What Does It Mean to Be an Asian American Brewer?
  + stars: | 2023-06-23 | by ( T.M. Brown | ) www.nytimes.com   time to read: +1 min
In 1994, Leah Wong Ashburn’s father, Oscar, did something very few, if any, Chinese Americans had tried before: He opened a craft brewery. Mr. Wong, who immigrated to the United States from Jamaica in the 1960s, had retired to Asheville, N.C., after a long and successful career running an engineering firm. Beer wasn’t on his mind until a friend and local brewer proposed starting their own operation — the city’s first since Prohibition. “There weren’t very many of us around back then.”Though demographics in the craft beer industry have slowly shifted since Highland opened its doors nearly 30 years ago, it is still a world dominated by white owners. According to data from the Brewers Association, only 2 percent of breweries in the United States are owned by Asian Americans like the Wongs.

The injunction was expected after Hinkle on June 6 partially blocked Florida from enforcing its recent ban on people under 18 receiving gender-affirming care such as puberty blockers and hormone therapy. U.S. district court judges elsewhere have blocked state laws banning gender-affirming care in Alabama, Arkansas, Indiana and Oklahoma. The plaintiffs were two transgender adults, August Dekker and Brit Rothstein, and two transgender minors who filed under pseudonyms. The defendants were the Florida Agency for Health Care Administration (AHCA) and its secretary, Jason Weida, who did not respond to an after-hours request for comment. The AHCA "retained only consultants known in advance for their staunch opposition to gender-affirming care," the judge found.

Blinken met on Monday, the second day of his visit, with Chinese President Xi Jinping. Western powers have provided Ukraine with billions of dollars in military assistance since Russia invaded in February 2022. China and Russia announced a "no-limits" partnership shortly before Russia invaded Ukraine. "With regard to lethal aid to Russia for use in Ukraine, we and other countries have received assurances from China that it is not and will not provide lethal assistance to Russia for use in Ukraine," Blinken said. "We oppose the unfair prohibition or restriction on normal economic and trade activities between Chinese and foreign companies.

The figure is up 0.7% from 108,825 overdoses recorded in the 12-month period ending January 2022, according to U.S. data. The U.S. drug overdose death toll crossed the 100,000-mark for the first time in 2021, as the COVID pandemic disrupted medical care and increased mental health problems. U.S. drug overdose deaths rose 13.7% between January 2021 and January 2022 and by 31.4% in the prior 12 months at the height of the pandemic. But the surge in overdose deaths began before the pandemic took hold due to abuse of prescription opioid painkillers and illegal drugs like heroin.

WASHINGTON, June 13 (Reuters) - White House press secretary Karine Jean-Pierre said on Tuesday that White House lawyers would review a ruling from a government agency that said she had violated a law limiting political activity by federal employees. The Office of Special Counsel on Monday announced that Jean-Pierre had violating the Hatch Act by referring to "mega MAGA Republicans" in talking to reporters last year. Asked at her daily briefing on Tuesday about the ruling, Jean-Pierre said she had used language given to her by White House officials. She said the previous Donald Trump administration had frequently referred to "MAGA Republicans." Jean-Pierre said White House lawyers would be in touch with the Office of Special Counsel to review the ruling.

Apple’s proposal would have downloaded onto every device a secret list of IDs corresponding to known exploitation images. It would then use an algorithm to determine whether any photos on the device were similar to those on the list. Like all matching algorithms, Apple’s system makes educated guesses based on statistical probabilities, but those guesses could be wrong. The second, and greater, problem was that scanning for one type of content opens the doors for scanning for other types of content. Miami CNN —Former President Donald Trump pleaded not guilty to 37 charges Tuesday in a brief but historic court appearance following his arrest and processing on federal charges. Trump is the first former president to face federal charges following last week’s indictment by special counsel Jack Smith. It underscored the fact that Trump’s legal turmoil is playing out amid a 2024 Republican primary where Trump’s legal troubles have been a central storyline, both for his campaign and his presidential rivals. We love the people, and you see where they are,” Trump said when asked how his court appearance went. Goodman concluded Tuesday’s hearing acknowledging his limited role in the Trump case.

Todd Blanche, Trump’s attorney, resisted the idea of barring all contact with the case’s witnesses, in a back-and-forth with the judge that played out over several rounds. “Many of the people, including the men and women to protect him, may be witnesses in this case,” Blanche said. If the Trump team found the list “inappropriate,” “excessive,” “unwieldly,” or otherwise problematic, they could file a motion with the court, Goodman said. Trump looked through the bond package, a packet of paper, and then gave it Blanche to look through. However, his bond package was discussed and approved, and handed to the table for him to sign.

There's no publicly known evidence of the Chinese government requesting data from TikTok, or TikTok providing it. The state's governor, Greg Gianforte, signed a bill last month that will prohibit Google and Apple's app stores from offering the TikTok app, starting in January 2024. A federal judge in Florida issued a scathing assessment on Tuesday of the state’s ban on gender transition care for minors, asserting in a ruling that the families with transgender children who sued the state are “likely to prevail on their claim that the prohibition is unconstitutional.”Judge Robert L. Hinkle of Federal District Court in Tallahassee ruled specifically that three transgender children can be prescribed puberty blockers despite the new state law, which also adds new hurdles for adults who seek similar care. But as legal challenges have been mounted to new restrictions on transition care that have been enacted across the country, Judge Hinkle’s ruling exemplifies the kind of chilly reception that the bans may receive from judges. “Gender identity is real,” Judge Hinkle wrote, adding that “proper treatment” can include mental health therapy followed by puberty blockers and hormone treatments. “Florida has adopted a statute and rules that prohibit these treatments even when medically appropriate.”

REUTERS/Cheney OrrJune 6 (Reuters) - The U.S. government cannot ban people convicted of non-violent crimes from possessing guns, a federal appeals court ruled on Tuesday. Circuit Court of Appeals is the latest defeat for gun control laws in the wake of a U.S. Supreme Court ruling last year expanding gun rights nationwide. The decision stems from a 2020 lawsuit by a Pennsylvania man, Bryan Range, who was barred under federal law from possessing a gun after pleading guilty to welfare fraud. The Bureau of Alcohol, Tobacco, Firearms and Explosives, which enforces federal gun laws, declined to comment. Federal criminal law generally bars people convicted of crimes punishable by more than a year in prison from possessing guns.

A crude joke that Sen. Marco Rubio, R-Fla., used to mock what he said was then-2016 presidential candidate Donald Trump's "small hands" will be the centerpiece of a Supreme Court ruling on whether a California lawyer can trademark the phrase "Trump too small." The "Trump too small" phrase is a reference to a 2016 Republican presidential primary debate featuring both Trump and Rubio. Rubio joked about Trump having small hands, adding: "And you know what they say about guys with small hands." In a February 2022 ruling, the U.S. Court of Appeals for the Federal Circuit ruled against the trademark office, saying the denial violated Elster's free speech rights under the Constitution's First Amendment. The Supreme Court in recent years has endorsed free speech rights in the trademark context, suggesting Elster could have a chance of prevailing in the case.

But in the last few years, increasing pay transparency has become a common cause for young workers, anti-discrimination advocates, and, increasingly, state legislators. But employers in states with transparency laws make up for it by imposing informal rules that prevent employees from talking about pay. If the "new norm" of salary transparency had supplanted the old taboo, then we'd expect a large majority to chafe under outdated restrictions against discussing pay. Strong support for managers in general appears to translate into strong support for managerial approaches to pay secrecy or transparency. If salary transparency is actually going to become the "new norm," it will clearly require more than our existing set of state laws.
A group of Chinese citizens living and working in Florida sued the state Monday over a new law that bans Chinese nationals from purchasing property in large swaths of the state. The suit says the law unfairly equates Chinese people with the actions of their government and there is no evidence of national security risk from Chinese citizens buying Florida property. The number of states restricting foreign ownership of agricultural land has risen by 50% this year. Foreign land ownership has become "a political flashpoint," said Micah Brown, a staff attorney for the National Agricultural Law Center at the University of Arkansas. Brown said the recent surge in state laws targeting land ownership by foreign entities stems from some highly publicized cases of Chinese-connected companies purchasing land near military bases.
There are three routes lawmakers and regulators could use to add coverage for weight-loss drugs. Older Americans hoping to get their hands on powerful weight-loss drugs such as Ozempic and Wegovy may find it impossible to access them. Should Medicare cover weight loss medication, it could also unlock access for people who have private coverage. "A decision by Medicare to cover weight-loss drugs would put pressure on employers and other private insurers to cover weight-loss drugs too," said Tricia Neuman, a senior vice president at KFF who co-authored a recent brief on the subject. There are three potential strategies that could be used to expand Medicare coverage to weight-loss drugs.
A Bipartisan Gun Control Measure - The New York Times
  + stars: | 2023-05-21 | by ( Gordon Witkin | ) www.nytimes.com   time to read: +3 min
The law expands the gun purchase prohibition for people convicted of domestic violence or subject to a restraining order to include dating partners, not just people married to or living with the victim. Reformers applauded this closing of the boyfriend loophole, but the worry is that many criminal history records don’t clarify whether such relationships existed. Some of the families sued in 2018 after the Air Force admitted it had not reported the violent history of the gunman, Devin Kelley, including a 2012 conviction for domestic assault, to the NICS system. A more basic NICS flaw involves simply identifying the prospective gun buyer. I’ll stipulate that for successful purchasers, all traces of the search would need to be destroyed immediately to satisfy privacy concerns.
Opinion | Legalizing Marijuana Is a Big Mistake
  + stars: | 2023-05-17 | by ( Ross Douthat | ) www.nytimes.com   time to read: +3 min
But Lehman explains in detail why the second-order effects of marijuana legalization have mostly vindicated the pessimists and skeptics. But Lehman argues that there is also no good evidence so far that legalization reduces racially discriminatory patterns of policing and arrests. Most casual pot smokers won’t have this experience, but the legalization era has seen a dramatic increase the number of non-casual users. Because of all the years of prohibition, a mature and supple illegal marketplace already exists, ready to undercut whatever prices the legal market charges. So to make the legal marketplace successful and amenable to regulation you would probably need much more enforcement against the illegal marketplace — which is difficult and expensive and, again, obviously uncool, in conflict with the good-vibrations spirit of the legalizers.

Supreme Court Justice Clarence Thomas — who accepted lavish gifts and luxury vacations from a billionaire for years — signed off on a Supreme Court opinion Thursday arguing that a law prohibiting taking bribes is too vague to be fairly enforced. Justice Neil Gorsuch wrote in a concurring opinion — on which Thomas signed off — that a federal anti-bribery law wasn't clear enough. "To this day, no one knows what 'honest-services fraud' encompasses," Gorsuch wrote. Crow described Thomas as a friend and insisted he never sought to influence the conservative Supreme Court justice. Additionally, the Senate Judiciary Committee asked Crow for a list of any gifts he's given to a Supreme Court justice or their family.
