HENRY TAYLOR How the figurative painter made portraiture the dominant mode of art in our era — and changed the way America sees itself. The bulk of the Trump PAC money went to law firms that have defended Trump against a series of criminal charges or in civil lawsuits. “Well, if the little fish’s lawyer is being paid by the big fish that’s less likely to happen potentially.”The Trump campaign did not respond to a request for comment. That money is earmarked for political and campaign activities, not for legal expenses, according to the campaign. To help pay the legal fees, Trump’s political operation has also moved millions from his super PAC, MAGA Inc. Those concerns are amplified in court records filed by Smith’s team in the Mar-a-Lago case.

Former President Donald Trump's lawyers told a court Tuesday that they are appealing a narrow gag order imposed on him in his federal 2020 election interference case. But Chutkan, who was appointed by President Barack Obama, said Trump can't mount a “smear campaign” against prosecutors and court personnel. At rallies and in social media posts, Trump has repeatedly sought to vilify Smith, other prosecutors, likely witnesses and even the judge. Smith’s team argued that Trump knows that his incendiary remarks could inspire his supporters to threaten or harass his targets. The case, which accuses Trump of scheming to subvert the results of the election, is scheduled to go to trial in March.

Reuters reported on Friday that Jeff Smith’s Starboard is the latest activist to try and unlock value at News Corp (NWSA.O), the publisher of the Wall Street Journal, owner of book conglomerate HarperCollins and Realtor.com. Starboard, which took a position in the $13 billion company, is pushing for a spinoff of the real estate assets, according to the Wall Street Journal. “This is not about whether I like the language Mr. Trump uses,” Judge Tanya Chutkan said. Trump will appeal Chutkan’s order, he said in a post on his social media website Truth Social. Following the two federal indictments against the former president, Trump has lashed out against prosecutors, potential witnesses and the judge overseeing the election subversion case in Washington. “When you start to use a word like ‘thug’ to describe a prosecutor doing their job, that wouldn’t be allowed by any other criminal defendant,” Chutkan said. CNN —Will Smith has shared his thoughts on Jada Pinkett Smith’s new memoir. The pair have been the subject of multiple headlines since Pinkett Smith revealed last week that the pair have been separated since 2016. Pinkett Smith confirmed what her mother said. “During Pinkett Smith’s appearance on the “On Purpose with Jay Shetty,” which debuted Monday, Shetty read a letter he said was from Smith. “That’s why I can’t divorce that joker.”In making her original revelation that she and Smith had split, Pinkett Smith told NBC’s Hoda Kotb they are still leagally married.

The gag order fight underscores the unprecedented complexities of prosecuting the former president as he tries to retake the White House while fighting criminal charges in four cases. The defense had claimed Chutkan's comments about Trump in other cases raised questions about whether she had prejudged his guilt. But Chutkan said her comments were mischaracterized and there was no need for her to step aside. Prosecutors noted in a recent motion that Trump's incendiary rhetoric has continued even after their initial gag order request. Prosecutors have said their proposal would not impact Trump's ability to campaign or prevent him from publicly declaring his innocence.

Though limited in scope, the gag order from Judge Tanya Chutkan is likely the biggest limit on the former president’s speech he has ever been handed. Chutkan outlined the order in court and plans to issue a more detailed written order in the coming days. That order bars Trump only from speaking publicly about the court staff in his civil fraud trial. Chutkan also said she believed she could issue a show-cause order, which would require Trump justify why he breached the rules of the gag order. Violations of the gag order may not necessarily need to be raised by prosecutors for Chutkan to impose a penalty, she said.

Judge Orders Trump to Rein In Incendiary Language

“This is not about whether I like the language Mr. Trump uses,” U.S. District Judge Tanya Chutkan said in announcing the decision. But Molly Gaston, who argued for the prosecution, underscored that the Justice Department isn’t seeking to prevent Trump from campaigning. Notably, the judge’s order deals Trump one of the first major consequences he’ll have to reckon with in relation to his ongoing trials. It remains to be seen how the order will impact his daily social media presence and campaigning tactics. Trump did not immediately respond directly to Chutkan’s order, but a spokesman called it the work of “weaponized and targeted law enforcement.”

FORT PIERCE, Fla. (AP) — A judge on Thursday scolded federal prosecutors in the classified documents case against former President Donald Trump as she abruptly postponed a hearing to determine if the lawyer for a co-defendant had a conflict of interest. U.S. District Judge Aileen Cannon accused prosecutors of “wasting the court's time” by raising new arguments that they had not made in earlier court filings. She said she would set a hearing for a later date for Walt Nauta, a Trump valet charged with conspiring with Trump to conceal classified documents from investigators. Both men were charged alongside Trump with obstructing government efforts to recover classified documents hoarded at Mar-a-Lago, the former president's Florida estate. De Oliveira is accused of lying to investigators when he claimed — falsely, prosecutors say — he hadn’t even seen boxes moved into Mar-a-Lago after Trump left the White House.

CNN —Former President Donald Trump will be in attendance Monday in a New York courtroom for the start of the civil fraud trial against him, his eldest sons, their companies and Trump Organization executives. What’s the impact of the fraud ruling? While Trump can opt to waive his presence at the civil trial, attorneys for the former president have indicated that he is eager to testify in court. Two criminal cases against Trump are scheduled for trial in March in New York and Washington, DC. While dates from that period had already been rescheduled, now the remainder of their “Peace Out” tour dates over October, November and December will be rescheduled as well. CNN —The federal judge overseeing Donald Trump’s federal 2020 election subversion criminal case will not disqualify herself from the matter, rejecting a longshot bid from the former president’s team to remove her from the case. In her 20-page ruling on Wednesday, Judge Tanya Chutkan spells out her approach to previous US Capitol riot defendants appearing before her and why she mentioned Trump during those hearings. “Presidents are not kings, and Plaintiff is not President,” Chutkan wrote in November 2021. Trump’s lawyers’ “inferential leap” based on her comments in other criminal cases “is not reasonable,” she wrote. This story has been updated with additional details.

Trump had already publicly attacked Smith’s request, arguing it was an attempt to limit his criticism of the President Joe Biden, his likely opponent in the 2024 election. Prosecutors said Trump has a history of inspiring his supporters to harass and threaten people he singles out for public criticism. Trump continues to make the false claim that his loss was the result of fraud.

Lawyers for former President Donald Trump are slamming prosecutors' request for a narrow gag order in his 2020 election subversion case in Washington, calling it an effort to “unconstitutionally silence” his political speech. In court papers filed late Monday, attorneys for Trump urge U.S. District Judge Tanya Chutkan to deny the proposal to bar the Republican ex-president from making inflammatory and intimidating comments about witnesses, lawyers and other people involved in the criminal case. "If the prosecution wishes to avoid criticism for abusing its power, the solution is simple: stop abusing its power. Prosecutors told the judge that a “narrow, well-defined” order was necessary to preserve the integrity of the case and to avoid prejudicing potential jurors. There's a high bar for recusal, and Smith’s team has said there is no valid basis to have the judge removed from the case.

Zadie Smith Drops In; Drew Barrymore Is Eased Out
  + stars: | 2023-09-22 | by ( ) www.nytimes.com   time to read: +1 min
Zadie Smith’s new novel, “The Fraud,” is set in 19th-century England, and introduces a teeming cast of characters at the periphery of a trial in which the central figure claimed to be a long-lost nobleman entitled to a fortune. Smith drew many of the book’s details from the historical record — the trial and the main characters all existed much as they appear in the novel — but as she tells Sarah Lyall on this week’s episode, her archival research was far from dusty or dutiful. “‘Research’ makes it sound really heavy,” Smith says. “It was actually a joy to read about this period and to read books set in the period. We would love to hear your thoughts about this episode, and about the Book Review’s podcast in general.

Attorney General Merrick Garland said he was not instructed to charge Donald Trump with federal crimes, pushing back against comments made by the former president over the weekend. Trump told NBC that the charges he’s facing as part of special counsel Jack Smith’s classified documents and election interference probes are “Biden political indictments,” and that Biden “said to the attorney general ‘indict him.’”Democratic Rep. Adam Schiff of California asked Garland to respond to the allegation, “Was [Trump] telling the truth or was he lying when he said the president told you to indict him?”“No one has told me to indict,” Garland said, “and in this case the decision to indict was made by the special counsel.”“So that statement the president made on Sunday was false,” Schiff asked. Garland again repeated that “no one has told me who should be indicted in any matter like this, and the decision about indictment was made by Mr. Smith,” referring to special counsel Jack Smith.

Judiciary Chairman Jim Jordan, one of the three committee chairs spearheading the impeachment inquiry, accused the Justice Department of not prosecuting Hunter Biden over the tax years when Hunter Biden was on the board of Ukrainian energy firm Burisma. “I’m going to say again, and again, if necessary, I did not interfere with, did not investigate, did not make determinations” on the Hunter Biden case, the attorney general said. I made him special counsel,” Garland said.

CNN —Attorney General Merrick Garland forcefully rebuked congressional Republicans who have accused the Justice Department of political bias as he opened a contentious House Judiciary Committee hearing in Washington on Wednesday. Even with the face-saving indictment last week of Hunter Biden, everyone knows the fix is in,” House Judiciary Chairman Jim Jordan said in his opening statement. The House Judiciary Committee has also been probing allegations from an IRS whistleblower that the Justice Department investigation into Hunter Biden was politically tainted. “House Republicans will use their time today to talk about long-discredited conspiracy theories and Hunter Biden’s laptop. Several House Republicans – including McCarthy – have floated an impeachment of the attorney general, although those calls have quieted down as House Republicans have turned their impeachment lens on President Joe Biden himself.
