are now able to pursue his $10 million net worth. He told Giuliani’s lawyers they had until Thursday at “high noon; that’s appropriately theatrical” to notify the court of a plan for Giuliani to resolve his bills. “If your client persists in this course of action, there are a lot of bad things that can happen,” Lane told Giuliani’s attorneys on Wednesday.

CNN —Former Donald Trump White House adviser Peter Navarro was released from a Miami federal prison Wednesday after completing his four-month sentence for defying a subpoena from the January 6 congressional committee. Trump adviser Steve Bannon started serving his four-month sentence earlier this month at a federal prison in Connecticut. Navarro, who is in his 70s, worked as a law library clerk during his time in the prison camp, his prison consultant Sam Mangel told CNN. “It gave him a chance to write.”Mangel said Navarro was liked and respected by his fellow inmates while in the prison. While Navarro was unsuccessful in an emergency appeal to delay his prison sentence, he is now appealing his conviction on the merits.

CNN —A federal judge’s decision to toss out Donald Trump’s classified documents criminal case means the former president can now talk to his co-defendants and potential witnesses about what happened at Mar-a-Lago without facing consequences. That means Trump, his co-defendants and potential witnesses against them are no longer barred from discussing the case among each other. De Oliveira remains the property manager at Trump’s Mar-a-Lago Club in Florida. Such conditions are the norm in the federal district where the criminal case was brought. De Oliveira was “elated” Cannon dismissed the criminal case against him and the former president, his attorney John Irving told CNN.

Judge Aileen Cannon had been on the federal bench for little more than a year when a senior judge offered to preside over one of her first criminal trials in her isolated south Florida courthouse. “It’s very lonely,” Senior Judge Paul C. Huck told CNN of Fort Pierce, a small fishing and citrus community on the edge of the Southern District of Florida where Cannon is the only federal judge. They also said Cannon’s lack of trial experience, both as a lawyer and a judge, is apparent. In her seven years as a Justice Department attorney, Cannon participated on the trial teams of just four criminal cases. And on the bench, she’s only presided over a handful of criminal trials — and Huck took over one of them.

CNN —A federal judge on Monday dismissed the classified documents case against Donald Trump, a shock ruling that clears away one of the major legal challenges facing the former president. In a 93-page ruling, District Judge Aileen Cannon said the appointment of special counsel Jack Smith violated the Constitution. She did not rule on whether Trump’s alleged mishandling of classified documents was proper or not. Even though a trial before the presidential election was considered highly unlikely, many legal experts had viewed the classified documents case as the strongest one of the four cases that were pending against the former president. Smith had charged Trump last year with taking classified documents from the White House and resisting the government’s attempts to retrieve the materials.

CNN —The Justice Department doesn’t want to return to Jacob Chansley the infamous horned helmet and flag-pole spear that he carried inside the US Capitol on January 6, 2021. Chansley pleaded guilty — without a trial — to the felony obstruction charge and was sentenced to 41 months in prison in 2021. He has finished serving his prison time but has two years left of court-supervised release. “The government would like to ensure finality in the appellate process in this and other cases,” prosecutors added. “The government’s request to continue to hold the property as evidence until such finality in the criminal prosecution is assured is thus appropriate.”The Justice Department also said it may consider keeping Chansley’s spear and helmet as part of a civil forfeiture.

CNN —Rudy Giuliani is no longer entitled to bankruptcy protection, a judge decided Friday, making it possible for creditors to immediately pursue his assets within days. Judge Sean Lane of the federal bankruptcy court in New York made the decision partly because of Giuliani’s lack of transparency after he filed for bankruptcy more than six months ago. The worth of those other assets is unclear, as creditors accuse Giuliani of downplaying or not disclosing complete estimates of the value of what he owns. The creditors believe one World Series ring alone would sell for nearly $30,000, according to court filings in his bankruptcy case. Giuliani agreed to end his bankruptcy proceedings, after Freeman and Moss suggested that approach earlier this week.

Giuliani’s bankruptcy attorneys and his spokesman didn’t provide additional comment to CNN for this story. They want the bankruptcy judge on Wednesday to throw him out of bankruptcy court. For instance, in recent weeks, according to his financial records available in court, Giuliani made 40 purchases from Amazon totaling nearly $3,500. “Unfortunately, in this case, good news always seems to be accompanied with bad,” lawyers for his creditors wrote to the bankruptcy judge last month. “We saw the same thing and have requested information, and a cup of coffee,” Giuliani’s own bankruptcy lawyers told the creditors.

CNN —Attorneys for former President Donald Trump are now seeking to use the Supreme Court’s presidential immunity decision to help him in his criminal case in Florida over the mishandling of classified documents. In a new court filing Friday, Trump’s team said they want an updated schedule in the federal classified documents case so they can argue points related to the Supreme Court decision. The decision “guts the Office’s position that President Trump has ‘no immunity’ and further demonstrates the politically-motivated nature of their contention that the motion is ‘frivolous,’” Trump’s attorneys wrote. The Supreme Court’s decision directly applies to the federal case over 2020 election subversion efforts in Washington, DC, but it could impact all four of the criminal cases against the former president. Trump’s attorneys argue the concurrence “adds force” to motions Trump has filed against how Smith was appointed and funded.

CNN —The Supreme Court handed down a landmark decision Monday granting Donald Trump partial immunity from special counsel Jack Smith’s election subversion case, handing the former president a significant win during his reelection bid. For starters, the Supreme Court ruled that for “core” presidential activity, Trump has the absolute immunity he had sought. The analysis about what’s immune and what isn’t “ultimately is best left to the lower courts to perform,” Roberts wrote. Immune, immune, immune,” she wrote. In a significant break from the court’s other conservatives, Barrett seemed to suggest Trump should go to trial quickly.

CNN —The biggest question now that the Supreme Court has decided Donald Trump is entitled to some immunity from prosecution: What happens next in special counsel Jack Smith’s election interference case against the former president? Those are likely to come in the days after the Supreme Court hands the opinion down formally to the federal courts in DC. The Supreme Court said that that Trump’s pressure campaign on Vice President Mike Pence to help him overturn the election is “presumptively” immune, and put the burden on the prosecutors to rebut the presumptive immunity. The Supreme Court’s ruling strongly suggests that those appeals would need to be resolved pre-trial, making it unlikely this case goes to a jury before Americans cast their ballots for president. Jack Smith’s options going forwardIt’s also possible that Smith’s office winnows down his case to bring it in line with the Supreme Court’s opinion.

CNN —Steve Bannon, a former Donald Trump White House strategist, is set to report to a federal prison in Danbury, Connecticut, on Monday to begin a four-month sentence for defying a congressional subpoena. ‘More powerful in prison’The MAGA media firebrand was keeping a busy schedule in the days before his prison sentence. “I’m going to be more powerful in prison than I am now,” Bannon said last week. Here’s what you need to know about the massive software outage. Its systems are used by roughly 15,000 car dealerships across the United States and Canada. Under normal circumstances, the CDK software allows the dealership to register a vehicle almost instantaneously, but now the process faces heavy delays. It said it was able to bring a “small initial test group” of car dealerships back online. But the next morning, the company told dealerships another incident had happened.

Charges against Trump not likely affectedThe people who pushed their way into the Capitol aren’t the only ones who are facing the obstruction charge. But even before the court’s decision was handed down, Smith made clear that the charge was based on different circumstances in Trump’s case. The Supreme Court’s opinion did not address the fake electors scheme specifically. What is far more important for Trump is the Supreme Court’s pending decision on immunity. The Justice Department has taken steps for months in its prosecutions of rioters to shore up the obstruction charges.

CNN —Judge Aileen Cannon wants to hold additional hearings on Donald Trump’s attempts to challenge key evidence in his classified documents case and will allow the former president’s lawyers to question witnesses about the investigation and search of Mar-a-Lago. Those issues were argued in hearings on Tuesday, but Cannon did not rule on the matters. The judge did not say when additional hearings would be held. The special counsel’s office has strongly opposed the need for additional hearings and Trump’s attempts to cut out parts of the case. Cannon has not set dates for the additional hearings yet.

“The financial impact it will directly have on us will take months to correct, if not years,” Callahan said. Tom McParland, the owner of Automatic Consulting, a national car buying service, said the outage was impacting customers because they have fewer dealers to choose from. “It limits the customer’s leverage.”Some dealers also can’t apply factory rebates without CDK’s software, so customers may miss out on money-saving deals. CNN —Federal Judge Aileen Cannon said Tuesday she had “a hard time seeing” any problems with the warrant the FBI obtained to search former President Donald Trump’s Mar-a-Lago estate in the summer of 2022. Trump’s attorney Emil Bove had argued that the warrant was overly broad and unjustly allowed agents to search the entire Mar-a-Lago premises. Bove, like in other recent hearings in the classified documents case, wants the judge to hold even more hearings that could probe into the investigators’ work. “They purported to look for classified documents in a gym and a kitchen,” he added. Investigators say they found classified documents in various places at the resort, including a public ballroom, a bathroom and a bedroom.

Special Counsel Jack Smith delivers remarks on a recently unsealed indictment including four felony counts against former President Donald Trump on August 1, 2023 in Washington, DC. Drew Angerer/Getty ImagesAttorneys for Donald Trump will continue their legal efforts to throw off special counsel Jack Smith and the classified documents case against the former president in Florida on Monday. Trump’s attorneys will battle prosecutors in court on the second part of Trump’s argument that Smith’s appointment was illegitimate, focusing on how he’s being funded. On Friday, prosecutors, defense attorneys and third parties fought over whether Smith was legitimately appointed as special counsel, an argument district Judge Aileen Cannon seemed skeptical of during the hearing. “President Biden’s DOJ is paying for this politically motivated prosecution of Biden’s chief political rival ‘off the books,’ without accountability or authorization,” Trump’s attorneys argued in their filing earlier this year.
