Trials for Class E felonies, which include the charges of falsifying business records that Trump faces, get the fewest number of challenges. Trump's complaint on Truth Social demonstrates "his willful ignorance of the law," said Jeremy Saland, another New York criminal defense attorney. CNN —If Donald Trump opts to testify at his New York criminal trial, Manhattan prosecutors want to use his past legal run-ins to discredit him to the jury. Prosecutors say they’ll want to question him about what they claim is false testimony he gave on the stand at that trial last November. The judge plans to hold a proceeding called a Sandoval hearing to rule on what’s fair fodder for prosecutors if Trump takes the stand in his defense later at trial. A Sandoval hearing is a common preliminary proceeding that reviews a defendant’s criminal history and looks at how much prosecutors can ask if a defendant testifies. “If for some reason we are fortunate and get done early on Friday, we will take up Sandoval at that time,” Merchan said.

Trump only spoke three times during Monday’s session, acknowledging to the judge he understood his rights as a criminal defendant. Throughout the day Trump often engaged with his attorneys, whispering to them and sharing notes as they debated motions with the Manhattan District Attorney’s Office. Trump looked toward Merchan as the judge addressed the prospective jurors to explain the case and their instructions as potential jurors. Entering and exiting the courtroom, Trump had to walk right past Manhattan District Attorney Alvin Bragg, who brought this case against Trump and was seated in the fourth row behind his prosecutors. Trump will be back at the defendant’s table on Tuesday, when Merchan will continue questioning the prospective jurors who could ultimately decide whether to convict Trump in the first criminal trial of a former president.
