A judge ordered jurors Friday to keep deliberating after they said they were deadlocked in the trial of Daniel Penny, the man accused of manslaughter in the May 2023 chokehold death of Jordan Neely. The jury said it could not come to a unanimous decision on the top charge of manslaughter. Outside the presence of the jury, Thomas Kenniff, one of Penny’s attorneys, asked that the judge declare a mistrial. “The jury has been deliberating for roughly 20 hours over four days in what is, in many ways, a factually uncomplicated case,” Kenniff told the judge. Dafna Yoran, an assistant prosecutor with the Manhattan District Attorney’s Office, disagreed and asked Wiley to give the jurors the Allen charge.

AdvertisementVaynerchuk, also known as Gary Vee, has built a legion of fans, many of whom are young men, by evangelizing hard work. His schtick lands with a generation that's grown up with — and is now exhausted by — social media, which encourages constant comparisons with others. Advertisement"In the beginning, it was, 'That's dumb, that's dumb,'" Jon Halvorson, SVP of Mondelez and a longtime client, said of Vaynerchuk's rhetoric. CMOs no longer have to be convinced to embrace social media, and many have even bypassed agencies like VaynerX altogether to take that work in-house. Naysayers say his personal brand is still bigger than his company; Vaynerchuk has 22 times as many followers on X as VaynerMedia.

Democratic Sen. John Fetterman said Thursday that the federal cases against President Joe Biden’s son Hunter Biden and the New York hush money case against President-elect Donald Trump were both “politically motivated” and deserving of pardons. Fetterman told a small group of reporters in the Capitol that the tax and gun cases against Hunter Biden were “politically motivated” and “weaponized for political gain,” comparing them to Manhattan District Attorney Alvin Bragg’s case against Trump. “The same thing was done with Trump with the New York case. Fetterman didn’t directly answer when asked if he’s calling on Biden to pardon Trump. Fetterman echoed Biden’s sentiment that “raw politics has infected this process and it led to a miscarriage of justice,” which the president wrote in his official statement announcing Hunter Biden’s pardon on Sunday.

The appeals court had been set to hear arguments on Willis's disqualification this week but abruptly canceled the hearing without explanation last month. In their filing, Trump lawyers Steven Sadow, Jennifer Little and Matthew Winchester contended Trump's election win is grounds to throw the case out altogether. The Justice Department relied on that memo in deciding to dismiss two federal criminal cases against Trump last month, but the Georgia case is a state case, not a federal case. The appeals court "should dismiss his appeal for lack of jurisdiction with directions to the trial court to immediately dismiss the indictment against President Trump," the filing said. The Georgia case was one of what was once four criminal cases against Trump.

Another Trump defense attorney made a similar argument Tuesday in asking a New York state court judge to dismiss the criminal hush money case against him there. Sadow argued that Georgia courts lost jurisdiction over the case because Trump won the 2024 election. President-elect Donald Trump asked the Georgia Court of Appeals on Wednesday to effectively end the criminal case related to his effort to overturn his defeat in the state's 2020 presidential election . Although Trump will not be sworn in until Jan. 20, the appeals court should "inquire into its jurisdiction" to continue hearing the appeal "well before the inauguration," Sadow wrote. Smith's move left just two criminal cases pending against Trump: in Fulton County, Georgia, and Manhattan Supreme Court.

Before you blow your nose like a foghorn, know that nose blowing is helpful when done correctly. “It’s pretty rare to blow your eardrums from nose blowing,” Kelley said. While blood vessels are all around the nose, the ones in the front of the nose can easily burst from the pressure of nose blowing. Rest assured, Filip said these are exceedingly rare cases of forceful nose blowing, and people were able to recover once they stopped blowing their noses. HeadachesFilip said experts are still divided on whether forceful nose blowing causes headaches because people with runny noses usually have a flu or cold that would induce migraine symptoms.

Large drones have been hovering in formation over northern New Jersey, officials said Monday, leading to "unnerved" residents wondering what's behind these bright, unidentified flying objects appearing almost every night in the sky. The FBI and Morris County Sheriff's Department are actively investigating the aerial phenomenon, which has been an annoyance but not yet any kind of safety threat, authorities said. Morris County resident Julie Shavalier said the mysterious night shows have been keeping her up. "We're all completely unnerved," Shavalier told NBC News on Tuesday. The sweeping pardon means Hunter Biden won’t face any punishment for criminal convictions in two separate cases, one involving gun charges, the other tax evasion. “They took a gamble that didn’t play out as they hoped,” former Justice Department spokesman Anthony Coley said. If he follows through, Trump may try to blunt the fallout by invoking the Biden pardon. “Joe Biden's pardon of Hunter Biden proves President Trump's signature campaign promise to end the weaponization of our justice system needs to happen,” she said, adding: “President Trump has made that promise. A judge has already ruled there is no merit to the idea that Hunter Biden is a victim of selective prosecution.

Opinion | Can Rahm Emanuel Flip the Script Again?
  + stars: | 2024-12-03 | by ( Bret Stephens | ) www.nytimes.com   time to read: +1 min
There’s a buzz around Rahm Emanuel — the former Bill Clinton adviser, former Illinois congressman, former chief of staff to President Barack Obama, former mayor of Chicago — possibly becoming the next head of the Democratic National Committee. “What started as two wars in two theaters is now one war in two separate theaters,” he says of the conflicts in Ukraine and the Middle East. “We need to ensure that it does not expand into a third theater.”How soon might that happen? I mention 2027, a year that’s often seen as China’s target date for reunification with Taiwan, if necessary by force. Unlike with Taipei, to which America’s obligations are deliberately ambiguous, with Manila and Seoul our defense commitments are ironclad.

As the summer of 2023 ended, the justices of the U.S. Supreme Court began trading even-more-confidential-than-usual memos, avoiding their standard email list and instead passing paper documents in envelopes to each chambers. Faced with ethics controversies and a plunge in public trust, they were debating rules for their own conduct, according to people familiar with the process. But a New York Times examination found that behind the scenes, the court had divided over whether the justices’ new rules could — or should — ever be enforced. Justice Gorsuch was especially vocal in opposing any enforcement mechanism beyond voluntary compliance, arguing that additional measures could undermine the court. The justices’ strength was their independence, he said, and he vowed to have no part in diminishing it.

AdvertisementNew York City is on the verge of legalizing accessory dwelling units in much of the city. The effort is part of the mayor's "City of Yes" housing plan, designed to boost the supply of homes. More than a dozen states across the country have legalized ADUs in recent years, and New York State greenlit the secondary units in 2022, although New York City has restricted them. Last year, New York City rolled out a pilot program that awarded 15 homeowners with up to nearly $400,000 in funding per household to build an extra dwelling in their backyard, basement, or attic. Another Republican council member opposed to City of Yes derided ADUs as backyard "treehouses" that would depress home values.
