Donald Trump complained Wednesday that his lawyers were not given "unlimited" chances to reject prospective jurors at his New York criminal hush money trial. Trump suggested that New York City, which leans heavily Democratic, is only better than Washington, D.C. Trump also faces criminal election interference charges in federal court in Washington. Trials for Class E felonies, which include the charges of falsifying business records that Trump faces, get the fewest number of challenges. Trump's complaint on Truth Social demonstrates "his willful ignorance of the law," said Jeremy Saland, another New York criminal defense attorney. Trump's lawyers and prosecutors can make an unlimited number of requests to Judge Juan Merchan to strike a potential juror for cause.

CNN —If Donald Trump opts to testify at his New York criminal trial, Manhattan prosecutors want to use his past legal run-ins to discredit him to the jury. Prosecutors say they’ll want to question him about what they claim is false testimony he gave on the stand at that trial last November. The judge plans to hold a proceeding called a Sandoval hearing to rule on what’s fair fodder for prosecutors if Trump takes the stand in his defense later at trial. A Sandoval hearing is a common preliminary proceeding that reviews a defendant’s criminal history and looks at how much prosecutors can ask if a defendant testifies. “If for some reason we are fortunate and get done early on Friday, we will take up Sandoval at that time,” Merchan said.

Xavi was shown a red card in the second half. “The red card marked the tie. For as much as we speak [about the match], the red card marks everything. PSG manager Luis Enrique, who enjoyed two trophy-filled spells at Barcelona as a player and manager, said he thought his team would have won even without Araújo’s sending off. She was the first of the prospective jurors who were challenged by Trump's defense team on Tuesday over their "anti-Trump" social media. AdvertisementThe prospective juror, identified only as "B-133," had clearly "attended an "anti-Trump rally," defense lawyer Susan Necheles protested. When it was released in 2016, the clip was shared on the Facebook account of the husband of prospective juror B-330. "I would have to say that politically, yes, I do," the prospective juror answered. "Boys request to return to cave"The final prospective juror questioned on their social media posts was a retired grandmother from Manhattan's Lower East Side.

We should call it an “election interference” trial going forward. Assistant District Attorney Joshua Steinglass skillfully advanced the election interference theory by structuring his evidentiary points in chronological order within that frame. Trump’s alleged 2020 attempt to overthrow our government distorts perceptions of how serious the charges related to the 2016 election are. How can we call this an election interference trial, they ask, if the election was already over when the 34 alleged document falsification crimes occurred? It is an election interference one and we should say so.

Merchan didn't hit Blanche as hard as a federal judge in Manhattan has hit Trump lawyer Alina Habba for her lawyering. During the E. Jean Carroll defamation trial in January, Judge Lewis Kaplan bench-slapped Habba 14 times during a single day of testimony. "Please direct me to the portion of the original gag order, or the subsequent gag order, where it makes any exception if Mr. Trump feels he is under attack. The judge told Blanche to file a response, in writing, explaining why Trump should not be held in contempt for violating the gag order. The judge paused, then added, with some sarcasm, "I don't recall inserting that anywhere in either gag order."

First, the conventions of the criminal trial – like those in thousands of courtrooms every day – mean this case will grind on relentlessly. In previous civil trials, Trump challenged the dignity of the rule of the court and feuded with other judges. But potential jurors appeared to take their obligation deeply seriously. But other potential jurors said they’d be able to put any political feelings about Trump to one side and focus on the evidence and the law. And in another revealing trend that hinted at the ex-president’s political appeal, some potential jurors mentioned that they viewed his rhetorical eruptions as those of someone who speaks his mind, unlike conventional politicians.

Former U.S. President Donald Trump speaks to the press after the first day of his trial for allegedly covering up hush money payments linked to extramarital affairs, at Manhattan Criminal Court in New York City, U.S. on April 15, 2024. Jury selection in the New York criminal hush money trial of former President Donald Trump is set to continue Tuesday, after the first day ended without anyone on the 12-person panel being seated. Monday's session in Manhattan Supreme Court revealed some of the many challenges of prosecuting Trump, the highly polarizing presumptive Republican presidential nominee. Of the first 96 potential jurors brought in for the proceeding, more than half were excused after saying that they could not be fair or impartial to Trump. Trump then griped outside of court after the session that Merchan was preventing him from attending Barron Trump's graduation.

Depending on their politics, media diets and views on Donald J. Trump, any one could join the group of 12 citizens who will sit in judgment of him. Not until midafternoon Tuesday did Mr. Trump’s lawyers and prosecutors select the first six jurors for the case, which centers on allegations that the former president falsified documents to cover up a sex scandal involving a porn star. Dozens were dismissed after saying they could not be fair, underscoring the towering task of trying a former president in a city where he is deeply unpopular. The lawyers reached the heart of the selection process early in the afternoon, when they began bringing individual people from the jury pool back into the courtroom to question them alone as they debated who should be dismissed. But that process was quickly interrupted when the judge, Juan M. Merchan, scolded Mr. Trump for muttering and gesturing while one of the potential jurors was being interviewed.

That process prompted Judge Juan Merchan to sternly admonish Trump for his conduct toward the first juror questioned about her social media. That gave Trump’s team the chance to mine their public social media postings to be ready for their challenges to the judge. As for the three jurors Merchan did not strike: Trump’s side used its preemptory challenges to remove all of them anyway. The juror was later struck for cause by the judge on a challenge from Trump’s team over his social media posts. But the judge is hoping to wrap up jury selection this week.

Six alternates will also hear the case in case a juror on the main panel needs to be replaced.

New York Supreme Court Judge Juan Merchan is a seasoned jurist who is no stranger to Trump’s orbit. In the lead-up to the start of the trial, Trump fanned the flames on social media with his views on the judge. “Judge Merchan was always well-prepared, accessible, and – most importantly in the Weisselberg matter – a man of his word. Trump also claimed Judge Merchan has ruled against him in pretrial motions “because his daughter makes money by working to ‘Get Trump.’”Loren Merchan has not commented publicly on the case. David Paterson appointed him to the New York State Court of Claims in 2009, the same year he began serving as an acting New York Supreme Court judge.

Of the first group of 96 potential jurors who crammed into the courtroom, more than half were immediately excused for saying they could not be fair and impartial. A Manhattan jury also found Trump’s business, the Trump Organization, guilty of tax evasion, although Trump was not personally named in that case. And here is an excellent visual timeline of the entire hush money scandal. It was Cohen who orchestrated the hush money payments and who pleaded guilty to federal charges of violating campaign finance law, for which he served time in prison. Trump is accused by New York of falsifying business records when he paid Cohen back for the hush money scheme.

“I’ve done a lot of cases that are considered no-win,” Bragg told CNN at the time, in December 2021. Though Bragg’s ambitions are widely considered to be less lofty than some of his predecessors, the Trump trial will likely write both his political future and legacy. Two months into office, Bragg was confronted by two senior attorneys leading the Trump investigation. When Bragg refused to authorize them to seek an indictment they abruptly and noisily resigned, putting additional pressure on the new district attorney. Trump eventually paid $2 million of his own money to a group of charities, and the foundation was dissolved.

Trump only spoke three times during Monday’s session, acknowledging to the judge he understood his rights as a criminal defendant. Throughout the day Trump often engaged with his attorneys, whispering to them and sharing notes as they debated motions with the Manhattan District Attorney’s Office. Trump looked toward Merchan as the judge addressed the prospective jurors to explain the case and their instructions as potential jurors. Entering and exiting the courtroom, Trump had to walk right past Manhattan District Attorney Alvin Bragg, who brought this case against Trump and was seated in the fourth row behind his prosecutors. Trump will be back at the defendant’s table on Tuesday, when Merchan will continue questioning the prospective jurors who could ultimately decide whether to convict Trump in the first criminal trial of a former president.

The criminal trial of Donald J. Trump, the nation’s 45th president and the Republican Party’s presumptive nominee, started Monday with potential jurors assembling in a drab courtroom in New York City while Mr. Trump looked on. Mr. Trump denies that encounter happened, and has declared his innocence, calling the charges politically motivated. He has attacked the judge, Juan M. Merchan, and the Manhattan district attorney, Alvin L. Bragg, a Democrat, who also attended the first day of trial on Monday. Mr. Trump faces 34 felony counts and could face probation or up to four years of prison time. The trial, which is expected to last weeks, has a fascinating list of potential witnesses: Michael Cohen, Mr. Trump’s former fixer turned apostate, who made the payment; Karen McDougal, a Playboy model who says she, too, had an affair with Mr. Trump; and Hope Hicks, a former aide to Mr. Trump.
