An Alabama inmate convicted in a 1994 murder is poised to die Thursday in the state's third nitrogen hypoxia execution this year. Carey Dale Grayson asked to have his execution carried out by nitrogen gas. It refused to do so when Alabama executed Kenneth Smith, the first person in the U.S. to die in a nitrogen gas execution, in January and again in September, when the state executed Alan Miller in a second nitrogen gas execution. Since then, Alabama has become the first state to develop a nitrogen hypoxia execution protocol in addition to lethal injection. “The State of Alabama’s nitrogen protocol has been used twice and has not worked as they swore it would.

At the hearing, David Smith pointed to his ex-wife’s record as he told the parole board that 30 years is simply not enough time for Susan Smith to spend in prison. The father said he questioned whether he could go on after Susan Smith killed their sons. Susan Smith’s attorney, Tommy A. Thomas, did not respond to a request for comment before or after Wednesday’s parole hearing. The parole board really listens to that,” said Hayden Smith, who conducts research for the state’s department of corrections and has interviewed Susan Smith while incarcerated. CNN —Richard Allen has been found guilty of two counts of murder and two counts of felony murder in the highly publicized Delphi murder trial, according to CNN affiliate WTHR. Delphi law enforcement have long held they believe the “Bridge Guy” shown in the video is the main suspect in the case. Prosecutors drew attention to the .40-caliber unspent round found by the girls’ bodies, which a prosecution expert testified matched Allen’s pistol. The prosecution has also tried to match Allen with the video and audio recording of the “Bridge Guy” captured on Libby’s cellphone. “Richard Allen is ‘Bridge Guy,’” McLeland told jurors.

CNN —A federal judge granted Idaho serial killer Thomas Creech a stay of execution just one week before he was scheduled to be put to death, months after he survived a botched execution. They also argued Creech was left traumatized after an execution team made eight attempts to start the IV line. On Wednesday, Judge G. Murray Snow granted Creech a reprieve, as the Idaho Supreme Court decision denying his claims came about a week before his scheduled execution. Creech is now required to file a supplemental brief by Friday, court documents say, and his case will continue. In the execution chamber, “the team attempted eight times through multiple limbs and appendages to establish IV access consistent with” the department’s policy, Tewalt said.

Jurors will deliberate from 9 a.m. to 4 p.m. Monday through Saturday until they reach a verdict, according to WTHR. Last month, 16 Allen County residents were selected to serve on the jury, including four people serving as alternates, WTHR said. “I believe the evidence is firmly convincing that Richard Allen is Bridge Guy and he killed Abby and Libby,” McLeland told the jury. Prosecutors drew attention to the .40-caliber unspent round found by the girls’ bodies, which a prosecution expert testified matched Allen’s pistol. He also pointed out that Allen still lived in Delphi for more than five years after the girls were killed.

BOISE, Idaho — A federal judge has temporarily halted the planned execution of an Idaho man on death row whose first lethal injection attempt was botched earlier this year. Thomas Eugene Creech was scheduled to be executed by lethal injection Nov. 13 — roughly nine months after the state first tried and failed to execute him. Execution team members tried eight locations in Creech’s arms and legs on Feb. 28 but could not find a viable vein to deliver the lethal drug. Creech’s defense team also has other legal cases underway seeking to stop him from being put to death. He has been in prison for half a century, convicted of five murders in three states and suspected of several more.

Prosecutors say Allen actually confessed over 60 times to the murders while in prison, to his wife, his mother, family members, the prison warden, the psychologist who treated him in prison, other prison employees and other inmates. The jury on Thursday heard recordings of seven prison phone calls Allen made to his wife and mother, according to WTHR. Monica Wala, the prison psychologist who treated Allen at Westville Correctional Facility, testified for the prosecution that he confessed to the crimes multiple times, once in great detail, according to WTHR. He also spoke about wanting to go back and change his actions and apologize to the families, Wala testified. He had a serious mental health history and had experienced both major depressive disorder and anxiety disorder, Wala testified during cross-examination.

A woman convicted of dressing up as a clown in 1990 and murdering the wife of a man she later married has been released from prison, putting to rest one of the more bizarre cold cases Florida has ever seen. Keen-Warren was arrested in 2017 in Washington County, Virginia, in connection with Warren’s 1990 murder. Initially, suspicion quickly focused on Michael Warren, the victim’s husband, as friends and family said the couple was having marital problems. Michael Warren served three years in prison, and in 1997 he vanished. But he re-emerged in 2002, marrying Sheila Keen — the same Sheila Keen-Warren who’s now charged with his ex-wife’s murder.

LOS ANGELES — California and Nevada voters are weighing whether to repeal legal loopholes in their state constitutions that allow slavery and involuntary servitude to be used as criminal punishment. California and Nevada would join a growing national trend that started with voters in Colorado repealing involuntary servitude in 2018. Slavery and involuntary servitude were banned nationally by the 13th Amendment with one exception — as punishment for a crime. In 2016, Shawna Lynn Jones became the first incarcerated woman to die while fighting a fire in California, according to the state corrections department. Moore is the last person remaining on South Carolina’s death row to be convicted by a jury with no Black members, his defense attorneys say. “No other South Carolina death penalty case has involved an unarmed defendant who defended himself when the victim threatened him with a weapon,” they said in a statement. “He’s a human being who made mistakes,” Lyndall Moore told the AP. Moore’s attorneys responded Wednesday the case’s “unique procedural backdrop” should allow the justices to consider their arguments. New York CNN —Wall Street traders are popping champagne and toasting the two-year anniversary of a period of outsized gains known as a bull market. What makes this bull market unusual is how much uncertainty and economic worry investors have had to contend with during its run. Historically, bull markets recover around 194% of the previous downturn, according to Sam Stovall, chief investment strategist at CFRA. While the first two years of a bull market often see significant gains, history shows that the third year can bring challenges, said Stovall. On average, bull markets entering their third year post a modest return of just 2%.

WASHINGTON — The Supreme Court on Wednesday will weigh whether inmate Richard Glossip's murder conviction should be thrown out — an unusual death penalty case in which the attorney general of Oklahoma has sided with a defendant. Oklahoma Dept of Corrections / via Reuters fileThe Supreme Court previously signaled an interest in Glossip's case by stepping in last year to prevent him from being executed. Eight states including Texas and Utah have urged the Supreme Court to uphold the Oklahoma court ruling. Utah, joined by six other states, filed a brief arguing that the Supreme Court had no business intervening in the case, which was focused on Oklahoma state law. If the court is divided 4-4, as is possible, then the state court ruling against Glossip would remain in place.

Viewers tuning into NFL and college football games in recent weeks have been bombarded with two Trump ads — running nationally and locally in swing states — that take issue with Vice President Kamala Harris’ past support for taxpayer-funded gender-affirming treatments. “So we’ll talk about it for them.”The Harris campaign declined to comment on the record. The two trans ads are Trump’s two most-seen commercials during professional and college football games, according to AdImpact, a firm that tracks political commercials and ad spending. Trump campaign officials say the ads will make it harder for Harris to make up ground with men, where polls show her trailing Trump. A Trump campaign official said the campaign's internal polling showed the ad was resonating with Black men — a demographic the campaign is courting.
