Philadelphia District Attorney Larry Krasner on Monday testified that Tesla CEO Elon Musk and his political action committee know they are conducting an "illegal" lottery by giving away $1 million to registered voters in Pennsylvania and other swing states before Election Day. "They know what they're doing is illegal and they are doing everything under the sun to clean it up," Krasner said. "There is no First Amendment right to commit crimes," the DA testified in the Philadelphia County Court of Common Pleas. "There is no First Amendment right to commit fraud." Under questioning by attorney John Summers, who is representing Krasner's office, the DA said the fact that he is a Democrat had nothing to do with his decision last week to sue the billionaire Musk and America PAC over the daily giveaway, which is due to end Tuesday.

Just 2% of voters say they’re unsure about the choice. Trump, meanwhile, leads among rural voters (75%-23%), white voters (56%-42%) and white voters without college degrees (64%-34%). This net gender gap of 34 points is larger than the 30-point gap in October’s NBC News poll. That’s a significant change from the final 2020 NBC News poll, when Biden was ahead of Trump by more than 20 points among these voters. And when it comes to the battle for Congress, 47% of voters say they prefer Democrats control Congress, while 46% want Republicans in charge.

In October, the Centers for Disease Control and Prevention recommended that high-risk adults get a second updated Covid vaccine to bolster their protection against the virus. No other vaccines are given at such a high frequency, but experts say there’s no reason to believe that the vaccines — and in particular, the mRNA vaccines from Pfizer and Moderna — aren’t effective. Pfizer’s and Moderna’s vaccines were the first to use mRNA technology to induce immunity to a virus, an approach that proved critical in the early days of the pandemic because mRNA vaccines can be developed much faster than traditional vaccines. Despite the CDC recommending an additional shot, there’s no evidence that the mRNA vaccines aren’t working as expected, said Akiko Iwasaki, a professor of immunology at the Yale School of Medicine. In a perfect world, the Covid vaccines would be able to be updated much faster to match the strains in circulation.

With Election Day around the corner, there's been just shy of $1 billion spent on political ads up and down the ballot in the last week, data from the ad-tracking firm AdImpact shows. The most expensive race over the last week is, unsurprisingly, the presidential race, where more than $272 million has been spent on ads, according to data from AdImpact. There's been more than $267 million spent on ads in down-ballot races, meaning all of the other races outside of races for president, governor and Congress. One other down-ballot race saw more than $10 million in ad spending over the last week: California's referendum on rent control. Governors races have had just $18 million in ad spending in the last week, thanks to a relative lack of competitive races this cycle.

Abigail Spanberger decided against seeking a fourth term, instead launching a campaign for governor in 2025. Democratic Rep. Jared Golden has crafted a moderate profile by challenging his party on issues ranging from spending to immigration. This year she faces a challenge from GOP state Rep. Gabe Evans, a fellow Mexican American and a former Army helicopter pilot and police officer. GOP Rep. Zach Nunn, an Air Force officer, was first elected in 2022 – defeating Democratic Rep. As polls show a dead heat between former President Donald Trump and Vice President Kamala Harris in the final days of the race, news outlets are preparing an anxious nation for the likelihood that election night will stretch into an election week. Most major media outlets around the country rely on a handful of organizations to crunch the numbers and make race calls. “We’re also going to be really transparent about why we may not be able to call a race,” Pace said. In 2020, Joe Biden was not declared the winner of the presidential election until Saturday, several days after election night.
