A Manhattan jury will be asked a narrow question this week: How much money must former President Donald J. Trump pay the writer E. Jean Carroll for defaming her after she accused him of raping her? Ms. Carroll’s chance encounter decades ago at the Bergdorf Goodman department store, in which she said Mr. Trump shoved her against a dressing room wall, pulled down her tights and forced himself on her, was already the focus of a trial last year. At the time, Mr. Trump called her claim “totally false,” saying that he had never met Ms. Carroll, a former Elle magazine advice columnist, and that she invented a story to sell a book. Now, Mr. Trump says he wants to attend and testify at Ms. Carroll’s trial, something he didn’t do in the earlier case. That’s sparked a bitter dispute between lawyers for Ms. Carroll, 80, and Mr. Trump, 77, over what the former president could say if he took the stand, and whether he would stray beyond strict boundaries the judge has set.

A federal appeals court on Thursday denied former President Donald Trump's request to halt proceedings in the upcoming E. Jean Carroll defamation trial. Circuit Court of Appeals to delay the case for 90 days while he considered appealing the court's previous rejection of his efforts to use presidential immunity as a defense. The appeals court denied that request on Thursday, allowing the trial to begin Jan. 16. U.S. District Judge Lewis Kaplan in June denied Trump's immunity argument, writing that presidential immunity is "not a 'get out of damages liability free' card." Trump has also raised the presidential immunity argument in the election interference case brought against him by special counsel Jack Smith.

CNN —Colombian superstar Shakira settled her tax evasion suit with the Spanish authorities on Monday, avoiding a trial that was due to start that day. At the beginning of court proceedings in Barcelona, the judge announced a last-minute agreement submitted by all parties to avoid trial. Shakira was asked by the judge if she was aware of the deal and the latest fines agreed to which the singer responded yes. Spanish prosecutors had alleged the Grammy-winning singer failed to pay personal income and wealth tax between 2012 and 2014, currently valued at about $15.6 million. The Colombian pop star disputed that, calling the accusations “false” in an interview with Elle magazine in September 2022.

Opinion: Why I’m not going to have children
  + stars: | 2023-11-11 | by ( Opinion Anna Lee | ) edition.cnn.com   time to read: +10 min
But each day, the current state of the world dissuades me more and more from having children. Like many folks in Gen Z (those born between 1997 and 2012), my main concern is climate change. As environmental catastrophes reach a caliber we cannot predict or conceive, having children is becoming less of a risk I’m willing to take. Coupled with the resources and opportunities that the US provides, my hypothetical children likely wouldn’t be among the worst-affected by climate change. Under today’s environmental and political climate, I find it is better to regret not having children than regret having them.

REUTERS/David Dee Delgado Acquire Licensing RightsNEW YORK, Nov 3 (Reuters) - A federal judge said Donald Trump will face an anonymous jury as it decides how much he should pay E. Jean Carroll for defaming the writer in 2019 by denying that he raped her. U.S. District Judge Lewis Kaplan in Manhattan said he found "strong reason" to provide special protections for jurors at the scheduled Jan. 16, 2024 civil trial. Neither Carroll, a former Elle magazine columnist, nor Trump, nor anyone else objected to using an anonymous jury, the judge said. Another anonymous jury in May ordered Trump to pay Carroll $5 million for sexual assault and defamation in a second lawsuit, after Trump again denied her claims in October 2022.

Circuit Court of Appeals in Manhattan challenged Trump's lawyer Michael Madaio during oral arguments in Trump's appeals of pivotal rulings by U.S. District Judge Lewis Kaplan. Carroll's lawyer Joshua Matz rejected any suggestion that Trump could not waive absolute immunity because "broader structural considerations" were at play. "A party who believes that they are holding onto absolute immunity from suit does not behave the way that Mr. Trump behaved it his case." The appeals court did not say when it will rule. The appeals court could order Trump to pay damages and costs if it ends up agreeing with the judge.

Trump is appealing the May 9 jury verdict, as well as Kaplan's June 29 refusal to dismiss the current lawsuit, to the 2nd U.S. REPUTATIONAL HARMIn his 25-page decision, Kaplan said the May 9 jury verdict eliminated the need to relitigate the alleged attack. Kaplan also said the verdict precluded Trump from arguing that his June 2019 statements, which were similar to his October 2022 statements, were not defamatory. On Aug. 18, Judge Kaplan called Trump's appeal of his decision to let the second case go to trial "frivolous." In his June 2019 statements, Trump also disparaged Carroll by saying "she's not my type" and the alleged rape "never happened."

WASHINGTON — A U.S. federal judge on Friday denied former President Donald Trump's fourth attempt to delay the trial date in a defamation case against him brought by the writer E. Jean Carroll. U.S. District Court Judge Lewis Kaplan, in a 17-page order, said Trump's request to stay the case while he appealed a previous ruling from the same court failed to meet any of the criteria under which a delay would typically be granted. The trial is currently set to begin on Monday, Jan. 15, the same day as the first-in-the-nation nominating contest in Iowa. If the current timeline holds through January, then the trial in federal district court in the Southern District of New York will most likely begin the following day, Jan. 16. As the defamation case wound its way through the legal system, Carroll sued Trump again in 2022 under a different statute, accusing him of both sexual abuse and defamation.

Trump, 77, filed his counterclaim in a second defamation lawsuit by Carroll, 79, who is seeking at least $10 million. The verdict reflected that "Mr. Trump 'raped' her, albeit digitally rather than with his penis," Kaplan wrote on Monday. There is also the fact that the jury found Trump sexually assaulted Carroll well before he ever assumed office. REUTERS/Reba SaldanhaJune 27 (Reuters) - Former U.S. President Donald Trump on Tuesday sued E. Jean Carroll for defamation, alleging she falsely accused him of rape after a jury in a civil trial found that he sexually abused her. Trump's counterclaim against Carroll in Manhattan federal court comes after a jury's unusual finding in May that he sexually abused and defamed but did not rape Carroll, a former Elle magazine advice columnist. "Donald Trump again argues, contrary to both logic and fact, that he was exonerated by a jury that found that he sexually abused E. Jean Carroll," Kaplan said. Trump's filing in that same lawsuit Tuesday cite Carroll's statements on CNN after the verdict, when she said Trump raped her despite the jury's finding that he only sexually abused her. The new filings come in Carroll’s first lawsuit against Trump, which she filed in 2019 for defamation only.
