Attorney General Merrick Garland speaks at the Justice Department on Sept. 27. Chip Somodevilla / Getty ImagesHow Trump’s legal jeopardy has unfolded over the past year, in terms of both the criminal charges and his sweeping election victory, is unprecedented. The immediate goal of Trump’s legal team is to get that postponed indefinitely or otherwise dismissed. The Georgia election interference case against Trump remains tied up on appeals over ethical issues surrounding the district attorney. “The American people have re-elected President Trump with an overwhelming mandate to Make America Great Again," Trump Campaign Spokesman Steven Chung said in a statement.

With his comeback victory over Vice President Kamala Harris in the books, Trump can rest easy. But he has not yet escaped from liability in a handful of high-profile civil cases, where he has been ordered to pay combined penalties of over $570 million. "In theory, there should be no effect" from Trump's election on those civil matters, former federal prosecutor Neama Rahmani told CNBC. "It's well established that while a sitting president can't be prosecuted, he can face civil cases," Rahmani said. A state-level criminal case in Georgia, alleging Trump illegally meddled in that state's 2020 election, is also on ice.

Dismissing Smith would allow the Department of Justice and Trump’s attorney general to move to drop the charges against him and end the court cases. In the DC case, Smith charged Trump over his efforts to overturn his election loss in 2020. In September, state and federal appeals courts in New York heard arguments for two of Trump’s civil appeals.

CNN —One year after bringing historic indictments against former President Donald Trump, the prosecutors left in special counsel Jack Smith’s office are gaming out legal options and bracing for retribution if Trump returns to the White House. In the event that Trump wins, staffers detailed to the special counsel’s office would have the option to go back to their home divisions within the Justice Department. But former prosecutors on the Trump case could face a difficult workplace, once Trump’s appointees are running the department. If Vice President Kamala Harris wins, the choices for the department and the special counsel’s office may be much simpler. “Just think of the chaos of it all – that, he [Trump] would love,” one of the former Justice Department officials said.

Those rules were designed to prevent a repeat of the abuses of Richard Nixon, who improperly used the Justice Department to punish his political enemies. Former President Donald Trump said Thursday that, if elected to a second term in November, he would immediately fire special counsel Jack Smith, who brought two federal indictments against Trump. "It's so easy — I would fire him within two seconds," said Trump, who added that he got “immunity at the Supreme Court" and called Smith a "crooked person." Firing him as special counsel potentially could end the federal government's prosecution against Trump. Judge Tanya Chutkan allowed the release of hundreds of pages of heavily redacted documents last week that contained evidence the special counsel was using for the prosecution. Last year, Trump warned that Smith and other Justice Department officials would wind up in a mental institution if he's re-elected.

WASHINGTON — Republican Presidential candidate Donald Trump on Friday called the judge overseeing the Jan. 6-related federal criminal case against him "the most evil person," despite threats U.S. District Judge Tanya Chutkan has already faced from his supporters. They do show that Smith’s team is relying upon transcripts of interviews and other information disclosed by the House Jan. 6 Committee, which dissolved after Democrats lost the House in 2022. Chutkan began overseeing the Trump case following his first federal indictment in the Jan. 6-related case in August 2023 and made clear from the beginning that Trump's 2024 presidential candidacy would have no impact on her handling of the case. You know, judge is supposed to keep— what judge would say ‘We’re going to release something, you know, a couple of days before.'" One key to Smith's case is his contention that Trump knew the lies he spread to his followers about the 2020 election were, in fact, false.

CNN —Special counsel Jack Smith on Friday released nearly 2,000 heavily redacted pages of documents in his 2020 election subversion criminal case against former President Donald Trump, revealing snippets of the evidence Smith relied on to charge the former president. The documents were released a day after Judge Tanya Chutkan rejected a bid by Trump to pause the release. Others include a myriad of claims of voter fraud during the 2020 election. The final volume includes memos from lawyer John Eastman with a plan for Pence to reject the congressional certification of the 2020 election. Prosecutors have charged Trump with four crimes stemming from his actions following his 2020 election loss, including conspiracy to defraud the United States and obstruction.
