Fulton County prosecutors asked a Georgia appeals court this week to restore six charges against former President Donald Trump that were tossed in his indictment over attempts to overturn his 2020 election loss in the state. In a court filing, prosecutors from Fulton County District Attorney Fani Willis' office requested that the state's Court of Appeals reinstate six counts, including three against Trump, that she said Fulton County Superior Court Judge Scott McAfee wrongly discarded earlier this year. "The trial court erred by quashing six counts of the indictment in this case, each of which alleged the crime of Solicitation of Violation of Oath by Public Officer," they wrote. The three solicitation counts against Trump included accusations that he solicited Georgia House Speaker David Ralston and twice solicited Georgia Secretary of State Brad Raffensperger. Four of the original 19 co-defendants in the case have pleaded guilty, while Trump, Meadows, Giuliani and the others have pleaded not guilty.

Washington CNN —Gateway Pundit, the far-right conspiracy site, has settled a defamation lawsuit from two Georgia election workers who were falsely accused of rigging the 2020 results. The Gateway Pundit, infamous for publishing extremely partisan and sensationalized material, often dabbles in baseless right-wing conspiracy theories. The company tried to declare bankruptcy in April, saying the 2020 defamation cases were threatening its solvency. Gateway Pundit is appealing that ruling. WASHINGTON — Former New York City Mayor Rudy Giuliani has been disbarred from practicing law in Washington, D.C., according to an order filed Thursday by the Court of Appeals for the District of Columbia. Both panels had pointed to Giuliani trying to get thousands of votes for President Joe Biden tossed out in the battleground state of Pennsylvania that year. The D.C. Bar's Board on Professional Responsibility said in a report in June that there was "clear and convincing evidence" that Giuliani "violated Pennsylvania Rules of Professional Conduct" and therefore "should be disbarred." Giuliani also lost his law license in New York state in July over his actions to disseminate lies about voter fraud in the 2020 election. Separately, he faces charges in Arizona and Georgia over his efforts to overturn the 2020 election results in those states.

A settlement has been reached in a defamation lawsuit pitting an electronic voting machine manufacturer targeted by allies of former President Donald Trump against a conservative news outlet that aired accusations of vote manipulation in the 2020 election. The Delaware lawsuit, which takes issue with Newsmax reports over a five-week period in late 2020, is one of several stemming from reports by conservative news outlets following the election. Smartmatic also is suing Fox News for defamation in New York and recently settled a lawsuit in the District of Columbia against the One America News Network, another conservative outlet. Dominion Voting Systems similarly filed several defamation lawsuits against those who spread conspiracy theories blaming its election equipment for Trump's loss. Last year, in a case presided over by Davis, Fox News settled with Dominion for $787 million.

CNN —Former New York City Mayor Rudy Giuliani is disbarred in Washington, DC, the district’s highest local court said Thursday, a move stemming from the ethics proceedings Giuliani faced in New York because of his efforts to help former President Donald Trump try to overturn the 2020 election. Those New York proceedings led to Giuliani losing his license to practice there this summer, and because the DC Bar has a reciprocal relationship with the New York Bar, he is now being disbarred in the district. According to the new order from the DC Court of Appeals, Giuliani did not respond to an opportunity to object to his disbarment in Washington. Meanwhile, two Georgia election workers obtained a $148 million defamation judgment against him for false allegations he made about them after the 2020 election. A federal judge Monday rejected an effort by former White House chief of staff Mark Meadows to move his Arizona indictment to federal court in a case focused on efforts to overturn Donald Trump's 2020 electoral defeat. U.S. District Judge John J. Tuchi said that Meadows missed a deadline to file his request and "has failed to show good cause that might permit the Court to excuse the untimeliness." An attorney for Meadows did not immediately respond to a request for comment Monday night. In April, a state grand jury in Arizona indicted Meadows and two other former Trump aides — Rudy Giuliani and Boris Epshteyn — and several so-called “fake electors” over efforts to overturn Trump's election loss in the state in 2020. CNN —Members of the grand jury in Arizona that indicted 18 allies of Donald Trump earlier this year for their alleged roles in attempting to overturn the 2020 election had also expressed interest in charging the former president, according to a new court filing. The interest was strong enough that it prompted the state’s lead prosecutor to request that the grand jury not indict the former president and give a PowerPoint presentation to explain his reasoning. Prosecutors cited two primary reasons for why the grand jury should not charge Trump: a lack of evidence and a US Justice Department policy they believe would hamper charges against a former president. The policy cited by prosecutors deals with DOJ guidelines limiting how the federal government can prosecute individuals already charged with similar crimes at the state level. An Arizona grand jury that indicted 18 allies of former President Donald Trump on criminal charges related to trying to overturn his 2020 election loss in the state was interested in indicting Trump as well, but was asked not to do so by the state attorney general's office, according to a new court filing. Attorney General Kristin Mayes' office disclosed the grand jury's interest in charging Trump in a filing that disputed a claim by many of the defendants that the office was politically biased in prosecuting them in the so-called fake electors case. "The State Grand Jury was told by the Attorney General's Office on multiple occasions that it had the discretion to indict no one," the office wrote. He also was charged last year in state court in Atlanta with trying to overturn Biden's victory that year in Georgia.
