There may be a path for Smith to revive the case, Cannon noted in her ruling, and Smith can appeal the decision. Cannon left open a potential pathway in her ruling for the classified documents case to be revived. (He is being prosecuted by a separate special counsel, David Weiss.) And during the Trump-Russia investigation, multiple Trump allies similarly attempted to derail special counsel Robert Mueller’s work. Former Attorney General Edwin Meese and Citizens United argued the same, writing that Smith’s appointment “severely undermines” the constitutional order.

CNN —Donald Trump urged the judge in his New York hush money case to dismiss his conviction in light of the Supreme Court’s ruling on presidential immunity last month, according to a new court filing. “In order to vindicate the Presidential immunity doctrine, and protect the interests implicated by its underpinnings, the jury’s verdicts must be vacated and the Indictment dismissed,” Trump’s attorneys wrote to Judge Juan Merchan. “Much of the unconstitutional official-acts evidence concerned actions taken pursuant to ‘core’ Executive power for which ‘absolute’ immunity applies.”The district attorney’s office declined to comment for this story. The district attorney’s office will respond later this month, and Merchan said he will decide the matter in September, with a potential sentencing scheduled on September 18, if necessary. Trump’s sentencing would be postponed until September 18, Merchan wrote – “if such is still necessary.”The district attorney’s reply to Trump is due on July 24.

CNN —Attorneys for former President Donald Trump are now seeking to use the Supreme Court’s presidential immunity decision to help him in his criminal case in Florida over the mishandling of classified documents. In a new court filing Friday, Trump’s team said they want an updated schedule in the federal classified documents case so they can argue points related to the Supreme Court decision. The decision “guts the Office’s position that President Trump has ‘no immunity’ and further demonstrates the politically-motivated nature of their contention that the motion is ‘frivolous,’” Trump’s attorneys wrote. The Supreme Court’s decision directly applies to the federal case over 2020 election subversion efforts in Washington, DC, but it could impact all four of the criminal cases against the former president. Trump’s attorneys argue the concurrence “adds force” to motions Trump has filed against how Smith was appointed and funded.

CNN —Donald Trump will not be sentenced on his business fraud conviction until September, a New York judge ruled Tuesday in the wake of Monday’s Supreme Court decision on presidential immunity. The ruling could impact the indictments of Trump in the classified documents and Georgia election interference cases as well. Trump’s legal team filed a letter Monday seeking to challenge the former president’s conviction after the Supreme Court ruled that presidents have an absolute immunity from prosecution for core official acts. Will Scharf, an attorney who represents Trump in the immunity case, told CNN Monday night the high court’s ruling “absolutely” impacts the hush money case. Special Counsel Jack Smith delivers remarks on a recently unsealed indictment including four felony counts against former President Donald Trump on August 1, 2023 in Washington, DC. Drew Angerer/Getty ImagesAttorneys for Donald Trump will continue their legal efforts to throw off special counsel Jack Smith and the classified documents case against the former president in Florida on Monday. Trump’s attorneys will battle prosecutors in court on the second part of Trump’s argument that Smith’s appointment was illegitimate, focusing on how he’s being funded. On Friday, prosecutors, defense attorneys and third parties fought over whether Smith was legitimately appointed as special counsel, an argument district Judge Aileen Cannon seemed skeptical of during the hearing. “President Biden’s DOJ is paying for this politically motivated prosecution of Biden’s chief political rival ‘off the books,’ without accountability or authorization,” Trump’s attorneys argued in their filing earlier this year.

CNN —Lawyers for Donald Trump asked the New York judge who ordered the former president to pay nearly half a billion dollars to recuse himself from the case alleging the judge engaged in “prohibited communications” with a real estate lawyer about the case before issuing his decision. Trump’s attorneys said if Judge Arthur Engoron would not recuse from the case they are seeking an evidentiary hearing to delve into the judge’s reported conversation with New York real estate lawyer Adam Bailey. The judge is still overseeing a monitor who he put in place to oversee the Trump Organization’s finances. The NBC article was published in May, months after Engoron issued his $454 million judgement against Trump in February. Bailey told NBC he spoke with Engoron before the judge issued his decision in the case.

CNN —Donald Trump’s attorneys on Friday ridiculed special counsel Jack Smith’s gag order request in the former president’s classified documents case in Florida, calling it an unconstitutional attack on the 2024 Republican candidate and a ploy to help Joe Biden keep the presidency. “In Jack Smith’s most recent shocking display of overreach and disregard for the Constitution, the Special Counsel’s Office asks the Court to enter an unconstitutional gag order as one of the release conditions on the leading candidate in the 2024 presidential election,” Trump’s attorneys wrote in a new filing, repeating their previous arguments against gag orders. The former president was in New York at the time. Prosecutors’ original ask for a gag order was thrown out by Federal Judge Aileen Cannon, who determined that they had not fully conferred with Trump’s attorneys before filing the request. Trump’s false claims “invite” threats and harassment against law enforcement agents involved in the case, prosecutors wrote, similar to those “that have occurred when other participants in legal proceedings against Trump have been targeted by his invective.”

CNN —House Speaker Mike Johnson is not waiting for ex-President Donald Trump to be judged by a jury of his peers. Vance, a possible VP contender, was there along with Alabama Sen. Tommy Tuberville, a famed former college football coach. The speaker’s appearance is different, given the constitutional heft of his office and the figurative connotations it evokes. Some experts have questioned whether any other defendant besides Trump would face the same indictment at the hands of a prosecutor, Manhattan District Attorney Alvin Bragg, a Democrat. Trump is exercising his right to mount a defense and is considered innocent until proven guilty.

CNN —Former President Donald Trump could owe more than $100 million in taxes as a result of a yearslong Internal Revenue Service inquiry into claims of huge losses on his Chicago skyscraper, The New York Times and ProPublica reported Saturday. The 2008 claim resulted in Trump reporting losses as high as $651 million for the year, and there is no indication it drew an IRS challenge, the outlets reported. Then, Trump’s lawyers enabled further claims of losses in 2010 by shifting the Chicago tower into another partnership, “DJT Holdings LLC,” The Times and ProPublica reported. The outlets calculated the revision sought by the IRS could result in a tax bill of more than $100 million. “This matter was settled years ago, only to be brought back to life once my father ran for office.

Before summoning the jury on Monday, Justice Juan Merchan directly addressed the defendant, whom he called “Mr.” and not President Trump. In a measured and by-the-book tone that showed no hint of his exasperation, Merchan told Donald Trump that he had now found him in contempt of court on a 10th charge. Each carries a $1,000 fine, the most allowed by New York State law. “The magnitude of that decision is not lost on me,” Merchan said. “But at the end of the day, I have a job to do.” Trump’s offenses, he noted calmly, represented “a direct attack on the rule of law, and I cannot allow that to continue.”

“Will Joe Biden Debate? He eagerly attended almost all of the Republican primary debates and all of the general election debates in 2016. About two years ago, the Republican National Committee voted unanimously to withdraw from its participation in the nonpartisan Commission on Presidential Debates, the organization governing general-election presidential debates, citing bias. It’s not clear to the Biden campaign what, if anything, changed since the Republican Party pulled out of the commission. Campaign officials are fully aware the Trump trial could dominate news coverage in the weeks to come. In a video earlier this month, Trump announced his campaign position on abortion, including his personal thanks – one-by-one – to the Supreme Court justices who had voted against the 1973 Roe v. Wade milestone. Lower court judges ruled against Trump, saying whatever immunity he might have enjoyed as president ended when he left office. CNN —Lawyers for former President Donald Trump said his $175 million bond posted to satisfy the judgement in the New York civil fraud case is financially sound, and they asked the judge to set aside the attorney general’s challenge to the bond and award him costs and fees. In court filings Monday night, Trump said the bond secured by Knight Specialty Insurance Company is backed by Trump’s Charles Schwab account with more than $175 million in cash. “KSIC also has a standing agreement with its parent company, Knight Insurance Company, Ltd. (‘KIC’), by which KIC reinsures 100% of KSIC’s risk,” the affirmation said. “The $175 million bond at issue is adequately secured.”Earlier this month, the attorney general’s office challenged the financial ability of the underwriter to be able to stand in for the bond. The attorney general’s office questioned whether Knight Specialty was authorized to underwrite a surety bond in New York state and whether it lacked a certificate from the state regulator saying it is qualified.

The judge ruled that Trump’s “dangerous rhetoric” threatens the integrity of the looming trial, which is scheduled to begin April 15. Here are the facts about Trump’s recent attacks against Merchan’s daughter, and how this sideshow could affect the first-ever criminal trial of a former American president. He deployed this same tactic in the New York case, but went even farther by targeting Merchan’s adult daughter, Loren Merchan. He used the image to argue that Loren Merchan and her father are biased against him. “The X, formerly Twitter, account being attributed to Judge Merchan’s daughter no longer belongs to her since she deleted it approximately a year ago,” court spokesman Al Baker said last week.

In an unusual order last month, Cannon asked attorneys on the classified documents case to submit briefs on potential jury instructions defining terms of the Espionage Act, under which Trump is charged over mishandling 32 classified records. Specifically, Cannon asked the special counsel and defense attorneys to write two versions of proposed jury instructions. Trump’s attorneys claim he did have that authority and have asked the judge to throw out the criminal charges. “Medical science has not yet devised an instrument which can record what was in one’s mind in the distant past,” Trump’s attorneys wrote. Cannon appeared skeptical that the charges should be outright dismissed during the hearing, but she said that Trump’s attorneys were making “forceful” arguments that may be appropriate to present to a trial jury.

CNN —Attorneys for Donald Trump want to delay the start of his upcoming New York criminal trial until the US Supreme Court weighs in on presidential immunity, according to a new motion – a ruling that may not come until late June. But Trump wants to wait until after the Supreme Court rules on immunity. Trump’s lawyers also requested that Merchan hold an evidentiary hearing after the US Supreme Court rules on the presidential immunity issue to then determine what evidence of Trump’s “official acts” should be precluded based on presidential immunity. “While the concept of presidential immunity is firmly established, the doctrine’s scope presents a ‘serious and unsettled question of law.’ Therefore, the Court should adjourn the trial until the Supreme Court resolves Trump v. United States for several reasons,” Trump’s motion says. “Waiting to try the case until after the Supreme Court addresses the question before it – following oral argument just next month – will likely simplify the application of the defense to evidentiary issues raised by the People’s motions in limine.”

CNN —Donald Trump’s attorneys accused Manhattan District Attorney Alvin Bragg of a pursuing a “fantasy” case against the former president by tying hush-money payments made to his former attorney Michael Cohen with the 2016 election. Both Trump’s lawyers and the district attorney’s office have urged the judge to exclude testimony and arguments from the other side. “The case the People charged is a lawless 34-count indictment relating to record entries reflecting monthly retainer payments President Trump made to his personal attorney Michael Cohen in 2017,” Trump’s attorneys wrote. “The People’s motions in limine, on the other hand, describe a fantasy: an uncharged ‘underlying conspiracy’ to ‘influence the 2016 election’ that the District Attorney wishes President Trump had not won. Washington CNN —Former President Donald Trump has appealed an Illinois judge’s decision that disqualified him from the state’s upcoming Republican primary ballot. The surprise court ruling this week throws into question whether votes cast for Trump will be counted. Porter issued her decision Wednesday night and paused the decision for two days, so Trump could appeal. Trump’s lawyers asked her on Thursday to extend the pause until all of their potential appeals are exhausted in Illinois courts. The justices seemed likely to reverse that decision, teeing up a conflict with the Illinois ruling.

CNN —Former President Donald Trump asked a New York appeals court on Wednesday to delay his obligation to post $454 million until his appeal of the civil fraud verdict is over. “The judgment order unprecedented and punitive disgorgement of nearly $460 million and overbroad permanent injunctive relief against Appellants in the absence of legal authority or factual support,” Trump’s attorneys wrote in the filing. Trump has less than 30 days to post the money to prevent the New York attorney general’s office from taking steps to execute the judgment, including potentially move to seize properties. The judge also ordered that an independent monitor, who has been in place at the Trump Organization since 2022, continue in the position for an additional three years. “Meaning, ice her,” said a person familiar with Trump’s trial schedule strategy. That would create a hole in Trump’s court schedule after the New York trial that no other case is positioned to fill. The special counsel’s office has repeatedly argued that the public, too, deserves to have Trump’s federal election case before a jury quickly, potentially even before the next presidential election. While Trump couldn’t be on trial simultaneously in two different courts, judges could have overlapping schedules initially because trial dates can often move.
