WASHINGTON — The Supreme Court could further weaken the power of federal agencies by agreeing on Friday to hear a dispute over a Federal Communications Commission program that requires companies to subsidize telecommunications services in underserved areas. The FCC case raises two interlinked issues, one of which concerns the broad question of whether Congress exceeded its powers. While the S & P 500 and Nasdaq 100 have both pushed to new all-time highs in November, market breadth indicators have mostly not confirmed those recent highs. Market breadth indicators like these are equal-weighted, meaning they simply count the number of stocks fulfilling a certain requirement. The change in that indicator over the last six weeks tells us that about 20% of the S & P 500 members have registered a sell signal on their point & figure charts! This chart shows the percent of stocks above their 200-day moving average, as well as the percent of stocks above their 50-day moving average as we quoted above. The S & P 500 continues to make higher lows, but a push below 5,850 would break that pattern which has been in place since August.

CNN —The International Criminal Court has issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu, former Defense Minister Yoav Gallant, and a senior Hamas official, accusing them of war crimes during and after the October 7 attacks on Israel last year. Citadel CEO Ken Griffin issued a warning against the steep tariffs President-elect Donald Trump vowed to implement, saying crony capitalism could be a consequence. "I am gravely concerned that the rise of tariffs puts us on a slippery slope towards crony capitalism," the billionaire investor said Thursday at the Economic Club of New York. Crony capitalism is an economic system marked by close, mutually advantageous relationships between business leaders and government officials. At the same event, Griffin also said that he's not focused on taking Citadel Securities public in the foreseeable future.

Comcast announced a plan Wednesday to spin off most of its cable television networks into a separate publicly traded company. The new company will include the USA Network, CNBC, MSNBC, Oxygen, E!, SYFY and the Golf Channel. Comcast will retain key NBCUniversal assets, including the NBC broadcast network, NBC News, NBC Sports, the streaming service Peacock, and the cable channel Bravo. The move comes as the traditional cable television bundle faces stiff economic headwinds, most notably the rise of cord-cutting and the shift to streaming alternatives. Matt Strauss will become chairman of the NBCUniversal Media Group.

☆ Euro-dollar parity is back in focus as Trump win sparks trade jitters

The euro has declined rapidly, meanwhile, briefly dipping below $1.05 on Nov. 14 for the first time since October 2023. Modeling by Barclays' economists shows the euro hitting dollar parity with a 10% tariff on European products and subsequent retaliation. The bank said the prospect of Trump tariffs and fiscal reforms had caused it to revise its view that the dollar would gradually decline through the year, instead seeing the U.S. currency "stronger for longer." Since hitting a low in September 2022, the euro has been comfortably back above parity even if below its long-range average. One of those 2022 factors roared back into focus this week, weighing broadly on European assets: the threat of escalating tensions with Russia.

One of the country's biggest cable TV companies doesn't want its cable networks anymore. That's the pitch Comcast is making Wednesday as it announces plans to split off almost all of its cable TV networks into a new company. Into the spinco goes every cable network Comcast owns except for Bravo. For the record: Comcast says it thinks the cable networks it is ditching can be successful on their own. And as I said last month: Comcast is getting rid of its basic cable networks for the same reason everyone who owns basic cable networks would like to get rid of their cable networks.
