CNN —The Supreme Court declined Tuesday to let Robert F. Kennedy Jr. withdraw his name from ballots in Michigan and Wisconsin, battleground states where votes for his now suspended campaign could cut into support for former President Donald Trump. Kennedy, who left the presidential race in August and endorsed Trump, urged the Supreme Court in an emergency appeal to force the states to yank his name from the ballots. The Supreme Court handed down its decision without further explanation, which is common on its emergency docket. The Supreme Court also rejected that request. “This election is not merely ‘imminent,’ it is already underway, and voters are already voting,” Michigan officials had told the Supreme Court.

CNN —Former President Donald Trump on Tuesday claimed two Pennsylvania counties are experiencing voter fraud despite both officials there maintaining they’re still investigating potential issues related to voter registration applications. “This on top of Lancaster County being caught with 2600 Fake Ballots and Forms, all written by the same person. While announcing the suspected fraud, Lancaster officials said at least two other counties may have also received fraudulent voter registration applications. On Tuesday, York County spokesperson Greg Monskie would not confirm to CNN whether it had received fraudulent voter registration applications and couldn’t speak to any connection with the issues alleged in Lancaster County. The interaction took place at the Voter Service Center in Media, Pennsylvania, the seat of the suburban Philadelphia county.

With one week until the Nov. 5 election, early voting is underway in all seven battleground states, along with dozens of others. While millions of Americans have stood in line to cast ballots in person, another 20 million have mailed in their ballots. The 46.5 million early votes are almost evenly split between ballots cast in person versus by mail, according to the University of Florida's Election Lab. Georgia also smashed its first-day early voting record with an estimated 310,000 ballots cast on Oct. 15. By Tuesday, just under 3 million ballots had been received.

Early voting in Georgia and North CarolinaWhile preelection turnout is generally down, Georgia is an outlier. Consistent with that hypothesis, the below table of early voting through Oct. 26 shows substantial leveling in the usage of early voting over different areas. One of the broader challenges of interpreting early vote totals in most states is the lack of sufficient historical data to benchmark against the current returns. The below table shows the number of recent elections in which this year’s Virginia early voters participated. Just as previous research suggests, an overwhelming number of the absentee ballots cast so far have been cast by consistent voters.
