Montana has long been a deep-red state in presidential elections — and every other statewide office is currently held by a Republican. WASHINGTON — The Supreme Court on Friday handed a loss to Republicans by allowing Pennsylvania voters who sent mail-in ballots that were flagged as being potentially defective to submit a separate provisional in-person ballot. The justices rejected, with no noted dissents, a Republican request to put on hold a Pennsylvania Supreme Court ruling from last week. The Supreme Court action does not definitively resolve the legal issue, which could yet return to the justices. Many of Pennsylvania's counties, which administer elections, already allowed for voters to cast provisional ballots if their mail-in ballots lacked a secrecy envelope even before the recent state Supreme Court ruling. Genser and Matis lost in a trial court, but an intermediate appeals court and the Pennsylvania Supreme Court ruled in their favor, prompting Republicans to appeal again to the U.S. Supreme Court.

CNN —The North Carolina Court of Appeals on Tuesday unanimously rejected a Republican bid to have election officials segregate overseas ballots cast by people who have never resided in the state for additional checks of the voters’ eligibility. The court’s decision is the latest blow to Republican efforts to attack overseas ballots in critical battleground states. Earlier Tuesday, a federal judge in Pennsylvania dismissed a challenge to the vetting procedures for overseas ballots in that state. And last week, a state judge in Michigan sided against the GOP in a case targeting ballots cast by people who had never lived there but were eligible to vote in the state because of familial ties to it. Though North Carolina’s policy of accepting ballots from overseas voters has been on the books for several years, starting in 2016, civilian voters abroad began outnumbering the military vote overseas – which itself is not as conservative as it once was.
