CNN —The legal battle over a controversial Texas immigration law could eventually give the Supreme Court a chance to revisit a historic ruling that largely struck down Arizona’s “show me your papers” law and reaffirmed the federal government’s “broad, undoubted power” over immigration. “It would have been incredibly difficult for the 5th Circuit to let this law stand under existing Supreme Court precedent,” she said. ‘Show me your papers’ lawThe Arizona law is a high-profile example of what happens when states attempt to take immigration policy into their own hands. Jan Brewer signed the Support Our Law Enforcement and Safe Neighborhoods Act, known as SB 1070, into law in 2010. The Supreme Court upheld the “show me your papers” part of the law and struck down the three other parts.

Antonio Masiello | Getty ImagesTwo weeks after a Delaware court ruled that Tesla must rescind Elon Musk's $56 billion pay package, the company's board remains mum on what the decision means for shareholders or what's next for the mercurial CEO. CNBC sent requests for additional information to Tesla investor relations, Musk and some board members. "Given the high stakes involved, it is likely that Tesla will appeal the decision," Kastiel said in an email. In the absence of a successful appeal, "any new compensation arrangement with him will have to be assessed" in light of McCormick's decision, Kastiel said. Kastiel also said that the decision likely makes Musk and Tesla more vulnerable to other types of lawsuits.

The hefty sum underscores the legal jeopardy Trump faces as he marches toward securing the 2024 Republican presidential nomination. The Trump campaign did not respond to a request for comment on the legal spending. Trump’s campaign paid Atlanta attorney Steven Sadow $1.5 million in the second half of 2023. Campaign money was also used to pay attorneys who have represented co-defendants and potential witnesses in the Trump cases. New York CNN —Nearly 900,000 Americans sitting down to Thanksgiving dinner this week will have unions – and the double-digit pay increases they won – to thank. The strike lasted more than six weeks before the union won contracts it was seeking from all three unionized US automakers. The unions won significant pay increases and job protections they were seeking. And even with some of the contracts that pass, some union members offer significant opposition, believing they could have negotiated for even more. Minneapolis CNN —The New York civil fraud trial of former President Donald Trump carries extremely high stakes for the self-proclaimed business mogul. “It’s between severe and seismic” as to the effects on Trump’s businesses, Thomas told CNN on Monday. Early last month, an appeals court judge paused the dissolution process for the duration of the ongoing $250 million fraud trial. A New York judge fined Donald Trump's family business the maximum penalty of $1.6 million for committing tax fraud. “[Trump] has largely been absent from the New York market for a long time,” he said.

Top law firms call out antisemitism on college campuses

New York CNN —Some of the nation’s most powerful law firms are warning America’s elite universities to crack down on antisemitism on campus – or the schools and their students will face real consequences. “Over the last several weeks, we have been alarmed at reports of anti-Semitic harassment, vandalism and assaults on college campuses, including rallies calling for the death of Jews and the elimination of the State of Israel,” more than two dozen law firms wrote in a letter obtained by CNN. The letter campaign was spearheaded by Joe Shenker, senior chair of Sullivan & Cromwell, according to the New York-based law firm. “One would hope that by the twenty-first century, antisemitism would have been relegated to the dustbin of history,” Columbia University leaders said in a statement. Last month, a Columbia student hanging up posters on campus in support of Israel was assaulted.

Bankman-Fried's will be the first of Williams' blockbuster white collar cases to go to trial. The cases Williams, 43, has brought so far show he has been a "steward" of the SDNY's longstanding priorities, said Kan Nawaday, who overlapped with Williams at the office. Prosecutors had described the cases as the first insider trading cases brought involving digital assets. Williams' charges against Bankman-Fried came just one month after FTX's collapse, which former prosecutors say is very fast for a complex white collar case. CNN —The European Court of Human Rights will hear an “unprecedented” lawsuit on Wednesday, brought by six young people against 32 European countries accusing them of failing to tackle the human-caused climate crisis. It is the first climate case to be filed with the European Court of Human Rights and is the largest of a total of three climate lawsuits the court is hearing. If it passes procedural hurdles, the court could rule that states do not have human rights obligations when it comes to climate change. “That could be very damaging to other similar cases,” said Michael B. Gerrard, director of the Sabin Center for Climate Change Law at Columbia Law School. Climate litigation is an important tool, said Catherine Higham, coordinator of the Climate Change Laws of the World project at the London School of Economics.

Elizabeth Moore, VP of PR and Communications at Breitbart, told Reuters, “We never indicated that the DOJ is seeking or will seek the death penalty. “The Eighth Amendment rules out the death penalty unless the defendant intended or had a high degree of culpability with respect to the death of the victim. “Nor does it plead any of the aggravating factors -- from a list in the federal death penalty statute --that need to be specified. When seeking the death penalty, the indictment must include special findings as detailed in the DOJ’s Justice Manual (here). Donald Trump is not facing the death penalty in the federal indictment brought by Special Counsel Jack Smith on overturning the 2020 election.

This argument has been partially successful with US District Judge Aileen Cannon in the federal classified documents case. It is unclear whether the judge assigned to the Georgia case would be amenable to delay arguments. I expect that, as in the New York case, where the judge recently denied such a motion, Trump will seek to move the case against him to federal court. While those decisions may not be binding on the Georgia judge, they will be informative as he considers the issues. As president, Trump would have the power to scuttle the federal cases and a greater ability to avoid accountability in the state cases as well.

On Monday, Fulton County District Attorney Fani Willis announced the fourth indictment against Trump — as well as 18 others — for alleged attempts to overturn the 2020 presidential election results in Georgia. The indictment is sweeping, invoking Georgia’s version of the Racketeer Influenced and Corrupt Organizations Act (RICO) and 40 other counts. While this Georgia indictment does not provide the easy-to-read narrative that Smith gave us in the federal election interference case, the evidence here was exhaustively collected over more than two years. Since these charges have been brought in Georgia state court — and not federal court — neither Trump, should he win in 2024, nor any another Republican president can issue a pardon. Under Georgia law, a state pardon can only be given by a state pardon board — not the governor — and only afterfive years have passed following completion of the sentence.

"We've seen a dramatic expansion of rights for conservative religious communities that has had a detrimental impact on equality rights, certainly for LGBTQ people," said Elizabeth Platt, director of the Law, Rights and Religion Project at Columbia Law School. Smith, who said she opposes gay marriage based on her Christian beliefs, was represented by the Alliance Defending Freedom, a conservative religious rights group. Still, the ruling illustrated a disparity in how the court views protections for LGBT people in contrast to the competing conservative Christian interests, Platt said. He stood out among conservatives in his espousal of sympathy both for conservative Christian causes and for what is sometimes called the "dignity interests" of marginalized groups including LGBT people. Barrett's addition gave it a 6-3 conservative margin and recalibrated how it weighed conservative Christian causes against the dignity interests of people protected by civil rights laws.

What the Supreme Court’s LGBTQ rights decision means
  + stars: | 2023-06-30 | by ( Devan Cole | ) edition.cnn.com   time to read: +8 min
“So I think the category of businesses that will be able to claim free speech rights against anti-discrimination laws is not at all clear. Jennifer Pizer, the chief legal officer for Lambda Legal, an LGBTQ rights group, also said the court wasn’t clear on what types of businesses are included within the category the court mentioned. Sepper similarly said that the majority didn’t specifically limit the decision to LGBTQ people. So this opens the door to race, religion, sex, sexual orientation, national origin discrimination – any kind of discrimination,” she said. But in the fallout of Friday’s decision, LGBTQ advocates and experts cautioned that, far from settling the issue at the center of the case, the ruling will likely embolden opponents of LGBTQ rights and spur a fresh wave of litigation that could strip away civil rights protections in other areas of life.

Elizabeth Holmes won't be able to afford $250 a month restitution payments when she's released from a Texas prison, her attorneys argued. It's common for funds like these to never fully be paid out, experts previously told Insider.
