Since the early days of the coronavirus pandemic, when cruise ships filled with sickened passengers were blocked from U.S. ports, residents in Key West, Fla., have been trying to limit the size and number of vacation vessels on the tiny island, using the momentum created during the pandemic to argue for continuing restrictions on cruise vessels. Ron DeSantis, void the new restrictions the following year. Now the wealthy hotelier who operates Key West’s cruise ship port is doubling down, asking the state for permission to expand, which would allow bigger ships with more passengers to operate legally out of the port. They represent the moral and philosophical foundations for the concrete constitutional rules of culture war that directly apply on campus. One of the most powerful and compelling arguments for free speech in American history was born out of mob suppression. In 1860, Frederick Douglass wrote his “Plea for Free Speech in Boston” after a violent mob shut down an antislavery event. Every college and university — public or private — that receives federal funds has an affirmative duty to protect students’ civil rights. In the recent past, schools have sometimes been too enthusiastic about stopping harassment, defining the term so broadly that university anti-harassment policies actually violate students’ free speech rights.

Some officials’ social media accounts have become vital forums for speech relating to those officials’ exercise of government power, and for speech about public policy more broadly. Those two lawsuits are about government officials’ use of social media. Two of the cases concern the constitutionality of social media laws enacted by Florida and Texas. Both states’ laws also require the platforms to provide explanations to users whose posts the platforms take down. A threshold question the court will have to answer is whether platforms’ content moderation policies reflect the exercise of editorial judgment, since editorial judgment is protected by the First Amendment.
