Some officials’ social media accounts have become vital forums for speech relating to those officials’ exercise of government power, and for speech about public policy more broadly. Those two lawsuits are about government officials’ use of social media. Two of the cases concern the constitutionality of social media laws enacted by Florida and Texas. Both states’ laws also require the platforms to provide explanations to users whose posts the platforms take down. A threshold question the court will have to answer is whether platforms’ content moderation policies reflect the exercise of editorial judgment, since editorial judgment is protected by the First Amendment.

In a 2003 essay, Johnson defended laws that criminalized homosexual activity between consenting adults. If Johnson is known for anything, however, it is for his tireless advocacy on behalf of Donald Trump’s attempt to overturn the 2020 presidential election. Johnson wrote one of the briefs purporting to give a legal justification for throwing out the voting results in several swing states. The new speaker is, in short, an election-denying extremist who believes that his allies have the right to nullify election results so that they can impose their vision of government and society on an unwilling public.

ORLANDO, Fla. (AP) — The state of Florida is asking the U.S. Supreme Court to block lower court rulings that prohibit the enforcement of a new law targeting drag shows. Florida officials filed an application with the nation's highest court on Friday asking that the prohibition against enforcing the anti-drag show law only be limited to the Orlando, Florida, restaurant which challenged its constitutionality. Circuit Court of Appeals upheld a lower court’s granting of a preliminary injunction stopping the law from being enforced. The appeals court panel ruled against a request from Florida officials to limit the injunction to the Hamburger Mary's restaurant, saying that Florida officials hadn’t shown that the lower court erred by prohibiting the universal enforcement of the law. Spirit Airlines canceled about 100 flights on Friday after pulling some planes out of service for inspections, and the airline expects the disruptions to last several days. “We’ve cancelled a portion of our scheduled flights to perform a necessary inspection of a small section of 25 of our aircraft,” Spirit said in a statement. About half of the Spirit cancellations were at Florida’s Orlando International Airport, where Spirit is the second-largest carrier. Spirit, which is based in Miramar, Florida, has canceled more than 3,600 flights this year, or 1.5% of its schedule. That is lower than the 2% cancellation rate at Frontier Airlines, a similar budget carrier, and rates for JetBlue Airways and United Airlines.

But whether or not the House Republican majority elects a new speaker anytime soon is irrelevant. Much of the recent discussion over House Republican divisions tries to frame it along the right-left ideological spectrum. Those who voted against McCarthy are more conservative, on average, than the GOP at large – and this is a very conservative House majority. Are people willing to line up behind the compromises House GOP leaders have made with Democrats to keep the government going? It’s no surprise then that we’re dealing with a House GOP leadership fight that seems more fitting of an Aaron Sorkin script than the real world.
